The project has been reviewed to determine impacts to water
quality. The following comments have been provided.
1. The project will require a 401 Water Quality Certification.
2. The project complies with the General 401 Water Quality
Certification No. 1271 for Inlet Maintenance.
3. The proposed project should be done in such a way as to not
cause the turbidity outside the immediate construction are
to exceed 25 NTU.
This office has no objection to the project as proposed.

IMPROVEMENT OF NAVIGATION - NEW RIVER INLET
ONSLOW COUNTY, NORTH CAROLINA
TO WHOM IT MAY CONCERN:
The Wilmington District, Corps of Engineers, Wilmington, North Carolina,
proposes to construct, operate, and maintain improvements to New River
Inlet, Onslow County, North Carolina.
PROJECT DESCRIPTION. The proposed project will modify the existing
Federal navigation project which is 6 feet deep plus 2 feet overdepth by
90 feet wide from the Atlantic Intracoastal Waterway (AIWW) to the Atlantic
Ocean. The proposed plan is an 8-foot-deep, with 2 feet overdepth plus
2 feet advance maintenance, by 150-foot-wide entrance channel across the
ocean bar at New River Inlet (shown on the attached drawing). Dredged
material will be discharged in open water on either side of the ocean bar
channel or along the 10- to 14-foot contours of the ocean within the limits
of 2 miles either upcoast or downeoast from the inlet. About 107,400 cubic
yards of material will be discharged with the initial deepening of the
channel. The material to be discharged is predominantly sand with some
shell. There is no known related dredging by others. The proposed
discharge is presently scheduled to begin in FY 90. Maintenance dredging
will occur on an average of four to five times per year, for a total of 15
weeks, and will involve approximately 180,000 cubic yards of material per
year. Dredging will be performed by a hopper dredge like the government-
owned hopper dredge CURRITUCH or a sidecast dredge like the government-owned
sidecast dredge MERRITT.
A drawing showing the area to be dredged and proposed disposal areas is
attached to this notice.
There is attached a list of Federal, State, and local agencies with whom
this activity is being coordinated.
No impacts to known archaeological/historical resources or endangered
species will occur.
The proposed action is covered in the Detailed Project Report and
Environmental Assessment on Improvement of Navigation, New River Inlet,
Onslow County, North Carolina, dated October 28, 1988.

The proposed discharge resulting from the proposed dredging has been
reviewed under Section 404(b) of the Clean Water Act of 1977 (P.L. 95-217).
The proposed dredging activity is covered by the N.C. Division of
Environmental Management General Water Quality Certification No. 1271,
issued on November 3, 1978.
The proposed action is consistent with the approved Coastal Management
Program of the State of North Carolina. State consistency concurrence was
received December 30, 1988.
The decision whether to perform this work will be based on an evaluation
of the probable impact, including cumulative impacts, of the proposed
activity on the public interest. That decision will reflect the national
concern for both protection and utilization of important resources. The
benefit which reasonably may be expected to accrue from the proposal must be
balanced against its reasonably foreseeable detriments. All factors which
may be relevant to the proposal will be considered, including the cumulative
effect thereof; among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, historic properties, fish and wildlife
values, flood hazards, flood plain values, land use, navigation, shoreline
erosion and accretion, recreation, water supply and conservation, water
quality, energy needs, safety, food and fiber production, mineral needs,
considerations of property ownership and, in general, the needs and welfare
of the people.
Any person who has an interest which may be affected by the disposal of
this dredged material may request a public hearing. The request must be
submitted in writing to the District Engineer within 15 days of the date of
this notice and must clearly set forth the interest which may be affected
and the manner in which the interest may be affected by this activity. In
order for such request to be given appropriate consideration, it should be
mailed or delivered to the U. S. Army Engineer District, Wilmington, Post
Office Box 1890, Wilmington, North Carolina 28402-1890, in time to be
received on or before March 3, 1989.

Dear Mr. Rhodes:
I am amending my consistency determination for the Atlantic Intracoastal
Waterway (AIWW) -dated February •25, -1980, - to add-an existing-upland diked
disposal site at-New River-Inlet Crossing, Onslow County, North Carolina
(figure 1): Concurrence with my consistency determination of February 25,
1980, was received on May 6, 1980.
.Maintenance dredging of the.-AIWW and the disposal site at the New River
Inlet Crossing (vicinity of Tangents I and J-, Section II) are discussed in
the Final Environmental Imbact Statement Maintenance of the Atlantic
Intracoastal-Waterwav,•North Carolina (FEIS , filed with the Council on
Environmental Quality on November 5, 1975.
The proposed 20-acre upland diked disposal site was created-during
initial-dredging-of the AIWW and was last used•in 1978. The site is located
at the.intersection•of Tangents I-and J,--Section II,-of the AIWW, as shown
on figure•2. The -disposal - site is predominantly (.about 80-percent) bare
sand, approximately 10 percent-shrub thicket and other low-lying shrubs,
and-10--percent grasses.- The-site is-bordered by salt marsh (consisting
predominantly -of Snartina alterni-flora).
..The site has a history=of providing suitable habitat for-nesting
colonial waterbirds. Surveys were performed in 1976, 1983, and 1988. -In-
1976, only-2 Least terns and 1.-Commen tern nested; in 1983, 15 Green-backed
heron, 2Common tern,and 96-Least tern-nests-were found; and in 1988, only
5-Least terns and 4-Green-backed heron nests-were-found. (Information was
obtained-from'Waterways Experiment-Station Technical Report D-86-3, Co' a

andv1983 Surveys-and Personal Communication with Dr. James Parnell, ONC-
_ Wilmington, concerning the. .1988 data (unpublished).). Due to the sporadic
use of-this-disposal-area by nesting colonial waterbirds, it-will-be
inspected for nests prior to construction of-dikes or deposition-of-dredged
material. -If-evidence of-nesting is found, work will be scheduled to avoid
adverse impacts to the maximum extent practicable.

During FY 89, approximately 50,000 cubic yards of fine to coarse sand is
scheduled to be removed from the AIWW and disposed of within the proposed
upland diked disposal-site, as described in Public Notice SAWCO-ND-89-0001.
Maintenance dredging of the AIWW is scheduled to begin mid- to late January
1989 and will require approximately 7 months to complete.
During the past 10 years, dredged material from the vicinity of Tangents
I and J has been disposed of within the upland diked disposal site located
just west of the intersection of the Channel to New River Inlet and the
AIWW.- This disposal site has-reached capacity. Until material is removed
from this site and placed on the beach, which is not scheduled at this time,
material will be placed within the disposal site described above and shown
on figure 2.
No other changes to my February 25, 1980, consistency determination are
required. I request your concurrence/nonconcurrence that the addition of
the proposed site is consistent with the approved Coastal Management Program
of the State of North Carolina. I also request your approval to proceed
upon receipt of your concurrence, rather than waiting the 90 days specified
in 15 CFR 930.41(c).
