D Division of Coastal Management A North Carolina Department of Environment ?G 1 2006 and Natural Resources DEN 400 Commerce Avenue 1 ` M0STrSQUAL1 Morehead City, North Carolina 28557-3421 Dear Mr. Huggett: Reference the application of Southport Marina, Inc for a Department of the Army permit for renovation and maintenance to Southport Marina, including the replacement of existing docks, filling the existing lift well, construction of a new lift pad, construction of a new commercial dock, and construction of an elevated boardwalk as described in the CAMA application dated April 13, 2006 and received by this office on June 13, 2006. The proposed project will result in a total of 251 slips (current total is 228 slips) and a transient dock measuring 12' wide by 368 ft long located at the end of C dock. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910- 3282 at least two weeks prior to beginning work and upon completion of work. 3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 4. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 7. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 8. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910) 772-2191. 9. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 2 10. Approval of the structure was based on determinations that there would be no obstruction to navigation. Under conditions existing in the Atlantic Intracoastal Waterway (AIWW), a possibility exists that the structure may be damaged by wave wash from passing vessels. Unreasonable slowing down of vessel traffic cannot be required because it would tend to nullify the navigational benefits on which the AIWW was justified. Issuance of this permit should not be construed, as relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave wash normally to be expected in the AIWW. 11. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 12. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 13. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 14. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 15. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre-project condition. 16. S. Fish and Wildlife Service (Service) on the subject Public Notice (PN), dated June 22, 2006. The applicant, Southport Marina, Inc., has applied for a Department of the Army (DA) permit to make major modifications to an existing State Permit (No. 99-01) for the purpose of maintaining and renovating the Southport Marina. The proposed work is being considered under Regional General Permit #198000291, a permit/processing agreement for work that has been approved pursuant to the North Carolina Coastal Area Management Act (LAMA). These comments are submitted in accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Comments related to the FWCA are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) in relation to the protection of fish and wildlife resources. Additional comments are provided regarding the District Engineer's determination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). Project Area, Proposed Actions, and Anticipated Impacts The project area, proposed work, and anticipated impacts are described the Field Investigation Report (FIR), dated June 8, 2006, of the North Carolina Division of Coastal Management (NCDCM). The project site is a 44-acre tract owned by the North Carolina State Ports Authority and leased by the applicant. The existing marina is a full service facility with approximately 200 wet slips and 220 dry storage racks. The facility has a boat ramp, a fork lift haul out, and 75-ton open hoist travel lift. The facility connects to the Atlantic Intracoastal Waterway (AIWW) which is not designated as a primary nursery area (PNA) by the North Carolina Division of Marine Fisheries and is closed to the harvesting of shellfish. The applicant proposes to replace and reconfigure the existing fixed and floating docks. An existing lift well would be filled and a new forklift area and forklift pad would be constructed 2 adjacent to the existing travel lift area. A 12-foot-wide, elevated, pedestrian boardwalk would be constructed. Water at the waterward end of the piers is approximately six feet deep at mean low water (MLW). The FIR states that filling the existing lift well would impact 2,512 square feet (ft) of shallow bottoms. The new docking facility would impact approximately 200,000 ftz of estuarine waters and public trust area. Approximately 57,000 ft'- of this impact would consist of shading produced by the proposed docks, finger piers, walkways, and dock office structure. The FIR does not mention any impacts to emergent wetland vegetation (salt marsh) or submerged aquatic vegetation (SAV). Federally Protected Species The Service has reviewed available information on federally-threatened or endangered species known to occur in Brunswick County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database which contains excellent data on the special status species, both federal and state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). Data from USGS quads provide the most project-specific information on species which should be considered in permitting this project. The project area is in the Southport quad. The occurrence data of special status species within this quad can be obtained on the internet at < littp://www.ncnlhp.or«/Paacs/lierita«edat,i.litnil >. Our review indicates that the only federally protected species under Service jurisdiction that is likely to occur in the project area is the West Indian manatee (Trichechus inanatus), a federally- endangered mammal. There are current records for the manatee in the Southport quad, and the NCNHP