The project site is the old US Coast Guard facility on Ocracoke at 2 Irvin Garrish Highway (NC 12), adjacent the Pamlico Sound and Silver Lake in Hyde County, North Carolina. The site comprises ±3.68 acres and forms a peninsula on the north side of the entrance into Silver Lake. Access to the site is a concrete road easement through National Park Service (NPS) land originating at the staging/parking area for the NC DOT ferry terminal. Currently on site is a large L-shaped building that was the old Coast Guard Station. A separate garage outbuilding with a wooden deck and two attached sheds also exist on site. An elevated concrete parking platform with a concrete ramp access connects the Coast Guard Station and the garage. Several docks with floating components, a boat ramp and bulkhead can be found on the Silver Lake side adjacent the NC DOT ferry loading facility. Approximately 500, of the Sound side of the site is protected by riprap that was installed under CAMA General Permit No. 42292, issued on 22 November 2005. This riprap ties into the existing rock jetty that protects the north side of the entrance to Silver Lake. The remaining portion of the sound side shoreline on the north end of the site is partially protected with some existing riprap and the remnants of an old concrete bag breakwater offshore. The site has an existing septic tank and drain field system and water is provided by the County water system. Vegetation on the site is a mix of red cedar and wax myrtle with pennywort, sea oats and upland grasses. The area adjacent the sound on the north end of the site has been delineated as Coastal Wetlands by the Division of Coastal Management consisting of Spartina alterniflora, Juncus roemerianus, and S. patens. The site is bordered on the north (upstream) side by NPS land and is the site of the NC DOT Ocracoke ferry terminal. A deteriorated chain link fence exist on the property line between the applicant's property and the NPS land. The site is bordered on the south (downstream) side by the riprap stabilized channel entrance to Silver Lake as well as a ±1.5 acre piece of property that was retained by the US Coast Guard. The project site has an existing elevation ranging between 0.5 and 3.0 feet above the mean high water level (MHW). Pamlico Sound has been classified as SA by the Environmental Management Commission and is open to the harvesting of shellfish. Silver Lake has been classified as SC by the Environmental Management Commission and is closed to the harvesting of shellfish. Project description The applicant proposes to renovate the old Coast Guard facility into a teaching facility for North Carolina teachers. The Coast Guard Station will be renovated within the C/O North Carolina Department of Administration Hyde County Express Permit Review Program Page Two existing footprint. The existing 10' wide concrete driveway will be replaced with a 20' wide asphalt drive and a 60, diameter terminal cul-de-sac will be constructed. Approximately 140' of the new driveway will be within the 75' Coastal Shoreline (CS) Area of Environmental Concern (AEC) with an impact of ±2,800 W. A new asphalt parking area will be constructed of which ±2,600 ft2 will be within the CS AEC. A 20' wide gravel access will connect the new cul-de-sac to the existing gravel drive at the Coast Guard boat ramp and ±200 ft2 of the new gravel access will be within the CS AEC. A ±18' by ±351(630 ft2) utility building (in place of the wooden deck and two sheds) is planned adjacent to the existing garage and ±162 ft2 of the new structure will be located within the CS AEC. A total of 70 geo-thermal wells will be installed on the site and all are outside the CS AEC. The chain link fence on the property line with the NPS will be replaced. The existing elevated concrete platform and ramp will be replaced with wooden decks and walkways between the garage and the renovated station. A sand berm will be constructed between the riprap shoreline and the proposed driveway. This berm was previously authorized via CAMA Minor Permit No. 20-2005, issued on 5 August 2005. The total amount of impervious coverage for the site is ±46,533 ft2 or 29%. As proposed, the amount of impervious coverage within the 75, Coastal Shoreline Area of Environmental Concern (AEC) is ±13,872 ft2 or 17%, which is below the 30% allowed by rule (this value includes ±2,766 ft2 of new impervious surface). Work is proposed within Zone 2 of the DWQ buffer and this includes impervious surface. Anticipated impacts The project as proposed will result in the disturbance of ±39,204 ft2 of uplands as a result of the construction activities. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. DCM-MP-1 APPLICATION ADDITIONAL RESPONSES DCM-MP-1 (3) continued (d) Give a brief description of purpose, use, methods of construction and daily operations of proposed project. PURPOSE: Upland portions of the site including existing facilities will be developed and refurbished for use as a teacher's coastal education professional development center by the North Carolina Center for the Advancement of Teaching (NCCAT). Driveway and parking upgrades for the site are required to provide parking for support of this educational facility and driveway access for seasonal Coast Guard use at their southern ramp. USE: The facility will be used by NCCAT as an instructional facility for teachers with indoor and outdoor study courses. The facilities will allow classes to be multi-day events with participants staying in dormitories on site and attending indoor lectures. Classes will also use the coastal environment as a learning tool