This permit, issued on Remember 29, 2(1106 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Shoreline Stabilization
1) The alignment of the permitted bulkhead shall be staked by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of any construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.
2) The bulkhead shall not extend waterward more than an average of 5 feet from the normal water level at
the time of construction.
3) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on

5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation is permitted except for that which
may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does
not authorize any excavation waterward of the approved alignment.
6) The fill material shall be clean and free of any pollutants except in trace quantities.
7) All backfill material shall be obtained from a high ground source'and confined behind the permitted
bulkhead.
8) No backfill material shall be placed within 30 feet of the normal water line, except that which shall be
used to backfill the area behind the permitted bulkhead.
9) . All fill material to be placed below the normal water level shall be confined behind the permitted
bulkhead.
Sedimentation and Erosion Control
NOTE: The N.C. Division of Land Resources approved this project under Project ID No. Curri-2006-024
on 5/31/06. Any violation of the permit approved by the Division of Land Resources will be
considered a violation of this CAMA permit.
10) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
11) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
Stormwater Management
12) The N.C. Division of Water Quality approved this project under stormwater management rules of the
Environmental Management Commission under Stormwater Permit No. SW7060509 on 6/15/06. Any
violation of the permit approved by the DWQ will be considered a violation of this CAMA permit.
Upland Development
13) This permit authorizes only the land disturbing activities associated with the development of the Cooper
Landing Subdivision, including the construction of the associated asphalt road, and the 24" drainage
culvert, all as expressly and specifically set forth in the permit application and depicted on the attached
workplan drawings as referenced above. Any additional land disturbing activities and/or construction
may require a modification of this permit.

14) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over public trust
waters without permit modification.
15) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
16) The-permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
17) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
18) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
19) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are
permitted. Lattice is specifically excluded from being used under this authorization.
20) The roof of the gazebo shall not be designed for second story use.
21) - No sewage, whether treated or untreated, shall be discharged at anytime from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.

23) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
24) No vegetated wetlands or open water areas shall be excavated or filled,_ even temporarily, without permit
modification.
25) Should Lot 3 or Lot 18 be sold prior to the initiation of construction, the permittee shall be required to
obtain a signed riparian corridor waiver from the new property owner. prior to the placement of any
structures within the 15-foot riparian corridor.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to
project initiation.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3400 (DWQ Project No. 061023), which was issued on 7/6/06.

Approval of 401 Water Quality Certification (GC3400) with Additional Conditions
Dear Mr. Cooper:
You have our approval, in accordance with the attached conditions, to shade 0.0225 acres of shallow
water, and fill 0.1536 acres of shallow water construct the proposed bulkhead, community pier, platform
- 2 slips and installation of a culvert, as described in your application dated May 22, 2006, and received
by the Division of Water Quality (DWQ) 401 Oversight/Express Review Permitting Unit on June 23,
2006. After reviewing your application, we have determined that the Division of Water Quality (DWQ)
General Water Quality Certification Number 3400 covers these water impacts. This Certification allows
you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In
addition, you should get or otherwise comply with any other federal, state and local requirements before
you go ahead with your project including (but not limited to) erosion and sediment control regulations
and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to
waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in I SA
NCAC 21-1.0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3400.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.

Project Setting
The project site is a 25.12-acre tract located on both sides of Narrow Shore Road (SR 1137)
approximately 1.3 miles north of the Aydlett Post Office, in Currituck County and on the
Currituck Sound.
The property is undeveloped and has ±18.09 acres of uplands located in the eastern portion
and adjacent to the Currituck Sound. The property has an elevation of ±15 feet above normal
water level (NWL), has sandy soils and is vegetated with pine, wild grape, honey suckle, cat
briar, wild cherry andiron wood. Approximately 7.03 acres of the property is a forested 404
wetlands area located in the western portion. No development is proposed for this area.
The property has approximately 515 feet of shoreline along the Currituck Sound. The shoreline
has experienced significant erosion over time and there is an existing ±15 feet high erosion
escarpment along the shoreline. The shoreline is approximately 60 feet landward of an existing
bulkhead on the adjacent property to the north and approximately 25 feet landward of an
existing bulkhead on the adjacent property to the south. Narrow Shore Road (SR 1137) runs
parallel to the shoreline and is located approximately 30 feet landward of NWL. A relic pier and
platform are located in Currituck Sound along the southern near shore area.
The upland area located on the west side of Narrow Shore Road has been selectively cleared
for a proposed road right.of way and for the creation of 18 subdivided single-family building
lots.
The adjacent riparian properties are tracts that have single-family dwellings and both have piers
and the described shoreline bulkheads.
The waters of Currituck Sound are classified as SC and as closed to shellfish taking.
Development Proposal
In order to protect the shoreline from further erosion, the applicant proposes to construct a 515-
foot long bulkhead a maximum distance of 21 feet waterward of NWL with an average distance
of 13 feet waterward of NWL. The existing erosion escarpment will be graded to slope from
Narrow Shore Road to the proposed bulkhead. The proposed grade will have a 4:1 slope and
the material that is removed from the bank will be used for backfill of the proposed bulkhead.
In order to provide water access for the planned subdivision, the applicant proposed to
construct in the Currituck Sound a 6-foot wide and 100-foot long pier with a 12-foot by 12-foot
gazebo at the end. The applicant proposes to install four mooring pilings to create two 10-foot
by 12-foot slips.
Other development activities associated with the subdivision include the installation of an 18-
inch corrugated metal culvert under Narrow Shore Road and through the proposed bulkhead to
allow drainage from a proposed ditch system for the planned subdivision to drain stormwater
overboard.

