Dear Ms. Beischer:
On July 1, 2009, the Division of Water Quality(DWQ)received your application dated July 1, 2009 to
place fill within or otherwise impact 0.035 acres of 404/wetland(temporary impact), 275 linear feet of
permanent, perennial stream impact, 272 linear feet of temporary, perennial stream impact, 20 linear feet
of temporary, intermittent stream impact, 29 linear feet of temporary, isolated intermittent stream impact,
0.54 acres of open water(pond), and 16,061 square feet of Zone 1 Neuse River basin protected riparian
buffers and 10,548 square feet of Zone 2 Neuse River basin protected riparian buffers to construct the
proposed residential development on the subject property. The DWQ has determined that your
application was incomplete and/or provided inaccurate information as discussed below. The DWQ will
require additional information in order to process your application to impact protected wetlands and/or
streams on the subject property. The DWQ will require additional information in order to process your

receive five copies of the additional information requested below, we will place this project on hold as
incomplete until we receive this additional information. If we do not receive the requested information,
your project will be formally returned as incomplete. Please provide the following information so that we
may continue to review your project.
Additional Information Requested:
1. Diffuse Flow Plan
a. To meet the diffuse flow requirements, a 50-foot minimum width of the filter strip is
required. Unless the vegetation downstream of each proposed 30-foot grass filter strip is
considered "dense vegetation",you will need to revise the level spreader length calculations.
The filter strip width is measured from the level spreader lip to the top of stream bank. The
required filter strip length per cfs of flow shall be calculated as a weighted average of the
lengths required for each vegetation type and/or density. Please refer to Section 13.3.4 of the
NCDWQ BMP Manual for further guidance.

b. Please provide photos of the vegetation within the area below the 30-foot filter strip for each
level spreader.
Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this
information to me. If you will not be able to provide the requested information within that timeframe,
please provide written confirmation that you intend to provide the requested information, and include a
specific timetable delineating when the requested materials will be provided. If we do not hear from you
in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider
the project as returned.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized(at