and incorporate outdoor coursework. Future phases of the station renovation project will include shoreline protection and restoration features for additional outdoor learning opportunities. The site will also be used be the NPS and USCG. NPS will have access to the grounds and pathways. USCG will have access through easements to their property and to boat ramps extending into Silver Lake Harbor. CONSTRUCTION METHODS: During the construction, it is anticipated a front-end loader, backhoe and dozers will be used on site. As the parking area is implemented, a paving machine will be brought in for that purpose only. DAILY OPERATIONS: Daily operations will vary with the course work described in the uses above, but will also include site maintenance and administration activities. DCM-MP-1 (4) Land and Water Characteristics (c) Approximate elevation of tract above MHW or NHW MHW at the property is 0.363 feet. Elevation on the property extends from the shoreline to a peak of +10.24 feet above MHW on the sand berm. However, the majority of the property (and the disturbance activity) is located between +0.5 to +3 feet above MHW. (e) Vegetation on tract Red Cedar and Wax Myrtle are probably the most abundant trees on (and adjacent to) the property. Sea oats and pennywort are also common species along with other species associated with Dune Grass, Maritime Shrub, and Salt Marsh habitats on Ocracoke Island. The Draft Hyde County CAMA Land Use Plan indicates that the existing and future uses of the site are "office/Institutional", which is consistent with the proposed project. The property is owned by the State of North Carolina. Per the State Construction Manual: Under the provisions of GS 153A-340 through 347, a county may regulate and restrict the following: and Under the provisions of GS 160A-381 through 391, a city may regulate and restrict the following: 1. The height, number of stories, and size of buildings and other structures; 2. The percentage of a lot that may be occupied; 3. The size of yards, courts and other open spaces; 4. The density of population; and 5. The location and use of buildings, structures, and land for trade, industry, residence, or other purposes, except farming. Ocracoke Development Ordinance has been adopted by Hyde County. The ordinance establishes minimum lot sizes, total lot cover (i.e., no more than 50% of any lot can be covered with structures or other impervious surfaces to help control stormwater), setbacks, and height restrictions on new development and substantial redevelopment, but does not provide zoning or restrict specific land uses. It is administered by the County Building Inspector and an Ocracoke Village ordinance advisory committee. The existing main facility is not being expanded. The entire property is under 50% developed. The maximum building height for the utility building addition is shorter than the existing structure. The addition has been reviewed by the Ocracoke Preservation Society and the North Carolina Department of Cultural Resources, State Historic Preservation Office (letters attached under "Previous State or Federal Project Permits". Also, additions to the utility building do not encroach on adjacent property setbacks (approximately 125 feet from NPS property). According to the general statutes referenced in the State Construction Manuel, the ordinance does not have jurisdiction over parking areas on state property. DCM-MP-1 APPLICATION ADDITIONAL RESPONSES DCM-MP-1 (4) continued (1) Coastal (marsh) delineation Figures provided in this permit application identifies the coastal line (CWL) delineated by Steve Trowell of Division of Coastal Management and immediately surveyed by BILD survey consultants on June 22, 2006. Coastal marsh on the property exists on the Pamlico Sound adjacent to the National Park Service (NPS) property between the NPS bulkhead and the delineated CWL. Since this area will not be disturbed by the proposed project, further delineation was not required. (m) Describe existing wastewater treatment facilities Existing wastewater treatment facilities will be handled with subsurface disposal on site with the original functioning leach fields for the facility. This has been reviewed with Hyde County Health Department and approved for this use by this facility and its proposed use (NPS approval letter is provide with the "TAB 5: Previous State or Federal Project Permits" section of this permit application package). (n) Describe location and type of discharges to waters of the state. (For Example, surface runoff, sanitary wastewater, industrial/commercial effluent, "wash down" and resident discharges.) Existing Stormwater drainage from impervious surfaces around the building and the existing driveway are currently draining to three areas: onto adjacent NPS property, into the Pamlico Sound, and into Silver Lake Harbor (Figure 3, Existing Drainage). Runoff from the existing roadway and other impervious areas is conveyed in the form of sheet flow across the vegetated areas and infiltrates in the sandy soils. There are no stormwater swales/ditches or culverts discharging from the site. Runoff from a portion of the existing buildings is stored in a series of cisterns and is used for irrigation. The original cisterns are in place for on site containment of the rainwater falling upon the buildings and impervious surfaces for the original Coast Guard Facility. The cisterns were originally designed to retain a 25 year storm. The total volume of the cisterns is 47,000 gallons. Overflow from these facilities goes to a pipe discharging to the stormwater.control system described