PROJECT SUMMARY: The applicant is proposing the construction of a 17-lot subdivision, including a pedestrian boardwalk, 4-slip community docking facility, retaining wall, rip-rap, driveways and utilities. Laguna Bay, LLC Page Two 9. PROJECT DESCRIPTION: The proposed Laguna Bay Subdivision is located off Washington Street, adjacent to the New River, in Jacksonville, Onslow County. To get to the proposed subdivision from Wilmington, head north on US Hwy 17 to Jacksonville. Turn right onto Broadhurst Road and continue approximately one mile. Turn left onto Washington Street and the property will be located on the left hand side of the road. The subject property is currently undeveloped, however the property has been graded and most of the understory vegetation has been mowed/cleared. Elevation at the tract averages from 2' to 12' above MSL. The property consists of approximately 9.21 acres. The highground portion of the tract has vegetation that consists of Live Oak (Quercus virginiana), Long-leaf Pine (Pinus palustris), Hickory (Carya sp.) and Maple (Ater rubrum). Wax Myrtle (Myrica cerifera), Yaupon (ilex vomitoria) and Grounsel-bush (Baccharus halimifolia) complete the transition to the upper limits of the "404 type" wetlands. Coastal Wetlands species such as Cattail (Typha spp) and Sawgrass (Cladium jamaicense) exists along the northern and eastern shoreline. The coastal and "404 type" wetlands have been delineated, and in several locations they are indicated as a "joint" line on the survey map. The waters of the New River, adjacent to the proposed project area, are classified as "SC" by the Division of Water Quality. This section of New River is designated as a Primary Nursery Area by the Division of Marine Fisheries. According to maps provided by Shellfish Sanitation, the area is CLOSED to the harvesting of shellfish. A 45' utility and access easement runs along the center line of the proposed Laguna bay Drive and continues through the peninsula (labeled as Lot 18 on the workplan drawings). The City of Jacksonville has historically used and maintained this easement for sanitary water and sewer. Utilities in this area are currently serving residents along the southern portions of Jacksonville. PROPOSED PROJECT: The applicant is proposing to construct of a 17-lot subdivision to include: a pedestrian boardwalk, 4-slip community docking facility, bulkhead, rip-rap, driveways and utilities. As proposed, development would include the installation of a driveway/access road that would begin at the entrance of the property, along Washington Street. The driveway (Laguna Bay Drive) would continue east and bear south at the turn around cul-de-sac, ultimately terminating in another cul-de-sac located between Lot 12 and Lot 13. The applicant has indicated that the future property/lot owners would be applying for individual CAMA Minor Permits to construct the privately owned driveways and residential structures associated with the subdivision. In addition to the upland development, the applicant is proposing to construct a retaining wall, boardwalk and community pier for the residents of the subdivision. Additionally, the applicant is proposing to install a narrow section of rip-rap between Lot 5 and Lot 18. The retaining wall, as proposed, would be located on the high ground portion of the property landward of the Section "404" Wetlands line. The retaining wall would run parallel to the shoreline, just landward of the Section 404 Wetland line, and would be approximately 1,350 feet in length. The retaining wall would only be installed from the northeast corner of Lot 5 to the southeast corner of Lot 12. Because the City of Jacksonville maintains an easement through a portion of Lot 18, the applicant has proposed to install a 10' x 60' section of rip-rap, instead of a retaining wall. The rip-rap would also be located landward of the Section "404" Wetlands line. The lots bordering New River on the northern side of the property exhibit a relatively high elevation and do not require shoreline protection. Laguna Bay, LLC Page Three The proposed community pier (which would provide dockage for up to four vessels) would be located on Lot 18, between Lots 5 and 6. Access to the pier would be provided by a 6' wide by 430' long wooden walkway that would extend east from the cul-de-sac, towards the New River. The pier (6' x 70') would begin at the terminal end of the walkway span in a northerly direction, into the New River. A12' x 60' T- head would be located at the terminal end of the pier. The platform would provide access to the five (3' x 25') elevated and fixed finger piers. Four, 12' x 13' boat-lifts would be installed between each of the finger piers. Water depths in the vicinity of the proposed boat-lifts range from -8.0' to -10.0' relative to Mean Low Water. 10. ANTICIPATED IMPACTS The construction of the proposed access road, and grading of the property, would result in the disturbance of approximately 362,419 sq ft (8.32 acres) of high ground. The proposed pier and docking facility would incorporate approximately 1,485 sq ft of estuarine waters and public trust area. The area of disturbance resulting from the construction of the retaining wall and rip-rap would be incorporated as part of the subdivision preparation area. These two areas overlap, and as such, no calculations were included for retaining wall/rip-rap disturbance. Total impervious surface coverage within the 75' Estuarine Shoreline AEC would be 0.0%. The applicant has applied for a State Stormwater Permit with the Division of Water Quality (Permit No.SW8060344), however a permit has not yet been issued.
