Dear Mr. Sams and Ms. Sanchez -King,
I am writing to you on behalf of Mr. Elijah Morton in response to the NOVs that
have been issued for Peyton Lake and Peyton's Ridge, Section VI. In my previous
discussions with Ms. Holley Snider (DEMLR), she has mentioned that a recommendation
of enforcement will be issued with the fine possibly being in excess of $20,000 per week
until both sites are brought out into compliance. I have informed Mr. Morton of this
recommendation of enforcement, and he has expressed his concern. Mr. Morton feels he
has drastically attempted to remove the sedimentation from the impacted areas and to
bring the site back into compliance, but has been unsuccessful due to the excessive
inclement weather the site has faced. I have attached a spread sheet showing a weekly
breakdown of hours worked on site attempting to bring the site back into compliance
along with weekly rainfall events and totals for your review.
The first NOV was issued on June 25, 2018 and delivered to Ms. Jennifer Ward
on June 29, 2018. Mr. Morton's staff immediately began trying to resolve the issues that
resulted in the NOV. For three weeks, Mr. Morton's staff had favorable working weather
and were able to make progress towards sediment removal. By July 18, a wall of rip rap
had been installed around the wetlands in an attempt to stop sedimentation from

occurring. Sediment removal had already begun by this date. Over the next 25 days, the
area received 20.4" of rainfall, with only six days of not recording a rainfall. Several of
these rainfall events were in excess of 2.0".
After that extended period of inclement weather, Mr. Morton's staff was able to
assess the damage caused by the multiple significant rain events and began resolving the
erosion control and sedimentation issues again. Much of the progress that was previously
made was reversed causing Mr. Morton's staff to start from the beginning. During the
second period of suitable weather (29 days), Mr. Morton's staff was able to make even
more progress removing sediment from the wetlands and attempting to permanently
prevent further sedimentation. By the end of August, the entire rear and side of Lot 225
had been regraded, bringing the slopes back to a 3:1 slope. The bare areas around this lot
were heavily seeded and strawed. A new sediment trap was installed to help prevent
further sedimentation and silt fence was reinstalled around this lot.
Between the dates of September 12-15, the area felt the full impacts of Hurricane
Florence with over 30" of rain occurring near this site (33.9" fell in Swansboro, NC
according to the National Weather Service). The site was inaccessible for nearly two
weeks after the hurricane left the area. At that point, it was realized that all previous
attempts to prevent further sedimentation had once again failed, causing Mr. Morton's
staff to once again start back at the beginning. The damage and effects caused by the
hurricane were felt for over a month after the hurricane passed. Mr. Morton's staff was
able to slowly begin working on sediment removal and erosion control items during the
month of October.
Since the site inspection by Ms. Snider and Mr. Robb Mairs on October 23, the
site has received a rainfall event approximately every 3-4 days with the exception of three
weeks (the weeks ending on November 2, November 30, and December 7). Wet
conditions have made sediment removal impracticable for many weeks. As you can see
on the spread sheet, the three weeks of suitable working weather (see above) have totaled
534 man hours of sediment removal and attempts of bringing the site back into
compliance.
On December 17, Mr. Morton's staff had created many large piles (in Impact
Areas #3 and #4) from the sedimentation that has occurred in the wetlands. I have
recently'spoken with Ms. Ward, and she is hiring a vacuum truck to remove all of these
piles from the impacted areas. Ms. Ward says the truck will begin removing these piles
starting at the beginning of the year. She anticipates it will take approximately 10 days to
remove the piles and will cost in excess of $25,000 for the truck. Once the piles have
been removed and the impacted areas become more manageable, Mr. Morton's staff will
continue removing sediment by hand.

Mr. Morton understands the importance of maintaining proper sedimentation and
erosion control measures, including how important it is to remove all sediment from the
impacted areas and to bring the site back into compliance. However, Mr. Morton feels he
has been fighting a losing battle after being set back two different times due to an
extended period of excessive rain and to an unprecedented amount of rainfall left from
Hurricane Florence. He also feels he has been challenged with the inaccessibility to the
area. Due to the elevation changes in the area, his staff has not been able to use
machinery on mats to haul sediment out of the wetlands. Mr. Morton would like for you
to please keep these considerations in mind while considering a recommendation for
enforcement.
