THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to the City of Graham pursuant
to an application filed on the 3rd day of January, 1989 to construct a
dam and raw water reservoir on Back Creek.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of Back Creek
in conjunction with the proposed dam and reservoir in Alamance County
will not result in a violation of applicable Water Quality Standards and
discharge guidelines. Therefore, the State of North Carolina certifies
that this activity will not violate Sections 301, 302, 303, 306, 307 of
PL 92-500 and PL 95-217 if conducted in accordance with the application
and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 50 NTU's or less are
not considered significant).
2. That appropriate sedimentation and erosion control
measures shall be employed to minimize turbidity
and siltation impacts.
3. That minimum flow releases from the reservoir
shall be maintained as described in the
Environmental Assessment.
4. That sediments and low dissolved oxygen water from
bottoms of the existing lakes and ponds to be
eliminated by this project be controlled so as to
prevent downstream violations of Water Quality
Standards for turbidity (50 NTU's) and dissolved
oxygen (not less than a daily average of 5 mg/1).
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

I have reviewed the public notice with attached plans
dated January 5, 1989, for the construction of an earthen
fill dam and a spillway to increase the capacity of the
Graham/Mebane water supply reservoir. If appropriate
erosion control methods are used with this project in
accordance with North Carolina Division of Land Quality,
then this should minimize the environmental impact of the
project.
A concern that has been raised by many county officials
and private citizens about the expansion of this reservoir
was the impact of area businesses on drinking water quality.
The issue was first raised by Mr. King of King Auto Parts.
King Auto Parts is a junkyard located within 1000 feet of
the south perimeter of the proposed reservoir. Mr. King
takes measures to drain motor oil and antifreeze from
automobiles prior to disposing of them on his yard so that
any oil or antifreeze runoff is minimal. However, the
potential for water supply contamination is still a concern.
One solution would be to build a berm around the southern
end of the reservoir to divert runoff away from the water
supply. This berm would also act as a barrier against any
spills that may occur on Highway 70, which is a well
traveled road, thereby keeping any hazardous materials from
entering the water supply.

However, King Auto Parts has been operating at the same
location for many years without noticeably impacting the
present reservoir, and investigations of his business have
found runoff of oil from the property to be very minimal and
Mr. King to be very cooperative. It is not expected that
this business will significantly affect the water quality of
the proposed reservoir.
Therefore, if erosion control is practiced in the
construction of this project as specified by the Division of
Land Quality, our office recommends that a 401 certification
be issued.

PUBLIC NOTICE
THE CITY OF GRAHAM, Post Office Box 357, Graham, North Carolina 27253,
has applied for a Department of the Army permit TO PLACE EXCAVATED/FILL
MATERIALS IN THE WATERS/WETLANDS OF BACK CREEK TO CONSTRUCT A DAM WITH
SPILLWAY ESTABLISHING A WATER SUPPLY RESERVOIR, GRAHAM, Alamance County, North
Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show the proposal of the cities of Graham and Mebane, North
Carolina, to construct a raw water reservoir in the Back Creek basin of
Alamance County. This reservoir would incorporate the existing 140-acre
Quaker Creek Reservoir adjacent to the proposed project site into the new
Graham-Mebane Reservoir. The proposed project would inundate portions of
Back, Quaker, Mill, and Stagg Creeks. It would povide 2.3 billion gallons of
storage in a lake with 688.8 surface acres at normal pool, including Quaker
Creek Reservoir.
The proposed project includes completion of an earthen fill dam;
construction of a concrete-lined spillway for flood flow; clearing and.
grubbing of vegetation in the reservoir pool area; removal of the old Graham
Lake dam and draining of Graham Lake; relocation of a 44-kilovolt (kV)
electrical power distribution line; raising and replacing state roads and
bridges; and implementation of the mitigation measures described in the
Environmental'Assessment (EA) developed for the project. A 6-million-
gallon/day (MGD) water treatment plant adjacent to the proposed dam site, the
east abutment of the proposed dam along with a 72-inch diversion pipe and a
water intake structure with raw water pumping facilities, were constructed in
1975.
The normal water level and spillway elevation is to be 530 feet above mean
sea level (msl) with the 3/4 Probable Maximum Precipitation flood level at 534
feet msl. The 880.6 acre study area described in the EA includes all lands
affected by the dam and spillway construction, all lands within the normal
pool area of the proposed reservoir, and a 100-foot-wide buffer measured from
the normal pool level outward. The 140-acre Quaker Creek Reservoir is not
included in the study area. The proposed reservoir would inundate
approximately 548.8 acres, in addition to the 140 acres currently inundated by
the existing Quaker Creek Reservoir. The total acreage of the Graham-Mebane
Reservoir, including the existing Quaker Creek Reservoir, would be 688.8
acres.

