12-SPGP-01 Special Conditions

In addition to all general conditions of 12-SPGP-01 and conditions required of your Virginia
Water Protection Permit authorization, you will be required to comply with the following special
condition(s) of your 12-SPGP-01 authorization:
1. Provide 50 percent and 90 percent design drawings (initial drawings entitled “Danville,
Pittsylvania Co. Regional Industrial Facility Authority-Berry Hill Commerce Centre-
Wetland Permit-Phase 1-Special Conditions Permit” dated June 30, 2015 (attached))for
review by VDHR, Preservation Virginia, and Pittsylvania Historical Society and for
review by and written approval from the Corps, for Berry Hill Industrial Park that clearly
identifies:
a. The 75-foot wooded buffer that will remain in perpetuity along Berry Hill Road.
The placement of the buffer should take into consideration any future expansions
of Berry Hill Road.
b. The 100 foot Industrial Access breaks as shown on the Phase 1 Special
Conditions Exhibit.
c. The 50-foot wooded buffer that will remain in perpetuity along Oak Hill Road.
The placement of the buffer should take into consideration any future expansions
of Oak Hill Road.
d. The 100 foot Industrial Access breaks allowed as shown on the Phase 1 Special
Conditions Exhibit.
e. The location of resource 071-5322 and the proposed 75-foot wooded buffer that
will remain in perpetuity around this resource.
f. The location of resource 071-5336 and the proposed 50-foot (minimum) wooded
buffer that will remain in perpetuity around this resource. If any encroachment
into the buffer should occur as a result of any future expansions of Berry Hill
Road, the buffer will be replanted at the completion of the expansion project.
g. A supplemental planting plan, if necessary, that will include tree and shrub
species that will supplement the existing buffer and provide additional screening.
2. Ninety days prior to any land clearing or grading, a completed draft of the attached
Declaration of Restrictive Covenants Template, that protects the above areas in perpetuity
and the associated plat, must be submitted for review by VDHR, Preservation Virginia,
the Pittsylvania Historical Society, and review by and written approval from the Corps.
Evidence that the Declaration of Restrictive Covenants and associated plat has been
recorded at the county must be provided within 30 days of the Corps written approval of
the draft documents.
Failure to comply with all terms and conditions, including special conditions, of your
12-SPGP-01 authorization, may result in the Corps of Engineers taking enforcement action
against you and/or your contractor.
