Dear Mr. Sams,
We are writing to you on behalf of Mr. Elijah Morton, in response to a Notice of Violation letter
dated June 25, 2018 for the above referenced project. Response to the items requested is as follows:
1. Restoration of the impacted areas is currently underway. After the NOV was issued on
June 25, 2018, Mr. Morton's staff began working on the impacted area behind Lot 275 to
prevent further sedimentation into the wetlands. By July 18, a wall of rip rap was
installed around the wetlands in an attempt to stop sedimentation from occurring in the
wetlands as sediment removal had already begun. By August 30, the entire rear and side
of Lot 225 had been regraded and sloped back to a 3:1 slope. The bare areas around this
lot were seeded with straw also being installed. A new sediment trap was installed to help
prevent further sedimentation, and the silt fence was reinstalled around this lot.
Between the dates of September 12-15, this area felt the full impacts of Hurricane
Florence with over 30" of rain occurring near this site. The site was not accessible again
until nearly two weeks after the hurricane. At that point, it was realized that all previous
attempts to prevent further sedimentation from occurring in the wetlands had failed.
Another site visit occurred on October 23 with NCDEQ and USACE flagging the extent
of the impacted areas. By this time, the slopes behind Lot 275 were repaired once again
along with the silt fence and damaged sediment traps. Sediment removal had also begun
again with approximately seven workers removing sediment from the wetlands by hand
behind Lot 275. Pending future inclement weather conditions, Mr. Morton plans to have
all sediment removed from the wetlands and all erosion control measures installed and
properly functioning within 60 days of this letter. A revised plan will also be submitted
before this date detailing a permanent solution to prevent sedimentation from occurring in
this area again.

2. Rainfall data and Inspection Reports are enclosed.
3. To prevent these types of problems from recurring in the future, Mr. Morton and the
contractor will review the design plans and the construction sequence prior to beginning
work, and will contact the engineer if any questions or modifications arise in regards to
erosion control. Mr. Morton will also help ensure the contractor installs and maintains all
designed erosion control measures on site and add more if needed. Stormwater Self -
Inspections have been conducted on site and Mr. Morton and the contractor will
thoroughly review these reports and implement any repairs that are needed.
4. An 11" x 17" restoration plan for Peyton's Ridge, Section VI and Peyton's Lake titled,
"Wetlands Sediment Impact" (Sheets 1-4 of 4) is enclosed for your use. The plan shows
the current 404 wetlands delineation, and the limits of impacts from sedimentation (four
impacts total). The impact limits were flagged by Robb Mairs of the Division of Water
Resources and Rachel Capito of the Army Corps of Engineers on October 23, 2018. The
sediment impact totals 0.44 acres and is approximately 6" — 3' deep in various locations.
The total accumulation of sediment totals approximately 30,274.2 cubic feet. All
restoration will be done by hand labor (buckets, shovels, and wheelbarrows) as noted. We
have been in direct contact with Mr. Morton and his employees since the site inspection
on October 23 to assure restoration is implemented in this manner as soon as practical.
5. We do not feel Mr. Morton deserves a penalty due to the severity of the inclement
weather conditions he has faced. The NOV was hand delivered on June 29, 2018 to Ms.
Jennifer Ward. From that time, Mr. Morton and his staff had three weeks of suitable
weather to assess and begin resolving the issue of sedimentation in the wetlands. During
those three weeks, Mr. Morton's staff made progress removing sediment from the
wetlands and attempting to temporarily prevent further sedimentation. The next 25 days,
the area received 20.4" of rainfall, with only six days of not recording a rainfall. Several
of these rain events were over 2.0".
After that extended period of inclement weather, Mr. Morton was once again able to
assess and begin resolving the issue of sedimentation in the wetlands. Much of the
progress previously made was damaged allowing sediment to enter the wetlands again.
During this second period of suitable weather (29 days), Mr. Morton's staff was able to
make even more progress removing sediment from the wetlands and attempting to
permanently prevent further sedimentation by sloping the rear of the lot to a 3:1 slope and
seeding and adding straw to the lot. Erosion control measures were once again cleaned
and re -installed.