database shows a known occurrence in the lower Cape Fear River between Southport and Battery Island. The Wilmington StarNews reported the presence of a manatee in Myrtle Grove Sound (New Hanover County), north of the project area, in late 2004. The estuarine waters of the lower Cape Fear River and AIWW provide suitable habitat for manatees that move along the Atlantic Coast during summer months and are seasonal transients in North Carolina, primarily from June through October. Manatees may occupy waters one to two meters (3.3 -6.6 feet) deep. Various project drawings indicate that waters within the marina are two to six feet deep at MLW. Manatees could occur in or near the area where pier construction would occur. The species moves extensively when in North Carolina waters and past occurrence records cannot be used to precisely determine the likelihood that it will be present at a particular construction site. To protect manatees in North Carolina, the Service developed guidelines entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina." These guidelines address all types of in-water construction, except blasting, and should produce little, if any, additional expense. The guidelines are intended mainly to ensure that: (1) construction personnel are informed that manatees may occur in the work; (2) work 3 should cease if a manatee approaches the work area; and, (3) work should not resume until the manatee leaves the work area. They also provide procedures for reporting the death or injury of a manatee. These guidelines are available on our web site at < httn://nc- es.fws.gov/mammal/manatee iuidelines.pdf>. The risk to manatees could be reduced to an acceptable level by the implementation of the Service's guidelines. The risk would be further reduced by performing the work during the period of November through May. With the inclusion of these manatee conditions as permit conditions, the Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. However, the requirement of section 7 would need to be reconsidered if. (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. Service Concerns and Recommendations The Service recognizes the developed nature of the project site. We also note that several aspects of the renovation have been authorized by recent permit modifications. With reasonable measures to protect the manatee, the Service does not believe the activities described in the PN and FIR would have significant adverse and/or irreversible effects on fish and wildlife resources. Therefore, the Service has no objection, from the standpoint of fish and wildlife resources under our jurisdiction, to the issuance of a DA permit for the proposed activities. Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 4. No Sediment & Erosion Control Measures w/n Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 5. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. Activities authorized by Coastal Area Management Act (CAMA) Minor or General Permits do not require written authorization from the Division of Water Quality as long as they comply with all other conditions of this General Certification; In accordance with North Carolina General Statute Section 143-215.3D(e), any request for written concurrence for a 401 Water Quality Certification must include the appropriate fee. If a project also requires a CAMA Permit, one payment to both agencies shall be submitted and will be the higher of the two fees. The fee shall be collected and distributed between the two agencies in accordance with agreements reached between the Division of Water Quality and the Division of Coastal Management; 4. In accordance with 15A NCAC 2H .0506 (h) compensatory mitigation may be required for impacts to 150 linear feet or more of streams and/or one acre or more of wetlands. In addition, buffer mitigation may be required for any project with Buffer Rules in effect at the time of application for buffer impacts resulting from activities classified as "allowable with mitigation" within the "Table of Uses" section of the Buffer Rules or require a variance under the Buffer Rules. A determination of buffer, wetland and stream mitigation requirements shall be made for any Certification for this Nationwide Permit. The most current design and monitoring protocols from DWQ shall be followed and written plans submitted for DWQ approval as required in those protocols. When compensatory mitigation is required fora project,. the mitigation plans must be approved by DWQ in writing before the impacts approved by the Certification occur. The mitigation plan must be implemented and/or constructed before any permanent building or structure on site is occupied. In the case of public road projects, the mitigation plan must be implemented before the road is opened to the travelling public; WQC #3400 5. Compensatory stream mitigation shall be required at a 1:1 ratio for not only perennial but also intermittent stream impacts that require application to DWQ in watersheds classified as ORW, HQW, Tr, WS-1 and WS-II unless the project is a linear, publicly- funded transportation project, which has a 150-foot per-stream impact allowance; 6. Impacts to any stream length in the Neuse and Tar-Pamlico River Basins (or any other major river basins with Riparian Area Protection Rules [Buffer Rules] in effect at the time of application) requires written concurrence from DWQ in accordance with 15A NCAC 213.0200. New development activities located in the protected 50-foot wide riparian areas (whether jurisdictional wetlands or not) within the Neuse and Tar- Pamlico River Basins shall be limited to "uses" identified within and constructed in