The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is unable
accept the permit conditions associated with the compensatory mitigation for above referenced project. NCEEP will not
provide mitigation south of the Albemarle Sound as specified in the 404 permit (Action ID: 2006-32369-128, special
condition `p'). As stated in our acceptance letter dated November 7, 2006, NCEEP is willing to accept payment for impacts
up to 1.5 acres of non-riparian wetlands associated with the project in accordance with the Memorandum of Understanding
between the N. C. Department of Environment and Natural Resources and the U. S. Army Corps of Engineers dated
November 4, 1998. The mitigation will take place in the Pasquotank river basin in cataloging unit 03010205.
Please contact the USACE to request modification to the permit conditions. If you have any questions or need additional

Reference your application for a Department of the Army permit to install a 28x 28' boat
basin, 234 linear feet of vinyl bulkhead, a Y x 28' walkway, and a Y x 25' finger pier at 172
Singleton St. (off Chadwick Acres Rd) adjacent to a man-made canal in Sneads Ferry, Onslow
County, NC as described in the CAMA application dated March 7, 2006 and received by this
office on May 18, 2006. The proposed 28' x28' boat basin will be excavated out of high ground
to a depth of -4.0 ft relative to NLW to be consistent with the existing depths of the adjacent
canal. The excavated material will be dewatered onsite and used for backfill for the bulkhead and
for grading and seeding an onsite area located above NHW.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of general permit No. 198000291 (enclosed). Therefore, you may commence
construction activity in strict accordance with applicable State authorization, the approved plan
(enclosed), and the special conditions (enclosed). Failure to comply with the State authorization
or conditions of the general permit could result in civil and/or administrative penalties.

accomplishing the authorized work, he will immediately notify the Wilmington District Engineer
who will initiate the required coordination procedures.
2. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work
authorized by this permit and again upon completion of the work authorized by this permit.
3. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10
of the Rivers and Harbors Act must be reported-in writing to the Wilmington District_U.S. Army
Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Reference the application of John Deel for a Department of the Army permit to install a 28'

The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
3. United States. No claim shall be made against the United States on account of any
such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN

20910-3282 at least two weeks prior to beginning work and upon completion of work.
4. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land-clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
5. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
6. Unless otherwise authorized by this permit, all fill material placed in waters or
wetlands shall be generated from an upland source and will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
7. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
8. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
9. An earthen plug will be left between the inland canal/basin and the adjacent canal
until all excavation activities landward of the plug has been completed. In order to prevent
sedimentation in adjacent waters, 24 hours will be allowed to elapse before the plug is removed.
10. All excavated materials will be confined landward of the mean high water level
elevation contour and any vegetated wetlands.
11. All excavated materials will be confined landward of the mean high water level
elevation contour within adequate dikes or other retaining structures to prevent spillover of
dredged materials into any vegetated wetlands or surrounding waters.

12. If the permittee discovers any previously unknown historic or archeological remains

13. Approval of the structure was based on determinations that there would be no
obstruction to navigation. Under conditions existing in the Atlantic Intracoastal Waterway
(AI`M, a possibility exists that the structure may be damaged by wave wash from passing
vessels. Unreasonable slowing down of vessel traffic cannot be required because it would tend to
nullify the navigational benefits on which the AIWW was justified. Issuance of this permit
should not be construed, as relieving the permittee of taking proper steps to insure the structure
and moored boats will not be damaged by wave wash normally to be expected in the AIWW.
14. The permittee shall advise the Corps in writing at least two weeks prior to beginning
the work authorized by this permit and again upon completion of the work authorized by this
permit.
15. The permittee shall require its contractors and/or agents to comply with the terms
and conditions of this permit in the construction and maintenance of this project, and shall
provide each of its contractors and/or agents associated with the construction or maintenance of
this project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
16. The permittee shall employ all sedimentation and erosion control measures
necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside
the permit area. This shall include, but is not limited to, the immediate installation of silt fencing
or similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must
remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973
(North Carolina General Statutes Chapter 113A Article 4).
17. The activity will be conducted in such a manner as to prevent a significant increase
in turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
18. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct, restore
the water or wetland to its pre-project condition.
19. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

This permit, issued on August 2, 2006 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.

1) Excavation shall.not exceed -4 feet below the normal low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
2) No vegetated wetlands shall be excavated or filled, even temporarily, without permit modification.
3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
4) No excavation shall take place outside of the area indicated on the attached workplan drawings.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2009
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

5) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
6) No spoil material shall be placed within 30 feet of the normal high water line, except that which will be
used to backfill the area behind the bulkhead.
7) Any change in the location of the spoil disposal area shall be approved by a representative of the
Division of Coastal Management prior to the initiation of any excavation activities.
Sedimentation and Erosion Control
8) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
9) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
Shoreline Stabilization
10) The bulkhead shall be constructed prior to any backfilling activities.
11) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
12) A silt fence shall be properly installed immediately landward of the bulkhead cap immediately following
completion of backfilling activities and shall remain until the area has become vegetated and stable.
Y 13) The bulkheads shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by Department personnel.
14) No backfill material shall be placed within 30 feet of the normal high water level, except that which will
be used to backfill the area behind the permitted bulkhead.
15) The fill material shall be clean and free of any pollutants except in trace quantities.
Docking Facility
16) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.

17) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification.
18) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
19) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
20) This permit authorizes a maximum of two (2) boat slips.
21) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.
General
22) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No.

23) This project site is located in an area having a high probability of containing cultural resources. If any
cultural materials are exposed during construction activities, the permittee shall immediately notify the
Office of State Archaeology at 507 N. Blount Street, Raleigh, NC, (919) 733-4763.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required including but not limited to a Stormwater.
Permit from the Division of Water Quality if required.
NOTE: Future development of the permittee's property, including the construction of a single family
residence, may require a modification of this permit. Contact a representative of the Division of
Coastal Management at (910) 796-7215 prior to the commencement of any such activity for this
determination. The permittee is further advised that many non-water dependent activities are not
authorized within 30 feet of the normal high water level.

The Wilmington Regional Office received your application for a CAMA Major Permit from the Division
of Coastal Management on May 17, 2006. The wetland impacts proposed are for the purpose of
constructing a boat basin, bulkhead, walkway and finger pier for single-family residence. You are
authorized to proceed with your project as proposed under General Water Quality Certification (WQC) #
3490 (enclosed). This Certification can also be found on line at:
http://h2o.enr.state.nc.us/ncwetlands/certs.html. This Certification allows you to use the CAMA Major
Permit when the Division of Coastal Management issues it. Written concurrence from the Division of
Water Quality (DWQ) is not required provided that you can meet all of the conditions of the General
Water Quality Certification.
If at anytime during construction of your project you determine that you cannot meet these conditions or
if there are any additional impacts to wetlands or water quality not described in your application, you
must contact this office immediately.

9. PROJECT DESCRIPTION:
The project site is located at 452 Chadwick Acres Rd (lots 26 &27), adjacent to a man-made canal which is a
tributary to Stump Sound, in Sneads Ferry, Onslow County. To get to the site from Wilmington take US HWY
17 N to Old Folkstone Rd, which is located approximately 4 miles north of Holly Ridge. Turn right onto Old
Folkstone Rd. and continue to Chadwick Acres Rd., there is a power sub-station at the intersection, take a right
and 452 Chadwick Acres Rd. is located about 1.5 miles on the right. The property is adjacent to Chadwick
Acres Rd. on the west side, a man-made canal on the east side and two residential lots on the north and south.
There is currently a house under construction on the site. The current elevation of the property is approximately
5' above mean sea level (MSL) and the lots are approximately 14,000 ft.' each. The highground portion of the
property is vegetated primarily with lawn grasses and shrubs. There are a few Red Cedars (Juniperus
virginiana) located near the waters edge. There is a 1' - 2' drop off to normal low water at the water's edge.
There are no coastal wetlands located on the site. The canal is approximately 50' wide at this location and is
approximately -4' deep at normal low water (NLW) at the center of the canal.
The Onslow County Land Use Plan classifies the upland areas of this project as Rural. The waters of the project
site are classified as SA by the NC Division of Water Quality. The NC Division of Marine Fisheries has
designated this area of Stump Sound as a Primary Nursery Area, and the waters adjacent to the proposed
project are open to the harvesting of shellfish.
PROPOSED PROJECT:
The applicant is proposing to excavate a 28' x 28' boat basin out of highground. The proposed boat basin would
be located in the center of the property on the western side of the project site. The proposed final depth of the
basin would be --4' @ NLW, to snatch the existing depth at the center of the adjacent canal. The applicant states
that the proposed boat basin would result in the removal of approximately 218 cubic yards of material. The
writer of this report has calculated the estimated dredged material would be approximately 232 cubic yards. The
applicant is proposing a disposal area onsite that would measure approximately 6000 ft.', constructed of silt
fencing and located a minimum of 30' from the landward edge of the proposed basin. This area will be used to
dewater all the dredged material. Once the material has been dewatered the applicant is proposing to use the
material onsite for grading and has indicated that it would be contained until the area has been seeded and
stabilized. The applicant is also proposing to install approximately 234 linear feet of vinyl bulkhead along the
existing shoreline and along the new basin shoreline on the southwestern side of the site. The applicant is
proposing a 3' x 28' walkway that would be located over the water on the eastern side of the proposed boat
basin for access to the water. The walkway would run parallel to the eastern edge of the proposed boat basin.
Also proposed is the installation of a 3' x 25' finger pier to divide the boat basin into two slips.

10. ANTICIPATED IMPACTS
The proposed boat basin would result in the excavation of approximately 900 ft.' of shallow bottom area within
the existing canal and approximately 648 ft.' of highground. The disposal area would disturb approximately
6,000 ft.2 of highground area during the dewatering process. Of the total 232 cubic yards to be excavated, 181
cubic yards would be from highground and the remaining 51 cubic yards would be excavated from the canal.
The installation of 234 linear feet of bulkhead would result in the disturbance of approximately 4,680 ft.2 of
highground for the installation of the tie-backs and dead-men anchor system and backfill. The proposed
walkway and finger pier would incorporate 159 ft.2 of Estuarine Waters and Public Trust Area within the newly
created basin.

only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the
