This office has no objection to the issuance of the permit(s) for the proposed
project with the following conditions:
That the activity be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-
related discharge (increases of 25 NTU's or less are not considered
significant).
That the instream turbidity not be increased by more than 50 NTU's as a
result of the proposed activity after a reasonable opportunity for dilu-
tion and mixture.

SITE DESCRIPTION
The applicant.., currently owns lot 15 Goose Nest Lane,
Perquimans County.. The lot is characterized by 'a 10' high clay
bluff with mature forest composed of Southern Red oak ( uercus
falcata), sweetgum (Liquidambar styraciflua), tulip poplar
(Liriodendron tulipfera), red maple (Acer rubrum), swamp chestnut
oak ( uercus michauxii) and loblolly pine (Pinus taeda). No
wetlands are located on this lot. Lot 14 is currently bulkheaded
24' waterward of NWL.
Mr. Smoyer proposes to tie his bulkhead into the bulkhead of
lot 14, 24' waterward of NWL, and then angle back an average of
7' waterward of NWL. A 12' X 40' boat ramp, 50' X 6' pier with a
20' X 6' "T", and 2-25' groins are also proposed. Applicant also
proposes to excavate by backhoe a 350' X 10' X -3' channel and
deposit the spoil landward of the bulkhead. Water depths are
currently 21-2 1/2' deep 30' offshore.
ANTICIPATED IMPACTS
This project will result in the filling of 1815 sq. it. of
shallow water habitat and the excavation of 3500 sq. ft. of
shallow water habitat. Some localized short-term turbidity will
result from the construction of the bulkhead. Excavation of the
channel will result in increased turbidity.
CAMA REVIEW
This project is consistent with the community classification
of the Perquimans County LUP.

8 Additional Information
In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 710203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the ad-
jacent waterfront (riparian) landowners. These in-
dividuals have 30 days in which to submit comments on
the proposed project to the Division of Coastal Manage-
ment and should be advised by the applicant of that op-
portunity.

Natural Resources and Community Development to
cover the costs of processing the application.
A signed AEC hazard notice for projects in oceanfront

ment documenting compliance with the North Carolina
Environmental Policy Act (N.C.G.S. 113A-1 to 10).

9 Certification and Permission
to Enter on Land '
Any permit issued in response to this application will
allow only the development described in the application.
The project will be subject to conditions and restrictions
contained in the permit.
I certify that to the best of my knowledge, the proposed
activity complies with the State of North Carolina's ap-
proved Coastal Management Program and will be con-
ducted in a manner consistent with such program.
I further certify that I am authorized to grant, and do in
fact, grant permission to representatives of state and
federal review agencies to enter on the aforementioned
lands in connection with evaluating information related
to this permit application and follow-up monitoring of
project.

1. Goose (Vest Lane is off Road #1336 just before Road #1351 on
Harveys Neck, Perguimans County, NC., Lot 15 is back: 2,365 feet
from the 90 degree band in the road.
2. The bulkhead will be constructed of 6"x6"xlO' timbers with 6"x4"
cross timbers and two layers of 1"xlO"xlO' planking. Typar
filter cloth will be used to keep the sail from washing through
the bulkhead. The timbers will be 5'4" apart and be backed with
a deadman attached with galvanized steel wire. The bulkhead
will be sunk: 5' below the natural shore line.
The bulkhead will be back:fi.lled with clay removed from the
channel that is to be dug. The ground line will be tapered
from 30' back from the top of the bulkhead.
4. The proposed bulkhead would go west from the corner of the
existing bulkhead on Lot 14, 65' to a point 3' waterward of the
shoreline. It then would change angle slightly and head
westward 85' to a point 3' waterward of the property line of Lot
16. It would then anchor into the shoreline.
5. A 12' wide boatramp would be built with seawood bulk: heading and
concrete about: 25' from the property line of Lot 14.
h. Two 25' groins are to be guilt 12' apart to follow the boat ramp
out. They will be one foot higher than the mean high water
line.
7. A 50' long 4` wide boat pier would attach to the groin and end
with a "T" shaped dock: 20'x6'.
8. A 10' wide channel starting from the boat ramp, following the
pier- and around the "T" dock:, out to about 350' will be dug to
obtain 3' of water for boating access. The clay that is removed
will be used to backfill behind the bulkhead. Any extra will be
used to fill in low spots on Lot 15.