Hurricane Florence severely impacted the area from September 12-15 dropping over 30"
of rain in this area (mostly over a two day span). The site was inaccessible for nearly two
weeks after the hurricane left the area. Once again Mr. Morton was left to access the
damage left by the unprecedented amount of rain from Hurricane Florence. During the
three weeks prior to the site inspection by NCDEQ and the USACE on October 23, Mr.
Morton's staff began removing sediment from the wetlands and attempting to prevent
further sedimentation.
Mr. Morton has now hired Parker and Associates, Inc. to re -design the area where these
issues are occurring and to create a plan for a permanent solution to the recurring
sedimentation issues.
Please find enclosed two (2) copies of the "Wetlands Sediment Impact" maps (Sheets 1-4
of 4) and the Rainfall/Inspection Reports. If any additional information is required for
this matter, please contact me.

Peytons Ridge V:
1. Some minor erosion is occurring in roadside ditches.
2. Sediment needs to be removed from Pipe A.
3. Install proper sediment control features on lots under construction to prevent sediment from leaving
these lots.
Section VI
1. The wetlands crossing from Section III to Section VI has been dressed and sodded. Silt fence is no
longer needed, but sediment is still in the wetlands and needs to be removed.
2. Inlet protection at some cross drain pipes need to be cleaned.

3. Silt fence is underwashing behind lot 226.
4. Silt fence behind lot 237 needs to be repaired/backfilled. Sediment is now beginning to enter the
wetlands behind this lot.
5. Silt fence behind lot 238 is damaged allowing sediment to leave the site and possibly enter the
wetlands.
6. Wire with 57 stone behind Skimmer Basin #3 needs to be cleaned.
7. Skimmer Basin #4 needs to be cleaned. Severe erosion is occurring in the Swale before this basin.
8. Silt fence is underwashing in multiple areas behind Sediment Trap #9.
9. Multiple washouts have occurred in the road in the unpaved section.
10. Continue to establish groundcover in bare areas, especially in bare roadside ditches/swales and on
the backside of lots that have been filled.
Peyton Lake
1. Silt fence and wire with 57 stone need to be repaired at the wetlands finger by Lot 275. Sediment is
beginning to enter wetlands and needs to be removed by hand.
2. Erosion is occurring in roadside ditches and swales. Establish groundcover as soon as practical.
3. Erosion is occurring around the RCD in Sediment Trap #2 allowing water to bypass this RCD.
4. Continue installing silt fence around cleared areas.

3. Silt fence has been damaged behind Lot 238. There are also a couple of areas underwashing the silt
fence behind this lot.
4. Wire with 57 stone behind Skimmer Basin #3 needs to be cleaned.
5. Skimmer Basin #4 needs to be cleaned. Erosion is occurring in the swale before this basin and needs
to be repaired.
6. Silt fence behind Sediment Trap #9 needs to be repaired.
7. There is a washout occurring in the roadway by Pipe D that needs to be repaired.
8. Continue to establish groundcover in bare areas, especially in bare roadside ditches/swales and on
the backside of lots that have been filled.
9. Multiple RCDs in ditches and swales have been blown out or damaged due to heavy rainfall events.
Peyton Lake
1. Silt fence and wire with 57 stone need to be repaired at the wetlands finger by Lot 275. Sediment is
beginning to enter wetlands and needs to be removed by hand.
2. Erosion is occurring around the RCD in Sediment Trap #2 allowing water to bypass this RCD.
3. Continue installing silt fence around cleared areas.

11. More of Lot 228 has been cleared, including a portion of the wetlands. Restore the wetlands and add
a second row of silt fence just before the wetlands.
Peyton Lake

entering the wetlands and needs to be removed by hand. A pipe has been previously installed in this

1. Some minor erosion is occurring in roadside ditches.
2. Sediment needs to be removed from Pipe A.

(continued):
3. Silt fence has been damaged behind Lot 238. There are also a couple of areas underwashing the silt
fence behind this lot.
4. Wire with 57 stone behind Skimmer Basin #3 needs to be cleaned.
5. Skimmer Basin #4 needs to be cleaned. Erosion is occurring in the swale before this basin and needs
to be repaired.
6. Silt fence behind Sediment Trap #9 needs to be repaired.
7. There are washouts occurring in the roadway by Pipes C and D that need to be repaired.
8. Continue to establish groundcover in bare areas, especially in bare roadside ditches/swales and on
the backside of lots that have been filled.
9. Multiple RCDs in ditches and swales have been blown out or damaged due to heavy rainfall events.
10. Silt fence is underwashing behind Lot 226.
11. More of Lot 228 has been cleared, including a portion of the wetlands. Restore the wetlands and add
a second row of silt fence just before the wetlands.
Peyton Lake
1. Silt fence and wire with 57 stone need to be repaired at the wetlands finger by Lot 275. Sediment is
entering the wetlands and needs to be removed by hand. A pipe has been previously installed in this
area and is outleting directly into the wetlands.
2. Erosion is occurring around the RCD in Sediment Trap #2 allowing water to bypass this RCD.
3. Continue installing silt fence around cleared areas.

