After reviewing your application, we have'determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3490 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). PROJECT SUMMARY: This permit application involves the construction of a private boat ramp facility for use by the property owners and guests of the Wild Horse Estates Subdivision in Carova, in Currituck County. This facility will include a boat ramp with a courtesy dock. The facility will also include a 400-sf shed for storage and an elevated walkway to access the waters of an adjacent canal on the property. Jay Bender / Wild Horse Estates, Currituck County FIELD INVESTIGATION REPORT Page 2 Project Setting The application site is an undeveloped 10.48 acre lot in the recently created subdivision, Wild Horse Estates. The subdivision is located west of Ocean Pearl Road adjacent to the existing Carova Beach Subdivision in Currituck County. The subdivision is made up of 13 large lots sandwiched between Carova Beach and North Swan Beach subdivisions, and a wild life reserve owned by the U. S. Fish and Wildlife Service. Wild Horse estates is north of the hard-surface NC 12 roadway and can only be accessed from the beach with four-wheel drive / off-road vehicle or by boat. The site elevation is approximately 2 to 3-ft above the NWL of the adjacent canal waters. The site is vegetated in predominately upland grasses. Portions of the adjacent shoreline are vegetated in U. S. Army Corps of Engineers (USACE) jurisdictional freshwater wetlands including Juncus effuses, Spartina patens and Andropogon glomeratus (broomsedge), as well as Myrica cerifera and Iva frutescens. A few small clumps of Juncus roemerianus are also located along the shoreline. The waters of the adjacent canal connect to Knotts Island Bay, which connects to the North Landing River. The North Landing River is a major tributary to the Currituck Sound. The North Carolina Environmental Management Commission has designated the waters of Knotts Island Bay as `SC' waters (suitable for fish propagation) and these waters are closed to the harvesting of shellfish. The Coastal Resources Commission (CRC) has also designated these waters as Public Trust Area and Estuarine Water Areas of Environmental Concern (AEC). Project Description The proposed project involves the construction of a private boat ramp facility for use by the property owners and guests of the Wild Horse Estates Subdivision in Carova, in Currituck County. This facility will include a boat ramp with a courtesy dock. The 252-sf "L" shaped courtesy dock will be located to the west of the ramp. The facility will also include a 400-sf shed for storage and an elevated walkway to access the waters of an adjacent canal on the property. The shed will be located 50-ft east of the NWL. The walkway will extend to the NWL of an adjacent canal. The walkway will be elevated 3-ft above the adjacent wetlands and be 6-ft wide and 70-ft long. The boat ramp will be 10-ft wide, 30-ft long, and constructed of concrete. Approximately 50-sf of the ramp will be situated waterward of the NWL. A 489-sf gravel boat ramp drive will be constructed to access the ramp. Anticipated Impacts The proposed fill and land disturbing associated development (including impervious surfaces) will result in the disturbance of approximately 789-sf of area within the Estuarine Shoreline and Estuarine and Public trust Waters AECs. An additional 84-sf of Estuarine and Public Trust waters will be shaded, as well as 448-sf of 404 wetlands. The proposed development is consistent with the rules and guidelines associated with boat ramp and pier structures referenced in Title 15A, NCAC 07H, and the proposed upland development is consistent with the rules associated with development within the Coastal shoreline Buffer Area.