below. Collected rainwater will be used for landscape irrigation on site. Proposed Proposed grading and drainage patterns are illustrated in Figure 4 (Proposed Drainage) and sheets SW-1 (Stormwater Plan), SW-2 (Proposed Drainage), and SW-3 (Stormwater Detail Sheet). The new parking area and driveway improvements will be graded to convey runoff as sheet flow along the driveway towards the proposed cul-de-sac. The majority of the new layout of the driveway is generally within the area of the original driveway and is not new impervious impact. Runoff from a portion of the buildings will be collected in the cisterns, with an overflow outlet to the driveway. A portion of the runoff currently directed towards the National Park Service property will also be redirected to the NCCAT driveway. Stormwater directed over the driveway will outlet through a planned curb cut at the cul-de-sac to a preformed scour hole. It is the policy of the Coastal Resources Commission to assess a civil penalty for all violations. This is done to recover some of the cost of investigating violations and/or to compensate the public for any damage to its natural resources. In a previous memo, I wrote that there would be no antifreeze nor corrosion inhibitors in the geothermal well and piping systems. Because of this, the letter from Slusser states that a well permit is not required. Slusser's letter also states that we should check with the Hyde County Health Department prior to constructing the system for any additional requirements. On Tuesday, November 21, 2006, I contacted Hugh Watson, Hyde County Health Department, and verified that were no additional requirements. In addition, on Tuesday, November 21, 2006, I also talked to David Putney. State Construction Office, to again review Slusser's letter. Construction and land disturbing activities must fall under both the general minimum criteria and- any specific minimum criteria applicable to the project, (1) General criteria. The following categories of land disturbing activity do not require preparation of an environmental document. (a) In the 20 coastal counties, land disturbing activity that: (i) is located more than 575 feetaway from waters classifiedas High Quality Waters (HQW) or impacts less than five acres located all or in part within 575 feet of waters classified as High Quality Waters (I-IQW); (ii) is located outside of any Outstanding Resource Waters (ORW) watershed or area that requires specific management actions to protect ORW waters as defined in 15A NCAC 021.0225; and (iii) impacts less than five acres located in any, Outstanding Resource Waters (ORNV watershed or in any area that requires specific management; actions to protect ORW waters as defined in 15A. NCAC 02B.0225. (b) Land disturbing activity outside the twenty coastal counties that: (i) is located more than one mile from waters classified as HQW or impacts less than five acres located within one mile of and draining to waters classified as HQW; - (it) is located outside of any Outstanding Resource Waters (ORW) watershed or area that requires specific management actionsto protect ORNV waters as defined in 15A NCAC 02B .0225; (iii) impacts less than five acres located in any Outstanding Resource Waters (ORW) watershed or in any area that requires specific management actions to protect ORW waters as defined in 15A NCAC 02B .0225, and (A) is located more than 25 feet from any waters classified as Trout (Tr) waters or impacts less than five acres located all or in part within 25 feet of any waters classified as Trout (Tr) waters: (c) Channel disturbance and land disturbing activities associated` with non-compensatory stream restoration or stream enhancement. (d) Land disturbing activities impacting wetlands if the activity will result in the loss of one acre or less of Class`WL wetlands. (e) Land disturbing activities impacting streams if the activity will result in channel disturbance of less than 500 linear feet of perennial streams. Land disturbing activities that impact 500 linear feet or more of perennial streams do not require preparation of an environmental document if stream restoration or stream enhancement is performed. (2) Specific Criteria. Construction or expansion activities listed below require an environmental document if they exceed either the nunimum criteria set out in Item (1) of this Rule or the thresholds established below. (a) The following activities related to wastewater treatment systems. (i) Relocation of discharge points within the same river basin; (ii) New discharge facilities witha proposed permitted expansion of less than, 500,000 gallons per day and producing an instream waste concentration of less than 33 percent during the 7-day 10-year low flow conditions; - (iii),Expansion of an existing discharge facility of less than 500,000 gallons per day additional flow; (iv) New surface irrigation, high rate infiltration, or subsurface waste water systems with a. proposed permitted capacity not exceeding 100,000 gallons per day; (v) Reclaimed water utilization systems with reclaimed: water utilization being the sole disposal option with a proposed permitted capacity not exceeding 200,000 gallons per day; (vi) New reclaimed water utilization sites with a proposed permitted capacity not to exceed 500,000 gallons per day when the reclaimed water utilization system is required for compliance with any other wastewater disposal permit; (vii) New reclaimed water' utilization sites with a proposed permitted capacity not to exceed 1,000,000 gallons per day when the reclaimed water utilization system is not, required for compliance