Dear Mr. McGaughy:
In accordance with your permit application received June 20, 2011, we are forwarding herewith
Permit No. WQ0035431, dated October 28, 2011, to DuPont Company — Fayetteville Works for the
operation of the subject residuals management program.
This permit shall be effective from the date of issuance until August 31, 2016, and shall be
subject to the conditions and limitations as specified therein. Please pay particular attention to the
monitoring requirements listed in Attachments A. Failure to establish an adequate system for collecting
and maintaining the required operational information shall result in future compliance problems.
Please be aware that if analysis results show that the cumulative loading limits are being
exceeded for the contaminants listed in Condition II.4 the Permittee will be required to find additional
land application sites within the DuPont property before another land application event occurs. Our
Fayetteville Regional Office will assist the Permittee with finding these sites.
If any parts, requirements or limitations contained in this permit are unacceptable, the Permittee
has the right to request an adjudicatory hearing upon written request within 30 days following receipt of
this permit. This request shall be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings at 6714 Mail
Service Center, Raleigh, NC 27699-6714. Unless such demands are made, this permit shall be final and
binding.