3. Silt fence behind Lot 238 is currently being repaired by Duane +2. Sediment has entered the wetlands
and needs to be removed.
4. Skimmer Basin #4 has been cleaned and all erosion upstream has been repaired.
5. There are washouts occurring in the roadway by Pipes C and D that need to be repaired.
6. Continue to establish groundcover in bare areas, especially in bare roadside ditches/swales and on
the backside of lots that have been filled.
7. Multiple RCDs in ditches and swales have been blown out or damaged due to heavy rainfall events.
8. Silt fence is underwashing behind Lot 226.
9. More of Lot 228 has been cleared, including a portion of the wetlands. Restore the wetlands and add
a second row of silt fence just before the wetlands.
Peyton Lake
1. Silt fence and the slopes behind Lot 275 have been repaired. The bare areas have been seeded and
strawed. Sediment is still in the wetlands and needs to be removed by hand.
2. Erosion occurring around the RCD in Sediment Trap #2 has been repaired.
3. Continue installing silt fence around cleared areas.

needs to be repaired. The RCD in this basin has also blown out.
4. Silt fence behind Lot 237 needs repair in multiple locations. Sediment is entering the wetlands.
5. Silt fence is underwashing behind Lot 226.
6. Continue to establish groundcover in bare areas, especially in bare roadside ditches/swales and on
the backside of lots that have been filled.
7. A portion of the wetlands behind Lot 228 has been cleared. Reinstall silt fence before wetlands and
restore back to its natural condition.
8. Silt fence behind SB#4 has blown out allowing sediment to enter the wetlands. Some erosion is
occurring in the swale leading to this basin. A 24" pipe has been installed as the basin outlet, but a
skimmer and a RCD should have been installed.
9. The silt fence behind Lot 238 has been damaged in multiple areas allowing sediment to enter the
wetlands.
10. The RCD in ST#9 needs to be repaired.
11. ST#1 and the RCD in this trap both need to be cleaned. Sediment has crossed the compost sock, but
has not entered the wetlands.
Peyton Lake
1. Severe erosion has occurred around the sediment trap on Lot 275 and also along the back of Lot 275.
More sediment continues to enter the wetlands.
2. A small portion of ST#2 has blown out. Silt fence behind this trap has been damaged allowing
sediment to enter the wetlands.
3. Continue installing silt fence around cleared areas.

Peytons Ridge V:
1. Some minor erosion is occurring in roadside ditches.
2. Sediment needs to be removed from Pipe A.
3. Install proper sediment control features on lots under construction to prevent sediment from leaving
these lots.
Section VI
1. Sediment that has previously entered the wetlands crossing from Section III to Section VI still needs
to be removed.
2. Wire with 57 stone behind S13#5 is damaged and needs to be repaired.

3. Wire with 57 stone behind S13#3 needs to be cleaned. The swale leading up to this basin is eroding and
needs to be repaired. The RCD in this basin has also blown out.
4. Silt fence behind Lot 237 has been repaired
5. Silt fence is underwashing behind Lot 226.
6. Continue to establish groundcover in bare areas, especially in bare roadside ditches/swales and on
the backside of lots that have been filled.
7. A portion of the wetlands behind Lot 228 has been cleared. Reinstall silt fence before wetlands and
restore back to its natural condition.
8. Silt fence behind Lot 237/238 and S13#4 have all been repaired. The sediment flagged in the wetlands
by NCDEQ needs to be removed. A 24" pipe has been installed as the basin outlet, but a skimmer and
a RCD should have been installed.
10. The RCD in ST#9 needs to be repaired.
11. ST#1 and the RCD in this trap both need to be cleaned. Sediment has crossed the compost sock, but
has not entered the wetlands.
12. Silt fence needs repair behind Lot 219.
13. Silt fence beside Lot 218 needs to be repaired. Sediment flagged in the wetlands by NCDEQ needs
to be removed.
Peyton Lake
1. Erosion occurring on Lot 275 has been repaired, but the area needs to be stabilized and new erosion
control measures need to be installed to prevent more sediment from entering the wetlands. Sediment
flagged in the wetlands by NCDEQ needs to be removed.
2. A small portion of ST#2 has blown out. Silt fence behind this trap has been damaged allowing
sediment to enter the wetlands.
3. Continue installing silt fence around cleared areas.
