The Subject application has been reviewed for water
quality impacts and the following comments are offered:
a. The proposed project does require a 401 Water
Quality Certification but does meet the
requirements of General Certification No. 1273 for
discharge of liquid effluent from an upland diked
disposal area.
b. The applicant has provided information concerning
the adequacy of the proposed spoil containment.
C. Because of the type of material being dredged
(fine soil particles) and the sensitivity of the
area of dredging (primary nursery area), a plan
for monitoring water quality had been requested
from the applicant. The applicant has agreed to
the monitoring scheme as described in the attached
memo from Deborah Swayer dated April 3, 1989. It
is recommended that this monitoring be included as
conditions of the CAMA permit.

A site investigation of the above subject project was performed on
March 28, 1989. The applicant supplied the Division with the
information concerning the spoils disposal area as requested on
February 28, 1989. The information supplied showed the area to be
adequate for the containment of spoils.
An approved monitoring scheme was also requested on February 28, 1989
by the Division. The applicant agreed on March 28, 1989 to the
following monitoring scheme for analyses:
1. Within the area to be dredged (midway) and within the area
of the proposed discharge from the spoils prior to the
dredging and discharge, measurements in the water column for
metals; cadmium, chrome, copper, nickel, lead, zinc, and
mercury; and total nitrogen and phosphorus should be
measured to supply the Division with background information.
2. Within the area to be dredged (midway) and within the area
of the proposed discharge from the spoils during the
dredging and after the discharge from the spoils commences,
measurements in the water column for metals; cadmium,
chrome, copper, nickel, lead, zinc and mercury; and total
nitrogen and phosphorus should be measured to supply the
Division with information concerning contaminants entering
the water column from the dredging project.
3. During the dredging, turbidity and total settleable solids
analyses should be performed 2 times per week.
This is a maintenance dredging project which should be monitored due
to the type of sediment (fine soil particles) and the sensitive area
of the dredging (primary nursery area) project. The results from the
first analyses taken should be submitted to the Division prior to the
dredging for review. The remaining analyses should be submitted
within a timely manner.

9. NARRATIVE DESCRIPTION: The proposed project is maintenance
dredging of an existing channel which was permitted under
N.C. Permit 4340-1974 and Federal Permit 474-69. The
project is located in oriental, the eastern branch of
Whittaker Creek, in Pamlico'County. Since the original
project was conducted, the shoreline of east Whittaker Creek
has become densely developed with houses and the marina.
The original channel ranged from 50' to 200' and this
proposed maintenance is for a 50' width along 2,200' with
the original -6' NWL depth. This proposed maintenance will
be conducted by hydraulic dredge and will excavate 8,500 cu.
yds. of sand-and muck. This material is to be placed into a
diked disposal area. The proposed highground spoil area
currently is vegetated with mixed hardwoods and pines. The
applicant is proposing a 550' x 400' (5 acres) spoil area
but has a spoil easement for up to 7 acres.
10. ANTICIPATED IMPACTS: The proposed project will remove 8,500
cu. yds. of sand and muck from 110,000 sq. ft. (2' acres) of
shallow estuarine bottom. This spoil material is to be
placed in a 5 ac. highground spoil disposal area.
The waters of Whittaker Creek are classified as 'SA' by the
Division of Environmental Management, closed to shellfishing
by the Division of Health Services, and designated as a
Primary Nursery Area by the Division of Marine Fisheries.

In addition to the completed application form, the
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 V2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d). //

9 CERTIFICATION AND PERMIS-