accordance with 15A NCAC 2B .0200. All new development shall be located, designed, constructed, and maintained to have minimal disturbance to protect water quality to the maximum extent practicable through the use of best management practices. Activities listed as "exempt" from these rules do not need to apply for written concurrence under this Certification; 7. All sediment and erosion control measures placed in wetlands or waters shall be removed and the original grade restored after the Division of Land Resources has released the project; 8. If an environmental document is required, this Certification is not valid until a Finding of No Significant Impact (FONSI) or Record of Decision (ROD) is issued by the State Clearinghouse; 9. That appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" whichever is more appropriate (available from the Division of Land Resources (DLR) in the DENR Regional or Central Offices) shall be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to assure compliance with the appropriate turbidity water quality standard; 10. Measures shall be taken to prevent live or fresh concrete from coming into contact with freshwaters of the state until the concrete has hardened; 11. Southport Marina, Inc. June 8, 2006 Page 2 9. PROJECT DESCRIPTION The project site is located at 606 W. West Street, adjacent to the Atlantic Intracoastal Waterway, within the Town of Southport, in Brunswick County. To find the property from the intersection of South Howe Street and W. West Street, turn west onto W. West Street and travel approximately 0.45 miles to the Southport Marina property. The property is a 44-acre tract of land owned by the North Carolina State Ports Authority and leased to Southport Marina, Inc. The existing marina is a full service facility consisting of approximately 200 wet slips, 220 dry storage racks with fork lift haul out and a 75-ton open hoist travel lift. The facility also includes a boat ramp, shower and laundry facilities, pump out station, a full service boat yard and fuel. The existing facility consists of the following six main docking structures: a commercial dock located just to the east of the boat ramp; A, B and C-Docks, which are located just to the west of the boat ramp consisting of condemned concrete piers with floating docks and finger piers along each side (The end of C-Dock also includes an existing covered dock house and fueling docks); D-Dock, which is located just west of the existing lift well consisting of a concrete roofed, concrete pier and associated floating docks; and E-Dock, which consists of long "U" shaped floating dock with associated finger piers located at the far western end of the basin. The property is bordered by Cottage Creek to the west, the AIWW to the south and the Southport Yacht Basin to the east. The marina facility pre-dates the Coastal Area Management Act, however, the facility has been issued State Permits for maintenance excavation of the marina basin and modifications / additions to the docking structures. (See State Permits 5-75, 138-87, 32-95 and 99- 01) The most recent permit (99-01) authorized the maintenance excavation of the existing basin to a depth of -6 feet at MLW, the addition of floating docks at the end of A, B and C-Docks. Modifications to State Permit 99-01 on November 17, 2003, authorized the construction of additional floating docks along each side of the abandoned concrete walkway at D-Dock. Modifications on April 17, 2006 authorized the maintenance of the boat basin, the construction of a 12' wide by 612' long boardwalk along the marina basin, the construction of two piers and associated finger piers (new D-Dock and E-Dock), and the removal of the existing finger piers on the current C-Dock and the removal of the existing D-Dock. Work under the latest modification is currently underway. A CAMA General Permit (No. 44036) was issued on May 1, 2006 for the replacement of the existing boat ramp dock. The waters of the AIWW in this location are classified as "SC" by the North Carolina Division of Water Quality and are included in the Southport Restricted Area. The area is not designated as a Primary Nursery Area by the North Carolina Division of Marine Fisheries and is closed to the harvest of shellfish. PROPOSED PROJECT Southport Marina, Inc. is currently proposing to continue the renovations of the Southport Marina by the replacement and reconfiguration of the existing fixed and floating docks, filling of the existing lift well, construction of a new fork lift pad, the construction and extension of a new commercial dock and the construction of a new elevated boardwalk. I Southport Marina, Inc. • June 8, 2006 Page 3 The existing dock configuration, as counted by the applicant, includes approximately 228 docking spaces or slips. Some of the existing docks, including the commercial dock, transient dock, travel lift dock, the "T" docks at the ends of A, B, C, and D-Docks, the docks connecting A, B and C-Docks and the fork lift launch well are side to or parallel type dockage. It is unclear, after review of past permit files, how exact slip numbers were measured. Under the last modification the applicant indicated that the proposed addition of seven slips would bring the total number of slips to 179. Under the existing slip count by the applicant (Sheet 7of 9), parallel dockage is measured at varying lengths from 25 feet to 60 feet. It appears that most of this parallel dockage was not accounted for in the original slip count of 179. Under the current reconfiguration proposal, the total slip number would increase to 251. The following is a description of the proposed dock changes: • Replacement of the existing D-Dock with D and E-Docks. Removal of the existing finger piers on the existing C-Dock and the removal of the transient dock immediately adjacent to the C-Dock. (Authorized under April 17, 2006 Modification) • Addition of seven new finger piers to the new D-Dock. Total slips at D and E-Docks would be 60, including (12) twenty-five linear feet each parallel slips on the west side of E-Dock. • The conversion of the existing E-Dock into F, G, H and I-Docks consisting of 62 slips, including (2) sixty linear feet each parallel slips adjacent to the travel-lift launch well. • The replacement of A, B, and C-Docks. A-Dock would consist of 31 slips. B-Dock would consist of 29 slips. C-Dock would consist of 47 slips, including (17) forty linear feet each parallel slips at the new transient / fuel dock. The transient dock would be located at the end of C-Dock and would consist of a floating "T" measuring approximately 12 feet in width by approximately 368 feet in length. The transient dock would also include a new enclosed dock house / office building which would replace the existing dock house located on the existing C-Dock. The dock house would measure approximately 28 feet wide by 40 feet long, including the roof overhang. Emergency fuel cut-off valves, fire extinguishers and other safety equipment would be located at the dock office. Pump-out services would also be provided on the transient dock. • The extension of the existing 200 feet long conunercial dock located at the east side of the basin. The extension would measure approximately 448 feet in length and 8 feet in width and would be configured in an "L" shape with the "L" extending in front of A-Dock. The new conunercial dock would include (22) thirty-five linear feet each parallel slips. Using the applicant's current estimate of 228 slips this proposal would represent a 10% expansion in slip numbers. The existing forklift lift well located between C-Dock and D-Dock would be filled and a new forklift pad would be constructed adjacent to the existing travel lift area. The existing lift well is approximately 73 feet long by approximately 19 feet wide. Existing water depths within the lift well average approximately -3 feet at MLW. A concrete bulkhead measuring approximately 19 feet in length would be constructed across the entrance to the existing lift well and the lift well would be filled with approximately 200 cubic yards of clean sand. The 12 wide pedestrian board walk would be extended across the filled area to allow access to the new D and E-Docks. Southport Marina, Inc. June 8, 2006 Page 4 The new forklift area would be located just east of and adjacent to the existing travel lift area. The new forklift pad would consist of a 50 feet wide concrete platform with a supporting bulkhead extending to the dredged basin limits. The pad would extend approximately 15-22 feet water ward of the existing shoreline and approximately 20 landward of the existing shoreline to adjoin with the existing concrete travel lift pad. The area behind the supporting bulkhead and under the new lift pad would be backfilled to grade. An eight feet wide by 36 feet in length floating dock would be installed on the west side of the new fork lift drop zone to be used for temporary tie-up of boats during launching and retrieval operations. 10. ANTICIPATED IMPACTS: The filling of the existing lift well and the construction of the new forklift pad area would result in the filling of approximately 2,512 sq. ft. of shallow bottom area within the boat basin, the disturbance of approximately 1,000 sq. ft. of high ground and the creation of approximately 2,000 sq. ft. of new impervious area. The new docking facility and associated slips would result in the usurpation of approximately 200,000 sq. ft. of estuarine waters and public trust area within the existing boat basin. (It is estimated that the current marina design usurps approximately 120,000 sq. ft.) Of this area, approximately 57,000 sq. ft. would be incorporated and shaded by the proposed docks, finger piers, walkways and dock office structures. Submitted by: Min Gregson Date: June 8, 2006 Office: Wilmington Narrative Description Maintenance and Upgrading of Southport Marina The current lease holders of Southport Marina, Southport Marina Inc., propose a major modification of CAMA Major Permit Number 99-01 for the renovation and maintenance of The Southport Marina. Maintenance and renovation is to include replacement and reconfiguration of the existing fixed and floating docks, filling the existing liftwell, construction of a concrete pad for forklift, boat launch and retrieval, and replacement and extension of a commercial dock with the addition of an elevated boardwalk for access to that dock. Floating Docks The proposed floating docks will replace and reconfigure the bulk of the current floating and fixed docks, with an addition of 23 floating dock slips. In addition to the floating docks presently at the marina, three condemned concrete piers extend out into the basin (A, B and C docks). The marina dock house and fuel pumps are located at the end of C dock. D dock features a large concrete roofed structure. All of the existing concrete piers will be removed along with the concrete roof over D dock. The new floating dock system will feature a dock house and fuel service to maintain this function for marina patrons. The dock house location will maintain the level of fueling safety and supervision along coordination of transient boat traffic. Emergency cut-off valves, fire extinguishers and other safety equipment will be located at the dock office for use by trained