The total raw water yeild of the proposed reservoir would be approximately
14 MGD during the drought of record, the lowest streamflow officially
recorded. A low flow requirement of 5 cubic feet per second (cfs) would be
expected to reduce the safe yield of the reservoir to the water treatment
plant to approximately 11.5 MGD during the drought of record. The proposed
reservoir would have a watershed of approximately..66 square miles. Land use
within the watershed is mostly forest and farmland. Based on existing water
quality data and the cities' experience in treating and using water from
Quaker Creek Reservoir, the proposed project is expected to be a source of
high quality water.
Because the city of Mebane planned to finance its share of the project
through financial assistance from the Farmers Home Administration (FmHA), the
environmental review required by the National Environmental Policy Act of 1969
(NEPA) became a responsibility for both the FmHA and the Corps of Engineers
(Corps). The Corps agreed to allow the FmHA to be the lead agency and
participate as a cooperating agency in the development of the Environmental
Assessment (EA) for the proposed project. Limited copies of this EA are
available.
Plans showing the work are included with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the Army permit will be issued until the coordinated State
viewpoint on the proposal has been received and reviewed by this agency, nor
will a Department of the Army permit be issued until the North Carolina
Division of Environmental Management has determined the applicability of a
Water Quality Certificate as required by PL 92-500.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a?public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The Environmental Assessment (EA) identified one archeological site that
is considered eligible for inclusion in the National Register of Historic
Places. The Farmers Home Administration (FHA) is presently working with the
North Carolina Department of Cultural Resources concerning this site. The
Corps of Engineers is otherwise unaware of the presence of other such
resources. Presently, unknown archeological, scientific, prehistorical, or
historical data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.

The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case.- The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards and flood plain value's (in accordance with Executive Order
11988), land use, navigation, shore erosion and accretion, recreation, water
supply and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, considerations of property ownership, and, in
general, the needs and welfare of the people. For activities involving the
placement of dredged or fill materials in waters of the United States, a
permit will be denied if the discharge that would be authorized by such permit
would not comply with the Environmental Protection Agencies' 404(b)(1)
guidelines. Subject to the preceding sentence and any other applicable
guidelines or criteria, a permit will be granted unless the District Engineer
determines that it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army.
permit will not be made until the North Carolina Division of Environmental
Management (DEM) Issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification maybe
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
January 30, 1989.