A 20-foot wide paved access road will connect Narrow Shore Road to interior lots.
Approximately 24,000 square feet of uplands will be covered with impervious asphalt by this
road.
The NC Division of Land Resources, Land Quality Section has approved an Erosion and
Sedimentation Control Plan, No. Curr-2006-024, for the subdivision for 18 acres of land
disturbance.
Anticipated Impacts
The construction of the proposed bulkhead will result in 6,695 square feet of Public Trust Area
(PTA) and Estuarine Waters (EW) Areas of Environmental Concern (AECs) being filled.
Approximately 185 cubic yards of backfill material will be placed below NWL. Approximately
14,383 square feet of Estuarine Shoreline (ES) AEC will be sloped and graded from Narrow
Shore Road to the proposed bulkhead.
The installation of the proposed drainage culvert will result in further disturbance of
approximately 420 square feet of ES AEC.
Approximately 4,867 square feet of ES AEC will be disturbed by ditch construction.
The proposed access road will result in approximately 978 square feet of impervious surface
within the ES AEC resulting in approximately 22% total coverage (including Narrow Shore Road
pavement) within the ES AEC. Approximately 23,022 square feet of upland area will be
covered with impervious surface by the proposed access road.
The proposed pier will shade 744 square feet of PTA, EW AECs and the two slips will occupy
240 square feet of PTA, ES AECs.
Temporary water turbidity will occur during construction. Surface runoff from Narrow Shore
Road will increase by the removal of the existing bank and the proposed shoreline grading and
sloping.

The property owner is proposing to protect the eroding shoreline with shoreline stabilization and
make improvements to the property to access the Currituck Sound for traditional recreational
boating. The project site is a proposed 18 Lot subdivision "Cooper Landing" located off (east
and west) of Narrow Shore Road (SR1137). Size of subject tract is 25.12 acres consisting of
18.09 acres of mature forested land and 7.03 acres of forested Section 404 wetlands. Currently
there are no manmade improvements on this property, excluding the NCDOT Narrow Shore Road
(SR 1137). The eastein portion of this site.is intersected by Narrow Shore Road (SR 1137), with
a small portion of the subject property remaining on the east side of Narrow Shore Road, adjacent
to the Currituck Sound. According to Mr. Cooper, prior hurricanes (ie. Isabell) along with strong
northeast storms have eroded the shoreline approximately five feet in the past year. The
succession of erosion over the years has placed the existing road (Narrow Shore Road (SR 1137))
in jeopardy. The adjacent property owners have existing bulkhead along their shoreline, which
has created accelerated erosion problems within the 515' of the applicants exposed shoreline.
High energy waves are funneled into this 515' area of exposed shoreline creating the accelerated
erosion problems. To minimize or eliminate future erosion to his 515' of shoreline, Mr. Cooper
proposes the construction of a 515 foot bulkhead, point to point to adjoin with adjacent existing
bulkheads to eliminate a weak portion of the shoreline. Mr. Cooper proposes to grade the
existing highground, cast of Narrow Shore Road, towards the proposed bulkhead at a 4:1 slope
and use excavated highground soil from the grading for the proposed bulkhead backfill. If
additional backfill is needed, upland commercial source will be trucked in from off site. Mr.
Cooper is also proposing within the Cooper Landing Community Access Area. (0.03 acre parcel)
a six foot wide 100' pier with a 144 s.f. gazebo and two boat slips with four mooring pilings and
boat lifts (2). The Community Access Area is located cast of the proposed Overton Lane adjacent
to Narrow Shore Road (SR 1137). Mr. Cooper is proposing to saw-cut the existing Narrow Shore
Road to install a drainage culvert (24" HDPE pipe) and make repairs to the existing asphalt road
after installation. This work is included in the disturbance within the 75' AEC.
Wetland impacts are not proposed for this project. Coastal wetlands do not exist within the
project area or adjacent to the projecr area. AEC flagged the existing Section 404 wetlands on the
western portion of the subject property and received a signed wetland plat from Tom Steffens,
U.S. Army Corp of Engineers on. 2-17-06 (Action ID#200610501).
Mr. Cooper met with Frank Jennings; N.C. Division of Coastal Management on site on April 3,
2006 for a pre-application meetins.
Watc,~r depths were taken by AEC staff, on May 12, 2006. Water depth at the end of the proposed
pier is -3.6 feet. During the time of sampling, AEC staff did not identify SAV's within or outside
the project area. Water depths taken by AEC on May 12, 2006 indicated a consistent water depth
pattern with no deep pockets. Water depths were taken in 100 foot transects, 30 feet apart (see
attached cross sections A & B).

The proposed pier (6'x 100' = 600 s.f.), gazebo (12'x 12'- 144 s.f.), mooring pilings (four
in pilings -12 inch dia.), and bulkhead (515' in length) will be constructed using hydraulic
pumps and hand tools. Wetlands wilt not be crossed during construction of proposed project.
Existing shoreline has a distinct drop off, therefore, wetlands do not exist, The proposed pier will
be 322' from the north riparian property line and 184' from the south riparian property line. The
distance to the adjacent shoreline is four miles or greater.
Proposed bulkhead (515') alignment is a minimums of 2' waterward of NWL an average of 13'
waterward of NWL and a maximum of 21 feet %vaterward of NWL,

EROSION CONTROL METHODS: Once the eastern portion of the subject site is graded to a
4:1 slope, the site will be seeded with heat and drought tolerant grass seed for erosion purposes.
Silt fence will be placed along the interface of disturbance and filter cloth will be placed behind
the proposed bulkhead before backfill is in place.
The proposed project will provide shoreline stabilization within an area of high erosion due to
existing adjacent bulkheads and continued storm events. Shoreline stabilization will also
eliminate future threat of erosion to existing Narrow Shore Road (SR 11.37). The proposed
project will also allow the future property owners of Cooper Landing an access to the Currituck
Sound for recreational boating.
