CERTIFICATION
THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to the Town of Navassa pursuant to an application filed on the
2nd day of June, 1989 to construct a public boating access area
on Davis Creek.
The Application provides adequate assurance that the
discharge of fill material into the waters of Davis Creek in
conjunction with the proposed public access area in Brunswick
County will not result in a violation of applicable. Water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted,
in accordance with the application and conditions hereinafter set
forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less are not
considered significant).
2. That all wet concrete poured below mean high water
shall be poured at low tide and that the forms
shall be completely dewatered prior to pouring the
concrete. At no time shall wet concrete be allowed
to directly contact surface waters.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.

PROJECT DESCRIPTION: The applicants propose to construct a
public access area, to include a boat ramp with 700 sq. ft. below
MHW, a 1.48 acre parking area, two pier, boardwalk, and dock.
ADJACENT WATER BODY: Davis Creek
CLASSIFICATION: SC-Swamp / Primary Nursery Area
The project has been reviewed to determine impacts to water
quality. The following comments have been provided.
The project will require a 401 Water Quality Certification
and should include the following conditions for the construction
of the boat ramp.
a. That all wet concrete poured below MHW be poured at low
tide and that the forms be completely dewatered. No wet
concrete shall be placed in the surface waters.
b. That construction be done in such a manner that
turbidity increases not exceed 25 NTU outside the
project area.
A stormwater management plan for this project was approved
on 5/29/89.
This office has no objection to the project as proposed.

8. Project Summary The applicants propose to construct a public access boat ramp
with parking facilities. They will also construct two pier systems to provide
ample water access for fishing etc. Parking facilities will also be provided.

9. Proiect Description
The project is located on Davis Creek just downstream of the railroad crossing
leading to High Rise Company, Inc. Davis Creek is a meandering body water that
is bounded on the north by wetlands and on the south by wooded swamp type
vegetation. The width of the creek within the project area varies from
approximately 40' to 48'. There are scattered wetland species located on the
southern bank. The species are fresh water in nature and were not identified.
The waters are classified as SC-Swamp and are designated as a primary nursery
area by the Division of Marine Fisheries. The highground adjacent to the creek
above the flood plain is vegetated by oak-hickory climax hardwoods. The flood
plain is vegetated with cypress and gum. The Corps of Engineers have
identified all significant "404" wetlands on the site.
The applicants propose to improve the highground portion of the tract by
maintaining and upgrading the existing access road and by creating a multi-use
parking area for approximately 65 vehicles. Of this number 22 will be pull
through for vehicles with boat trailers. The other 43 will be for simple
parking. A boat ramp will be installed at the northwest corner of the parking
lot. The ramp will be approximately 14' wide x 90' long. Approximately 50'
will extend beyond the high water contour. However only approximately 10' will
extend into the low water channel. This channel is the only navigable portion
of the creek at this point. Trees and shallow mud banks prohibit the use of
the stream landward of the low water contour. The width of the stream at low
water in the boat ramp vicinity is approximately 43'. A 50' x 5' pier will.
serve the ramp. In addition to the boat ramp two pier/boardwalk/dock complexes
will be constructed. Each of these will also have a gazebo. One pier/dock
system will have 2-50' piers extending waterward to end in 2-50' "T" heads.
One of these will have a 10' x 10' gazebo at the downstream end. The two
structures will be connected by approximately 105' of boardwalk along the toe
of the bank. The other pier/dock will have 2-50' arms connected at an angle
and one will terminate in a 10' x 10' gazebo. The pier/docks will be 6' wide.
10. Anticipated Impacts
The "404" wetlands on the tract have been identified by the Corps of Engineers.
These areas will be avoided by the development. The pier system will provide
simple access for bird-watching, fishing, etc. The boat ramp will provide
water access for vessels.
As we understand the project will be constructed in phases. The entire
development concept is presented for review. Provided that the project is
completed as proposed, no significant impacts are anticipated.

Enclosed is the application of Town of Navassa for Department of the Army
authorization and a State Water Quality Certification to construct public
boatramp facilities, with piers and gazebos, on Davis Creek, Navassa,
Brunswick County, North Carolina. Your receipt of this letter verifies your
acceptance of a valid request for certification in accordance with Section
325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is a reasonable time for State action.
Therefore, if you have not acted on the request by August 26, 1989, the
District Engineer will deem that waiver has occurred.

The Natural Heritage Program is the State's central repository of information
about the locations of rare and endangered species, exemplary and unique
natural areas, and other important natural. ecosystems. The inventory of
those resources is incomplete, and no comprehensive resource survey has been
done in the area of the proposed project.
We have no records indicating the presence of rare species or other special
natural features in the project vicinity. However, this lack of information
should not be interpreted since there is potential for the presence of
significant ecological resources associated with Sturgeon Creek and Davis
Creek. The park plans should attempt to avoid impacts on potentially
important natural habitats--such as relatively undisturbed wetlands and
mature forest habitat.

In addition to the completed application form, the
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 V2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).

APPLICATION FOR CAMA MAJOR DEVELOPMENT 0, P,an,_ar,q 3ranch
PERMIT AND WATER QUALITY CERTIFICATION ;-
The Department of Natural Resources and Community Development hereby
gives public notice as required by NCGS 113A-119(b) and 143-215 3(a) (1) (c) that
the Town of Navassa of Brunswick County filed an application on May 19, 1989
for a permit from the Division of Coastal Management to develop in an Area of
Environmental Concern and for certification from the Division of Environmental
Management that a discharge of fill material in project wetlands will not violate
applicable water quality standards.
According to said application applicants propose to construct a public access
boat ramp with parking facilities. They will also construct two pier systems to
provide ample water access for fishing, etc. Parking facilities will also be
provided.
A copy of the entire application and additional information may be examined
(or copies furnished upon request and payment of reproduction costs) during
normal business hours of the Division of Coastal Management and/or the Division
of Environmental Management, Regional Office 7225 Wrightsville Avenue,
Wilmington., North Carolina 28403.
The Division of Environmental Management proposes to take final action on
this water quality certification on or before June 15, 1989. The issuance of the
CAMA Major Development Permit and the Section 401 Certification may deviate from
this projected date depending upon the nature of the comments submitted find
subsequent hearings that may arise.
All persons desiring to make comments should do so in writing to Mr. George
Everett, Director, Division of Coastal Management, P. O. Box 27687, Raleigh,
North Carolina 27611 prior to June 30, 1989 for consideration in the CAMA permit
decision, and to Mr. Bill Mills, Division of Environmental Management, P. O. Box
27687, Raleigh, North Carolina 27611 prior to June 30, 1989 for consideration in
the water quality certification decision. Later comments on the CAMA application
will be accepted and considered up to the time of permit decision. Project
modifications may occur based on review and comment by the public and state and
federal agencies. Notice of the permit decision in this matter will be provided
upon written request.
