Oak Island Drive Oak Island, NC 28465 Subject: REQUEST FOR ADDITIONAL INFORMATION Town of Oak Island Maintenance Dredging Dear Mr. Kudgus: On September 12, 2018, the Division of Water Resources (Division) received your application requesting a Water Quality Certification from the Division for the above -referenced project. The Division has questions about the proposed work and has determined that additional information is necessary to process your application. The application is on -hold until all of the following information is received: 1. Please provide a letter of agreement from the US Army Corps of Engineers (USACE) allowing placement of material in the USACE Disposal Area 0268. The Division understands that the applicant intends to obtain a consent agreement from the USACE Real Estate Office prior to beginning construction, however the Division can not provide authorization for work without the disposal site being identified. 2. The applicant has requested authorization for year-round channel navigation maintenance and placement activities including work during environmental moratorium widows. The Division has concerns with authorization work in conflict with resource agency moratorium windows. Please provide letters of agreement from the appropriate resources agencies allowing work to take place during these moratorium windows or revise the application to clarify that the moratoriums will be complied with. 3. The CAMA Major permit application states that the proposed project is located in a National Registered Historic District or involves a National Register listed/eligible property. Please clarify which properties/area within the project are part of Historic Register. 4. The CAMA Major permit application received by the Division was not signed. Please provide a signed page 5 to the Division. Please clarify the time frame of the proposed work as it is unclear to the Division for how many years you are seeking authorization to conduct dredging and placement events. 6. The permit does not provide a specific amount of material to be dredged, a specific placement location for each event, or a specific date of each event to be undertaken if a 401 Certification was to be issued. Therefore, the Division may approve the construction plans conceptually, but will require modification to the Certification for each future construction event as the location, dredging quantity, placement location, etc. are known. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond in writing within 30 calendar days of receipt of this letter by sending one (1) copy of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by submitting all of the above requested information through this link: htt s: /edocs.deg.nc.gov/Forms/Supplemental-Information-Form (please note that the DWR# requested on the link is referenced above). If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Water Quality Certification Rules for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
