Dunn Denial and Project Reduction. In February, Mr. Dunn's request for a 27-slip marina was denied. An existing subdivision in the early stages of development and the new docking facility are located on Moore Creek, near Florence, in Pamlico County. Reasons for denial ranged from projected impacts to a primary nursery area to inconsistency with the land use plan. Mr. Dunn did not appeal the denial. The reduced project described in the attached is for ten slips which, as you will recall, is not defined as a marina in Rules of the CRC. The proposed project does not require a 401 Water Quality Certification. b. The proposedmarina is expected to result in a closure of presently open shellfish water (classified SC by DEM). If there is an existing use of shellfishing in these waters to be closed, then the allowance of the marina would result in the loss of an existing use. The loss of use would constitute a violation of the Antidegradation Policy of our Water Quality Standards. C. PROJECT SUMMARY: Applicant proposes to construct a 27 slip community marina on Moore Creek, near Florence, in Pamlico County, in an existing subdivision FIELD INVESTIGATION REPORT - RAYMOND E. DUNN - BAY SHORES ESTATES PAGE #2 *. 9. NARRATIVE DESCRIPTION: The applicant's property is a 134 ac. tract located on SR 1324, on Moore's Creek (off Bay River), near Florence, in Pamlico County. The applicant has subdivided a portion of the tract into 24 single-family, waterfront lots. The applicant has named the subdivision "Bay Shores Estates". A few houses have been constructed in the subdivision, and a boat ramp exists on Lot #23 (from CAMA G.P. #C-1595, issued April 3, 1986). A gravel road approximately 60' x 3400' exists on the property. A border of marsh consisting primarily of Juncus roemerianus and Spartina cynosuroides extends along portions of the shoreline of Moore Creek ranging from approxifnately 2' to 300' in width. The waters of Moore Creek are open to shellfishing by the Division of Health Services, classified as 'SC' by the Division of Environmental Management, and are designated as a Primary Nursery Area by the'Division of Marine Fisheries. Water depths around the proposed project area are -1' to -4' NWL. The applicant's proposed project is a 26 slip community residential marina. The proposed dock will extend approximately 46' into Moore Creek with a 6' x 46' access walkway and then will become an 'L' approximately 6' x 2661. Slips will range from about 25' to 30' in length. Approximately 13 finger piers and 39 mooring pilings will be constructed for the slips. The 'L' is in front of Lots #20, #21 and #22 which the owner has retained. No other piers currently exist along the same shoreline. 10. ANTICIPATED IMPACTS: As proposed, the marina will occupy approximately 8,990 sq. ft. of Public Trust Waters in a Primary Nursery Area which is open to shellfishing.
