Subject: Proposed Maintenance Dredging and Dredge Disposal

DEM has reviewed your plans of your request for 401 Water
Quality Certification to conduct maintenance dredging and
deepening of the Morehead City Inner Harbor Navigation Channel
and pump out of the Brandt Island upland diked disposal site. We
have determined that the proposed fill can be covered by
modifications to General Water Quality Certifications nos 1863,
1967 and 2365 as requested in your 8 December 1992 letter. This
approval shall expire three years from the date of this letter.

This is a request to amend Water Quality Certification
No. 1967, issued January 4, 1984, as amended in 1991, and Water
Quality Certificate No. 2365, issued August 11, 1989, to cover
the disposal of dredged material on Bogue Banks from the combined
maintenance dredging and deepening of the Morehead City Inner
Harbor Navigation Channel and pumpout of the Brandt Island upland
diked disposal site, Carteret County, North Carolina (enclosed
figure 1).
The disposal of dredged material on the ocean beach along
Fort Macon and Atlantic Beach is authorized under Section 401
(P.L. 95-217) Water Quality Certificate No. 1967, issued by the
North Carolina Division of Environmental Management (NCDEM) on
January 4, 1984, as amended, on September 10, 1991. As stated in
the September 10, 1991, amendment, the water quality certification
expires 3 years from issuance (September 10, 1994). Water Quality
Certificate No. 2365 was issued on August 11, 1989, for the
disposal of dredged material on the beach of Pine Knoll Shores
from the maintenance dredging of the Atlantic Intracoastal
Waterway, Section I, Tangent B, Carteret County, North Carolina.
The U.S. Army Corps of Engineers is requesting that the NCDEM
amend Water Quality Certificate Nos. 1967 and 2365, respectively,
to cover disposal of dredged material on Bogue Banks (Fort Macon
State Park to Pine Knoll Shores) from the combined maintenance
dredging and deepening of the Morehead City Harbor Inner
Navigation Channels and the pumpout of the Brandt Island upland
diked disposal site.
Water Quality Certificate No. 1863 was issued by the North
Carolina Division of Environmental Management on December 10,
1985, and modified March 4, 1986, to place dredged material from
Brandt Island on the beaches of Bogue Banks and in the access
channel into Brandt Island for closure of the channel upon
completion of the pumpout operation. There is no time limit on
this certification.

The disposal of dredged material from the combined actions
is scheduled to start September 1, 1993, and end March 15, 1994.
An Environmental Assessment has been prepared pursuant to the
National Environmental Policy Act of 1969, as amended, and is
being circulated to Federal and State agencies and the interested
public. A public notice will also be circulated prior to
construction.
