Dear Mr. Sanders:
This 'letter is in response to the pre-discharge notification that was
received from you.concerning a proposed project called Autumn Brook in New
Hanover County, North Carolina (copy enclosed). Your pre-discharge
notification indicates that total-adverse impacts to waters of the United
States and/or adjacent wetlands will be no.more than 1.95 acres for the total
project.
The period allowed by reguaation for us to review your pre-discharge
notification has expired. Consequently, your proposed project is authorized
provided it complies with the criteria for authorization by Nationwide Permit
#26.
A:separate Department of the Army permit is not required providing the
work is performed as indicated on the pre-discharge notification and in
accordance with the conditions listed in 33 CFR 330.5(bj(1-14) (copy of list
enclosed). Other. State and local authorizations may also be required.
This verification will be valid until the nationwide permit is modified,
reissued or revoked. All nationwide permits are scheduled to be modified,
reissued o>,crevoked prior to November 13, 1991.7 It is incumbent upon you to
rema,g Afbrmed of.changes to the nationwide permits. We will issue a public % notice announcing changes,when they occur.. Furthermore, if you commence or
;are `. under contract to commence this activity before the date the nationwide
e:rmit is modified or revoked, you will have twelve months from the date of
the modification or revocation to complete the activity under"the present

INFORMATION SHEET - NATIONWIDE PERMIT 26 REGULATORY
1. Nationwide permit 26 authorizes the discharge of dredged or fill material
which will cause the loss or substantial adverse modification of less than 10
acres of (i) non-tidal rivers, streams, and their lakes and impoundments,
including adjacent wetlands, that are located above the headwaters; and (ii)
other non-tidal waters of the U.S., including adjacent wetlands, that are not
part of a surface tributary system (i.e., isolated waters). The district
engineer must be notified if the discharge will cause the loss or substantial
adverse modification of 1 to 10 acres of such waters.
- 2. The applicant shall not begin discharges requiring pre-discharge
notification under nationwide permit 26:
a. Until notified that the work may proceed under the nationwide permit
with any special conditions imposed by the district or division engineer, or
b. If notified that an individual permit may be required, or
c. Unless 20 days (calendar) have passed from the time the notification
is received by the district engineer and no notice has been received from the

district or division engineer.
3. Notification under NWP 26 must be in writing and include the following:
a. Name, address and phone number of applicant;
b. Location of the planned work;
c. Brief description of the proposed work, its purpose, and the
approximate size of the waters, including wetlands, which would be lost or
substantially adversely modifiedas a result of the work; and
d. Any specific' information required by the nationwide permit and any
other information that the applicant b?.lieves is appropriate.
e. Applicant is required to obtain a`Section.401 Water Quality
Certification from the State of North Carolina for NWP 26 to be valid.
Applicant should furnish a copy of the certification with the pre-
discharge notification to the Corps of Engineers. To obtain a Section 401

PROJECT DESCRIPTION: The applicant proposes to fill 1.95 acres
of wetlands on a 7.83 acre tract of land for the purpose of
preparing the site for the construction of a 20 lot residential
subdivision. A site visit was conducted on June 7, 1991 with
Steve Morrison of Land Management Group, Inc.. Please find the
attached Wetland Rating.System Worksheet. The entire site has
'.recently been cleared and burned. Several areas near the center
of the wetland area have subsided approximately 1-2 feet,
apparently due to'existing drainage ditches on the east and north
sides of the site. The soil in the wetland area consisted of
black muck approximately 4 inches thick near the surface
underlaid by at least 4 feet of peat which apparently starting
to decompose causing the area to subside. Presently the area is
vegetated with a few Longleaf pines and an under story of
Greenbriar and Sumac.

The project has been reviewed to determine impacts to water
quality. 'the following comments have been provided.
Although. the project is within a sensitive watershed
(eventually drains to Whiskey Creek, Class SA) runoff from the
site would have to travel approximately 1/2 mile through a man
made ditch before reaching Whiskey Creek. Using the rating
system, if the site was given 5 for sensitive watershed, the
total score would then only be 9 (13%). Due to the low
restoration potential (ditches and sewer line) and low ecological
values, it is recommended a 401 Certification be issued for this
project. If the project complies with current Stormwater
Regulhtions impacts to water quality should be minimal.

cause the turbidity outside the immediate construction area

June 12, 1991. It is my understanding that additional
y information is still needed for this Office to complete the
review of this stormwater plan.

Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road'(SR) numbers, landmarks, and
the like.

9 Certification and Permission
to Enter on Land
Any permit issued in response to this application will
allow only the development described in the application.
The project will be subject-to conditions and restrictions
contained in the permit.
I certify that to the best of my knowledge, the proposed
activity complies with the State of North Carolina's ap-
proved Coastal Management Program and will be con-
ducted in a manner consistent with such program.
I further certify that I am authorized to grant, and do in
fact, grant permission to representatives of state and
federal review agencies to enter on the aforementioned
lands in connection with evaluating information related
to this permit application and follow-up monitoring of
project.
