REGAN Secretary LINDA CULPEPPER Director Water Resources Environmental Quality December 6, 2018 CERTIFIED MAIL RETURN RECEIPT REQUESTED RECEIPT # 7017 0190 0000 9569 9784 Bob Kellington Regional Market Manager Builders Firstsource – Raleigh, LLC 23 Red Cedar Way Apex, NC 27523 Subject: Notice of Continuing Violation NOV-2018-PC-0454 Permit No. WQ0014391 Builders Firstsource – Apex Yard WWTF Chatham County Dear Mr. Kellington: Staff of the NC DEQ Division of Water Resources (DWR), Water Quality Regional Operations Section in the Raleigh Regional Office inspected the subject non-discharge facility on November 20, 2018. On the day of the inspection, records were reviewed and found to be complete and on time, there were no signs of failure at any of the components. The indexing valve that had failed has been replaced. One pump in the recirculation tank pumps to 2 EZ Treat pods and the other pumps to the other 2 EZ treat pods. The septic tank is pumped out every 3 months. Surging of the septic tank during lunch hour is reportedly still a problem. The UV bulbs still occasionally leak water periodically. There have reportedly been no problems with the drip system. The pump will shut down any zone that has low pressure (indicating a leak) and store a trouble code. The following item specifies a permit condition with requirements that were noted during our review to be in violation: III. Operation and Maintenance Condition 15 which states: “The drip irrigation field shall be mowed… regularly during the growing season.” Vegetation in the non-forested portion of field 1 has not been mowed. Please mow the vegetation and maintain it to support the proper use and maintenance of the drip field. MONITORING AND REPORTING REQUIREMENTS Condition 3, which states “Flow through the treatment facility shall be continuously monitored…Flow may be estimated from water use records provided the permittee’s water use is metered.” The Builders Firstsource WWTP receives flow from Builders First Source and ST Wooten Concrete. Flow from Builders Firstsource has been reported but flow from ST Wooten has not. Builders First Source was made aware of this violation in a DWR letter dated June 8, 2016 and in an NOD 2017 PC 0256 dated November 15, 2017. You are required to take any necessary action to correct the above violation and to provide a written response to this Notice within 30 days of receipt of this correspondence. In addition, please include in your response all corrective actions already taken and a schedule for completion of any corrective actions planned for the immediate future. Failure to comply with the State's rules, in the manner and time specified, may result in the assessment of civil penalties and/or the use of other enforcement mechanisms.
