CERTIFICATION
THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to Mr, Richard Jackson pursuant to an application filed on the
28th day of August, 1989 to construct a jetty from rubble from
the Route 32 Bridge.
The Application provides adequate assurance that the
discharge of fill material into the waters of Albemarle Sound
in conjunction with the proposed jetty in Chowan County will not
result in a violation of applicable Water Quality Standards and
discharge guidelines. Therefore, the State of North Carolina
certifies that this activity will not violate Sections 301, 302,
303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set
forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less are not
considered significant).
2. That the rubble material be concrete material of
such size as to not be carried away by wave or
tidal action. That the rubble material not contain
any toxic or oily substances.
3. That the rubble which contains surfaces from thEk
top of the bridge decking not be used in the jetty
construction. Such material may contain toxic or
oily substances from the residues left on the old
bridge decking.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.

Development hereby gives publicC notice as required by NCGS
113A-119(b) and 143-215 3(a)(1)(c) that RICHARD JACKSON of Chowan
County filed an application on August 1, 1989 for a permit from
the Division of Coastal Management to develop in an Area of
Environmental Concern and for certification from the Division of
Environmental Management that a discharge of fill material in
project wetlands will not violate applicable water quality
standards.
According to said application RICHARD JACKSON proposes to
construct a 50 ft. wide 100 ft. long jetty from waste material
from the demolition of the Route 32 bridge in Chowan County on
the Albemarle Sound.
A copy of the entire application and additional information
may be examined (or copies furnished upon request and payment of
reproduction costs) during normal business hours at the office of
Richard L. Watts, Division of Coastal Management, located at
Route 6, Box 203, Elizabeth City, N.C., (919) 264-3901, and/or
the office of Deborah Sawyer, Division of Environmental
Management, NRCD Regional Field Office, Washington,: N.C., 27889.
The Division of Environmental Management proposes to take
final action on this water quality certification on or before
September 25, 1989. The issuance of the LAMA Major Development
permit and the Section 401 Certification may deviate from this
projected date depending upon the nature of the comments
submitted and subsequent hearings that may result.
All persons desiring to make comments should do so in
writing to Mr. George T. Everett, Director, Division of Coastal
Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
September 20, 1989 for consideration in the LAMA permit decision,
and to Mr. Bill Mills, Division of Environmental Management, P.O.
Box 27687, Raleigh, N.C., 27611, prior to September 20, 1989 for
consideration in the water quality certification decision. Later
comments on the LAMA application will be accepted and considered
up to the time of permit decision. Project modifications may
occur based on review and comment by the public and state and
federal agencies. Notice of the permit decision in this matter
will be provided upon request.

SITE REPORT
The applicant has the written permission of Mr. Fred Wood,
owner of the land formally the easement for the Chowan County
portion of the old Route 32 bridge on the Albemarle Sound. With
the opening of the new high rise bridge (RT 32), demolition of
the old bridge has begun.
The old bridge connected to a man-made berm on the Chowan
County side. At its highest point, the berm rises approximately
20 feet above MHW. The surface of the berm is paved (old RT.
32). The side slopes are steep and vegetated with Sorghum
halepense, (Johnson grass) Paspalum dilatatous (Dallis grass)
Festuca arundinacea (Tall fescue) and Ambrosia astemisiifolia
(Common ragweed). The point of the berm effected by water action
is protected by a concrete slab along the slope, rock riprap
along the toe and a deteriorated wood breakwater.
The construction of the berm and old Rt 32 bridge has been
credited with the accretion of beach on its upriver side. The
sandy beach ranges from 4 feet in width adjacent to the berm to
approximately 30 feet, 30 yards N.W. of the berm. The first line
of vegetation along this portion of the river consists of an
unidentified stolonifercus grass and a spreading small, broadleaf
plant. The treeline approximates the first line of vegetation.
Dominant trees are Pinus taeda (Loblolly pine) and Liquidamber
styraciflus (sweet gum) A few Acer rubrum (Red maple) and Ilex
opaca (Holly) were noted. A dense matting of Pueraria lobata
(kudzu), Smilax sp. (Catbriers) and Lonicera s2. (Honeysuckle)
covered the forest floor. This zone averaged approximately +2 ft
above MHW. Soils in this area have a loamy texture and are
poorly drained.
No shallow water submerged vegetation was noted from the
shoreline. Water movement 30 yards offshore indicated heavy fish
activity.
The applicant believes the properties upriver on the Chowan
County side of Route 32 will be quickly eroded with the removal
of the old bridge. He proposes to construct a 100 foot jetty
with a 50 foot wide base, following the old Rt. 32 bridge
alignment. The height of the jetty will be approximately 60
inches. All jetty material will come from the RT 32 bridge
demolition. The broken concrete will be sorted for size.
Nothing with less than an 8 inch diameter will be used.
Demolition material will be dropped onto barges, sorted and then
placed along the proposed jetty alignment.

ANTICIPATED IMPACTS
Five thousand sq. ft. of public waters will be usurped by
the proposed jetty. This project should not have a major effect
on navigation, at this point since it is adjacent and parallel to
the new Rt. 32 bridge. Small craft will have to negotiate around
the jetty.
The demolition material will vary in size and shape. Wave
impacts and river currents may dislodge smaller sized material
and litter it along the adjoining river bottom and shoreline.
Upriver of the proposed jetty the beach has been accreting
for a distance of .5 mile. Down river of the project site the
shoreline has been eroding an average between 2 to 3 feet.
CAMA REVIEW
This project is consistent with the LUP classification of
conservation. Development is in an AEC. This location site has
not been identified as an archeological site of interest.

In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the-deed (with state application only) or other,
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to, be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.

9 CERTIFICATION AND PER-MISSION

The project will be subject to conditions and restrictions
contained in the permit.
I certify that to the best of my knowledge, the proposed
activity complies with the State of North Carolina's ap-
proved Coastal Management Program and will be con-
