The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of Atlantic Intracoastal Waterway in conjunction with the proposed bulkhead in Craven County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. That the backfill material be clean material from an upland source and free of toxic pollutants. Violations of any condition herein set forth shall result in revocation of this Certification. NARRATIVE DESCRIPTION: Applicant's property is a .71 acre tract which consists of two (2) lots, #124 & 0125 in Sea Gate subdivision, on the AIWW, in Craven County. The property presently is cleared and the shoreline has been riprapped (authorized by CAMA G.P. #C-4863, 10/28/88) and bulkheaded. The applicant plans to construct a home on the property. The applicant's proposed project is to dredge a small channel and basin, install a culvert and fill, and construct a pier. The proposed basin is 50' x 25' x -4' MLW with a 50' x 15' x -4' access channel. The channel and basin will -be constructed with a dragline, and the spoils will be utilized to backfill the 50' x 25' bulkheaded basin. One side of the proposed basin is already bulkheaded. Any additional spoils will be spread on the existing yard. An additional new 45' of bulkhead and a 30' wooden groin (south side) are proposed for the basin. The applicant is also proposing to construct a 4' x 40' pier with an 8' x 35' 'L' out to -4' MLW. This pier will not extend any farther out into the AIWW than the bulkhead on the northern adjacent lot. The proposed culvert will extend 40' from an existing culvert under the road to the proposed bulkheaded basin and will be filled over. 10. ANTICIPATED IMPACTS: The project, as proposed, will excavate 350 cu. yds. below MHW of sand material from 3,350 sq. ft. of sandy bottom on the Core Creek AIWW. The dredged spoils will be placed behind the proposed 45' of new bulkhead and also spread on the highground lot. The proposed pier will occupy 440 sq. ft. of public trust waters. The waters of Core Creek are closed to shellfishing by the Division of Health Services and are classified as 'SA' by the Division of Environmental Management. PREPARED BY: W.
