Dear Mr. Johnson:
This letter is to confirm that the Hazardous Waste Section (HWS) no longer requires facilities to submit
an Annual Report as required in permit condition I.G. The report is now due biennially as stated in 40
CFR 264.75 as adopted in 15A NCAC 13A .0109. Rather than revise each of the permits from annual to
biennial, the HWS decided to use enforcement discretion when inspecting facilities.
