Two ditches have also been excavated with the spoil material being placed on the property. ADJACENT WATER BODY: Welch Creek CLASSIFICATION: CSw The project has been reviewed to determine impacts to water quality. The following comments have been provided. 1. The project will require a 401 Water Quality Certification. 2. The project complies with the General 401 Water Quality Certification No. 2176 for Headwater Wetlands. 3. It is recommended the certification be issued only for the area that the house, septic tank and drive are constructed on, i.e., less than one acre. Per conversations with the Corps of Engineers the ditch on the south side of the lot is to be filled in. In addition to the land clearing activities, two ditches have also been excavated with the sidecast fill material being placed either in spoil piles or being spread on the property. The total area of wetlands impacted is approximately 4 acres. This activity in a wetland area` without authorization by a Department of the Army permit is a violation of Section 301 of the Clean Water Act. You are directed to cease and desist from any further work in the wetland area and to submit a detailed written explanation of your activities to this office within 10 days of your receipt of this letter. We will then determine further appropriate administrative or legal action. Failure to comply with this directive may result in referral to the United States Attorney with a recommendation for civil prosecution. Your proposed placement of this fill material may qualify for Federal authorization pursuant to nationwide permit (33 CFR 330.5(a) (26)). Please complete the enclosed pre-discharge notification (PDN) form and submit it with a copy of your Section 401 Water Quality Certification from the North Carolina Division of Environmental Management.
