On-Site Determination for Applicability to the Neuse Riparian Area Protection Rules (15A NCAC 2B
.0233)-EXPRESS REVIEW PROGRAM
On February 5, 2007, at the request of Jeff Harbour of Environmental Services, Inc., an on-site determination was
conducted to review twelve stream features located on the subject property for applicability to the Neuse Buffer
Rules (15A NCAC 2B .0233). The features are labeled as "A" through "M" on the attached map, initialed by Lia
Myott on February 7, 2007. The Division of Water Quality (DWQ) has determined that the following:
• Feature "A" is subject to the Neuse Buffer Rule from the flag labeled "A1" to the flag labeled "A4". The
feature is an intermittent stream between flags "A1" and "A2" and between flags "A3" and "A4". The
pond that exists between flags "A2" and "A3" this subject to the Neuse Buffer Rules.
• Feature "B" is subject to the Neuse Buffer Rule on the property. The feature is an intermittent stream and
transitions to a perennial stream at the flag labeled "B 1 ".
• Feature "C" is subject to the Neuse Buffer Rule from the flag labeled "C1" as an intermittent stream and
transitions to a perennial stream at the flag labeled "C2".
• Feature "D" is not subject to the Neuse Buffer Rule,
• Feature "E" is not subject to the Neuse Buffer Rule.
• Feature "F" is not subject to the Neuse Buffer Rule on the property or within 50 feet of the property
boundary.
• Feature "G" is not subject to the Neuse Buffer Rule, nor is the pond that is associated with the feature.
• Feature "H" is an uncontested perennial stream and is therefore subject to the Neuse Buffer Rule on the
property.
• Feature "I" is not subject to the Neuse Buffer Rule.
• Feature "J" is not subject to the Neuse Buffer Rule.
• Feature "K" is not subject to the Neuse Buffer Rule.
• Feature "L" is not subject to the Neuse Buffer Rule on the property or within 50 feet of the property
boundary.
• Feature "M" is not subject to the Neuse Buffer Rule on the property or within 50 feet of the property
boundary.
This on-site determination shall expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ that a surface water exists and that
it is subject to the buffer rule may request a determination by the Director. A request for a determination by the
Director shall be referred to the Director in writing c/o Cyndi Karoly, DWQ 401 Oversight/Express Review
Permitting Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. You must act within 60 days of the date that you
receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start until the

This letter only addresses the applicability to the buffer rules of the stream features listed above and does not
approve any activity within the buffers or address features that were not observed during the site visit. Nor does