marina personnel. Holding tank pumpout service will also be provided on the transient dock. Liftwell The current liftwell for forklift removal of boats is located between C and D dock in the direct vicinity of a major public area of the marina. For safety and accessibility it is proposed to locate the new forklift retrieval area next to where the travel lift is currently located, away from the major pedestrian traffic area of the marina. The move will involve two aspects of this proposal; construction of a concrete pad to create a forklift and retrieval area and the filling in of the existing lift-well. The existing liftwell is approximately 73' long 19' wide and 12' deep with approximately 3-4' below MLW. A concrete bulkhead will close off the entrance along the main marina bulkhead. An estimated 200 yds3 of clean sand will be required for the fill. The platform will extend back on to land to adjoin the existing concrete pad. A 36' 6" by 8' floating dock is also proposed to be attached to the forklift and retrieval area via 3' by 20' ramp for temporary tie-up of boats during launch and retrieval operations. Dock Extension and Boardwalk Construction The east end of the marina presently has approximately 200' of commercial floating dock with no finger docks. It is proposed to replace the existing floating dock and extend its overall length to 628'. To improve the accessibility of the dock a 6' wide elevated boardwalk is proposed to run from the main boat ramp area to the existing landward end of the floating dock. W&H X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Southport Marina, Inc., 100 Weston Estates Way, Cary, NC 27513 Authorizing development in Brunswick County at marina basin off AIWW, Southport Marina, 606 W. West St., Southport as requested in the permittee's application dated 4/13/06 (MP-I & MP-2). 6/5/06 (MP-4) & 5/31/06 (MP-6) including att'd workplan drawings (9), as referenced in Condition No. 1 of this permit. This permit, issued on St )temlier 20, 2000 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, all development shall be carried out in accordance with the attached workplan drawings (9), 1 dated revised 6/5/06, 1 dated revised 6/6/06, 2 dated 5/18/06, l dated 2/10/06, 1 dated 5/31/06, 1 dated revised 10/31/05, and 2 dated received 6/13/06. Forklift Pad 2) The forklift pad shall be no greater in size than the 22.5' L X 50' W as specified in the permit application dated 4/13/06 and the work plan drawing labeled 4 of 9 and dated revised 6/5/06. (See attached sheets for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Southport Marina, Inc. ADDITIONAL CONDITIONS Shoreline Stabilization and Lift Well rill 3) The bulkhead shall be constructed prior to any backfilling activities. Permit # 99-01 Page 2 of 4 4) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 5) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. 6) The bulkheads shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by Department personnel. 7) No backfill material shall be placed within 30 feet of the normal high water level, except that which will be used to backfill the area behind the permitted bulkhead. 8) The fill material shall be clean and free of any pollutants except in trace quantities. Docking Facility 9) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal facility shall be installed and operable, and maintained for the life of the marina. 10) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on-site with a representative of the Division to ensure that the required pumpout facility is in place and operable. 11) The marina shall display a sign showing the location of the on-site pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier(s). 12) All material resulting from the removal of the existing piers shall be placed on an approved upland disposal site. 13) This permit authorizes only the docks, piers, and other strictures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other stricture, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of strictures shall be conducted on, in or over public trust waters without permit modification. 14) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 15) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. Southport Marina, Inc. ADDITIONAL CONDITIONS Permit # 99-01 Page 3 of 4 16) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 17) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 18) This permit authorizes a maximum of 251 boat slips. Dockliouse 19) In accordance with 15A NCAC 07J .0211, the enclosed area of the new dock house shall not exceed the enclosed area of the existing dock house that is to be demolished. In order to ensure compliance with this condition, prior to the initiation of construction of the new dock house the permittee shall submit for Division approval a new design drawing that shows the modified dimensions of the new dock house. 20) The roof of the deckhouse shall not be designed for second story use. General 21) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 22) No vegetated wetlands shall be excavated or filled, even temporarily, without permit modification. 23) This major modification shall be attached to the original of Permit No. 99-01, which was issued on 8/13/01, as well as the minor modifications issued 11/17/03 and 4/17/06, and the renewal issued 10/28/05, and copies of all documents shall be readily available on site when Division personnel inspect the project for compliance. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to a North Carolina Department of Transportation permit. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. Southport Marina, Inc.