Water Act certification should do so in writing delivered to the North

PUBLIC NOTICE
THE CITY OF GRAHAM, Post Office Box 357, Graham, North Carolina 27253,
has applied for a Department of the Army permit TO PLACE EXCAVATED/FILL
MATERIALS IN THE WATERS/WETLANDS OF BACK CREEK TO CONSTRUCT A DAM WITH
SPILLWAY ESTABLISHING A WATER SUPPLY RESERVOIR, GRAHAM, Alamance County, North
Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show the proposal of the cities of Graham and Mebane, North
Carolina, to construct a raw water reservoir in the Back Creek basin of
Alamance County. This reservoir would incorporate the existing 140-acre
Quaker Creek Reservoir adjacent to the proposed project site into the new
Graham-Mebane Reservoir. The proposed project would inundate portions of
Back, Quaker, Mill, and Stagg Creeks. It would povide 2.3 billion gallons of
storage in a lake with 688.8 surface acres at normal pool, including Quaker
Creek Reservoir.
The proposed project includes completion of an earthen fill dam;
construction of a concrete-lined spillway for flood flow; clearing and
grubbing of vegetation in the reservoir pool area; removal of the old Graham
Lake dam and draining of Graham Lake; relocation of a 44-kilovolt (kV)
electrical power distribution line; raising and replacing state roads and
bridges; and implementation of the mitigation measures described in the
Environmental Assessment (EA) developed for the project. A 6-million-
gallon/day (MGD) water treatment plant adjacent to the proposed dam site, the
east abutment of the proposed dam along with a 72-inch diversion pipe and a
water intake structure with raw water pumping facilities, were constructed in
1975.
The normal water level and spillway elevation is to be 530 feet above mean
sea level (msl) with the 3/4 Probable Maximum Precipitation flood level at 534
feet msl. The 880.6 acre study area described in the EA includes all lands
affected by the dam and spillway construction, all lands within the normal
pool area of the proposed reservoir, and a 100-foot-wide buffer measured from
the normal pool level outward. The 140-acre Quaker Creek Reservoir is not
included in the study area. The proposed reservoir would inundate
approximately 548.8 acres, in addition to the 140 acres currently inundated by
the existing Quaker Creek Reservoir. The total acreage of the Graham-Mebane
Reservoir, including the existing Quaker Creek Reservoir, would be 688.8
acres.

The total raw water yeild of the proposed reservoir would be approximately
14 MGD during the drought of record, the lowest streamflow officially
recorded. A low flow requirement of 5 cubic feet per second (cfs) would be
expected to reduce the safe yield of the reservoir to the water treatment
plant to approximately 11.5 MGD during the drought of record. The proposed
reservoir would have a watershed of approximately 66 square miles. Land use
within the watershed is mostly forest and farmland. Based on existing water
quality data and the cities' experience in treating and using water from
Quaker Creek Reservoir, the proposed project is expected to be a source of
high quality water.
Because the city of Mebane planned to finance its share of the project
through financial assistance from the Farmers Home Administration (FmHA), the
environmental review required by the National Environmental Policy Act of 1969
(NEPA) became a responsibility for both the FmHA and the Corps of Engineers
(Corps). The Corps agreed to allow the FmHA to be the lead agency and
participate as a cooperating agency in the development of the Environmental
Assessment (EA) for the proposed project. Limited copies of this EA are
available.
Plans showing the work are included with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the Army permit will be issued until the coordinated State
viewpoint on the proposal has been received and reviewed by this agency, nor
will a Department of the Army permit be issued until the North Carolina
Division of Environmental Management has determined the applicability of a
Water Quality Certificate as required by PL 92-500.
This'application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The Environmental Assessment (EA) identified one archeological site that
is considered eligible for inclusion in the National Register of Historic
Places. The Farmers Home Administration (FHA) is presently working with the
North Carolina Department of Cultural Resources concerning this site. The
Corps of Engineers is otherwise unaware of the presence of other such
resources. Presently, unknown archeological, scientific, prehistorical, or
historical data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.

The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards and flood plain values (in accordance with Executive Order
11988), land use, navigation, shore erosion and accretion, recreation, water
supply and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, considerations of property ownership, and, in
general, the needs and welfare of the people. For activities involving the
placement of dredged or fill materials in waters of the United States, a
permit will be denied if the discharge that would be authorized by such permit
would not comply with the Environmental Protection Agencies' 404(b)(1)
guidelines. Subject to the preceding sentence and any other applicable
guidelines or criteria, a permit will be granted unless the District Engineer
determines that it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Environmental
Management (DEM) issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whetter or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
January 30, 1989.

Department of the Army authorization and a State Water Quality
Certification to place excavated/fill materials in the
waters/wetlands of Back Creek to construct a dam with spillway
establishing a water supply reservoir, Graham, Alamance County,
North Carolina. Your receipt of this letter verifies your
acceptance of a valid request for certification in accordance with
Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant
to Section 404 of the Clean Water Act, and we have determined that
a water quality certification may be required under the provisions
of Section 401 of the same law. A Department of the Army permit
will not be granted until the certification has been obtained or
waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is a reasonable time
for State action. Therefore, if you have not acted on the request
by February 29, 1989, the District Engineer will deem that waiver
has occurred.
