Mills SUBJECT: Application Garland Sl.a, Dare County C)rivla; S fined ` Pfl for CAMA Permit jle The Subject application has been reviewed for water quality impacts and. the following comments are offered: a) The proposed project does require a 401 Water Quality Certification but does meet the requirements of General Certification No. 1273 for discharge of liquid effluent from an upland diked disposal area. b) The proposed excavation will result in a direct loss of 11,250 sq. ft. of shallow water habitat. We are especially concerned that this excavation will indirectly result in impacts to the marsh fringe which is between the proposed basin and the bulkhead. This marsh fringe may possibly slough off into the proposed basin. We recommend that the CAMA permit not be issued unless adequate assurance can be provided that the marsh fringe would not be directly or indirectly affected by the creation of the basin. BM/kls P.O. (.6 acres) 8 PROJECT SUMMARY: Applicant proposes to enlarge an existing 170' X 75' X -5' basin by excavating an additional 150' X 75' X -5' area below MHW at the juncture of a man-made canal and Pamlico Sound adjacent his property, parcel 17, Brooks Court, Brigands Bay, Frisco, Dare County. GARLAND L. SLAGLE BIO REPORT PAGE 2 BIO REPORT The applicant owns lots 17, 18 and 19 off Brooks Court in Brigands Bay Subdivision, Frisco, Dare County adjacent Pamlico Sound. The lots are vegetated with lawn grasses, pampas grass and live oaks. The shoreline has been bulkheaded along all three lots. A two to five foot wide coastal wetland fringe exists waterward of the bulkhead in front of lot 17. Spartina alterniflora, Spartina patens and Distichlis spicata make up this fringe area; it is kept cut at a very short height by frequent mowing. Under LAMA permit #130-82, the applicant excavated a boat basin to -8' deep in front of lots 18 and 19. This excavated area extended out 75' from the bulkhead. Current water depths in front of lot 17 range from approximately -1' near shore to -4.5' deep at a distance of 75' from the waterward edge of the marsh fringe. The property is situated at the mouth of Brooks Creek and/or a man-made canal and the Pamlico Sound. The applicant proposes to extend his existing boat basin across in front of lot 17. The basin extension area would be -5' deep and 75' wide by approximately 150' long. Excavation would begin waterward of the marsh fringe and slope down to the proposed -5' deep bottom area. The excavation is proposed to be accomplished by dragline and hydraulic dredge. The spoil material is to be deposited landward of the bulkhead on lot 17. Water depths adjacent the area to be excavated are currently -5' deep; however water depths decrease toward Pamlico Sound to a minimum of approximately -3.5' to -4.0' deep. ANTICIPATED IMPACTS The excavation of the proposed boat basin will cause the loss of 11,250 square feet of shallow water habitat. The excavation adjacent the marsh fringe may cause the fringe to slough off into the basin. Type of fill material 8 Additional Information In addition to the completed application form, the follow- ing items must be submitted: A copy of the deed (with state application only) or other instrument under which the applicant claims title to the affected property. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to cant' out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 16 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management. Slagle of Dare County, North Carolina, filed an application on June 2, 1989, for a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for certification from the Division of Environmental Management that a discharge of fill material in project wetlands will not violate applicable water quality standards. According to said application the applicant proposes to enlarge an existing 170' X 75' X -5' basin by excavating an additional 150' X 75' X -5' area below MHW at the juncture of a man-made canal and Pamlico Sound adjacent his property, parcel 17, Brooks Court, Brigands Bay, Frisco, Dare County. A copy of the entire application and additional information may be examined (or copies furnished upon request and payment of reproduction costs) during normal business hours at the office of David R. Griffin, Division of Coastal Management, located at Route 6, Box 203,Elizabeth City, N.C., (919) 264-3901, and/or the office of Deborah Sawyer, Division of Environmental Management, NRCD Regional Field Office, Washington, N.C., 27889. The Division of Environmental Management proposes to take final action on this water quality certification on or before August 10, 1989. The issuance of the CAMA Major Development permit and the Section 401 Certification may deviate from this projected date depending upon the nature of the comments submitted and subsequent hearings that may result. All persons desiring to make comments should do so in writing to Mr. George T. Everett, Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to August 5, 1989 for consideration in the CAMA permit decision, and to Mr. Bill Mills, Division of Environmental Management, P.O.
