Kramer SUBJECT: Application for Pump and Haul Permit Permit No. WQ0019660 DuPont Fayetteville Works BladenCounty On February 19, 2001, the Fayetteville Regional Office received an application submitted by DuPont Fayetteville Works, Bladen County, NC for a pump and haul permit. Based on the information included in the project application DuPont Fayetteville Works will be pumping and transporting the following amounts to the following wastewater treatment plant: a. 110 truck loads per day, with 55 truck loads going to the PWC Cross Creek WRF and 55 truck loads going to the PWC Rockfish WRF and, b. 100,000 gpd going to the DuPont Cape Fear Plant, Wilmington, NC and C. 150,000 gpd going to the DuPont Fibers, Kinston, NC and d. 60,000 gpd going to the N.H. Larkins, City of Clinton WWTP. This Permit is issued to DuPont Fluoroproducts, Fayetteville Works for the operation of a pump and haul system. This permit shall be effective from February 22, 2001 until midnight March 31, 2001, and shall be subject to the conditions and limitations as specified herein. If any parts, requirements, or limitations contained in this Permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within 30 days following receipt of this Permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Box 11666, Raleigh, NC 27604. Unless such demands are made, this Permit shall be final and binding. The amount of wastewater and location is as follows: a. 110 truck loads per day, with 55 truck loads going to the PWC Cross Creek WRF and 55 truck loads going to the PWC Rockfish WRF and, b. 100,000 gpd going to the DuPont Cape Fear Plant, Wilmington, NC and C. 150,000 gpd going to the DuPont Fibers, Kinston, NC and d. 60,000 gpd going to the N.H. Larkins, City of Clinton WWTP. This Permit will be effective from the date of issuance until March 31, 2001, and shall be subject to the following specified conditions and limitations: 1. This Permit shall become voidable unless the subject pump and haul activities are are carried out in a manner which has been approved by the Fayetteville Regional Office. 2. This Permit is effective only with respect to the nature and volume of wastes described in the information provided by DuPont Fayetteville Works. 3. The facilities shall be properly maintained and operated at all times. 4. This Permit is not transferable. 5. No type of wastewater other than that from the butacite production area shall be included in the pump and haul activities. DEQ-CFW 00061816 DuPont Fluoroproducts Pump and Haul Permit Page 2 6. The Permit shall become voidable unless the PWC Cross Creek WRF, PWC Rockfish WRF, DuPont Cape Fear Plant, Wilmington, NC, DuPont Fibers, Kinston, NC WWTP and City of Clinton WWTP remains fully capable of treating waste generated at this facility. 7. In the event the facilities fail to perform satisfactorily, including the creation of nuisance conditions, DuPont Fluoroproducts Fayetteville Plant shall cease operation of all pump and haul activities and take such immediate corrective action as necessary, including those as may be required by this Division. 8. This pump and haul permit shall not be renewed. 9. The wastewater collected by this system shall be treated by the PWC Cross Creek WRF, PWC Rockfish WRF, DuPont Cape Fear Plant, Wilmington, NC and/or DuPont Fibers, Kinston, NC prior to being discharged into the receiving stream. 10. DuPont Fluoroproducts Fayetteville Plant is liable for any damage caused by a spill or failure of the pump and haul operations. 11. Adequate inspection, maintenance, and cleaning shall be provided by the DuPont Fluoroproducts Fayetteville Plant to ensure proper operation of the subject facilities. 12. The DuPont Fluoroproducts Fayetteville Plant or his designee shall inspect the pump and haul collection facilities a minimum of two (2) times per day, five (5) days per week to prevent malfunctions and deterioration, operator errors, and discharges which may cause or lead to the release of waste to the environment, a threat to human health, or a nuisance. The DuPont Fluoroproducts Fayetteville Plant shall keep an inspection log or summary including at least the name of the person conducting the inspection, the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the DuPont Fluoroproducts Fayetteville Plant for as long as the pump and haul activities are being conducted and shall be made available upon request to the Division of Water Quality or other permitting authority. 13. Any duly authorized officer, employee, or representative of the Division of Water Quality may, upon presentation of credentials, enter and inspect any property, premises, or place, on or related to the pump and haul collection facilities at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any record that must be kept under the terms and conditions of this permit; and may obtain samples. 14. An accurate record of the pump and haul activities must be maintained by the DuPont Fluoroproducts Fayetteville Plant, indicating: a. Date wastewater is removed from the facility. b. Name of facility from which wastewater is removed. C. Name of facility receiving wastewater. d. Volume of wastewater removed. DEQ-CFW 00061817 DuPont Fluoroproducts Pump and Haul Permit Page 2 15. Failure to abide by the conditions and limitations contained in this Permit may subject the DuPont Fluoroproducts Fayetteville Plant to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6. 16. The issuance of this Permit does not preclude the DuPont Fluoroproducts Fayetteville Plant from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which may have jurisdiction. 17. Noncompliance Notification: The DuPont Fluoroproducts Fayetteville Plant shall report by telephone to the Fayetteville Regional Office, telephone number 910-486-1541, as soon as possible, but in no case more than 24 hours or on the. next working day following the occurrence or first knowledge of any of the following: a. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors, etc. b. Any failure of a pumping station, sewer line, etc., resulting in a by-pass directly to receiving waters without treatment of any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall file a written report in letter form within 5 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. Permit issued this the 22th day of February, 2001.
