As we discussed yesterday on the phone, we are planning on responding to your February 4, 2009 request for
more information before the end of this month. I met with the engineer and client to discuss the avoidance and
minimization comment and they are evaluating and analyzing the sheet flow conditions in the areas adjacent to
(or within) the buffers. I will update you as to our response schedule once I hear back on this issue from them.