with any other wastewater disposal permit; (viii) New reclaimed water utilization distribution lines; (ix) New permits oz modification to existing permits for land application of residuals utilization; where less than 10 acres not previously permitted is prior converted within three years or will be converted from a non- plantation forested area to application area; (x) New or expanding surface disposal sites disposing less than 3000 dry tons of residuals per year; (xi) Gravity sewer extensions with less than three miles of new lines or lines of less than 18 inches in diameter; and (xii)' New or expanding individual pump stations and associated force mains with a proposed, pen-pitted capacity, of less than 1750 gallons per minute. (b) The following activities related to potable water systems. (i) Improvements to water treatment plants that involve less than 1,000,000 gallons per day added capacity. and total design withdrawal less than one-fifth of the 7-day, 10-year low flow of the contributing stream; (ii) Improvements not intended to add capacity to thefacility; (iii) Installation of appurtenances in existing rights-of-way for streets or utilities, or water lines and appurtenances less than five miles in length and having only directional bore stream crossings or no stream crossings; and (iv) Construction of water tanks, or booster pumping or secondary or remote disinfection stations. (c) Groundwater withdrawals= of less' than 1,000,000 gallons per day" where such withdrawals are not expected to cause alterations in established land use patterns, or degradation of groundwater or surface water quality. (d) The following activities related to solid waste disposal: (i) Construction of solid waste management facilities, other than landfills exempt pursuant to G.S. 130A-294 (a)(4), which store, treat; process incinerate, or dispose of less than 350 tons per day (averaged over one year) of solid waste; and (ii) Disposal of solid waste by land application on 100 total acres or less, where less than 10 percent of the total land application area is converted from a non-plantation forested area. (e) Development requiring a Coastal Area Management Act (CAMA) permit or State Dredge and Fill Law permit that does not involve: (i) Construction of a new marina, or a 25%o or greater expansion in the number of slips at existing and operating marinas; (ii) Excavation of a, new navigation channel. Maintenance activities associated with maintaining the traditional and established use of a channel and new excavation activities located entirely within 100 feet of the shoreline, or within 50 feet from the waterward edge of any existing or authorized docking facility and involving the excavation of less than 5,000 square feet of public trust bottom do not constitute excavation of a new navigation channel for purposes of these rules. (iii) Excavation of materials from aquatic environments for use for beach nourishment or other purposes not directly related` to approved navigation projects; (iv) A large scale beach nourishment or spoil deposition project. A project shalt be considered large scale when it places more than a total volume of 200,000 cubic `yards of sand at an average ratio of more than 50 cubic yards of sand per linear foot of shoreline; (v) The salvaging of cut logs from public trust waters for commercial use, unless the salvage operation complies with any departmentally-approved best management practices developed for such activities; (vi) The construction over state owned submerged lands of private bridges w privately owned islands, unless` the length of the bridge is less than 50 feet; and (vii) The excavation, dredging or other hydrodynamic manipulation of an inlet; inlet channel(s) or inlet shoal(s) for non-navigational purposes. (f) Construction of a minor source or modification of a minor source of air emissions as defiried in 15A NCAC 02D .0530, that are less than 100 tons per year or 250 tons per year as defined therein. (g) Construction relating'to the reclamation of underground storage tanks and restoration: of groundwater quality. (h) The construction, repair or removal of dams less than 25 feet in height and having less than 50 acre-feet of effective storage capacity: (i) Any new construction forabuilding .which involves all'of the following; (i) A footprint of less than 10,000 square feet; (ii) ,A location that is not aNationaI Register Archaeological site; and (iii) The building's purpose is not for storage of hazardous waste. 0) Demolition of or additions, rehabilitation or renovations to a structure not listed in the National Register of Historic places or less than 50 years of age.. (k)`Routine grounds construction and landscaping of sidewalks, trails, walls, gates and related facilities, including outdoor exhibits. (1) Installation of on-farm Best Management Practices that meet the standards of the North Carolina Soil and Water' Conservation Commission and the federal Natural Resources Conservation Service. (m) Construction or remodeling of swimming pools. (n) Construction of a new two-lane road in accordance with DOT accepted design practices and DOT standards and specifications involving less than a total of 25 cumulative acres of ground surface limited to a single project, and not contiguous to any other project making use of this provision. (o) Expansion of a two-lane road in accordance with DOT accepted design practices and DOT standards and specifications involving less than a total of 10 cumulative acres of ground surface limited to a single project, and not contiguous to any other project making use of this provision.
