Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the subject
application for impacts to wildlife and fishery resources. A site visit was conducted on May 4, 2006. Our
comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat.
401, as amended; 16 U.S.C. 661 et. seq.), and Sections 401 and 404 of the Clean Water Act (as amended).
The project is located south of NC 211, between Long Beach Rd. and Arbor Creek Dr., approximately 1 mile
west of the intersection of Long Beach Rd. and NC 211. The property consists of approximately 64.3 acres
including approximately 36.9 acres of wetlands. Jump and Run Creek, a tributary to Dutchman's Creek and
ultimately the AIWW, bisects the property. The stream is designated as a perennial stream on the NC Natural
Heritage Program (NHP) GIS map. Waters in this stream are classified C-Swamp by the Division of Water
Quality. Other on-site wetlands include pine flats, pocosin, and managed pine forest.
The applicants propose to impact approximately 0.50 acre of wetlands through filling/culverting to construct
roads and provide infrastructure for an 84-home community. The applicant proposes to mitigate for wetland
impacts by buy-in to the NC EEP program for 1 acre of non-riparian wetland and 40 linear feet of stream and
the preservation of all remaining wetlands on-site.
We have the following concerns/recommendations:
• During the site visit, an apparently inactive cluster of Red-cockaded Woodpecker (Picoides borealis)
cavity trees was observed near the eastern border of the project site. Although most of the trees were
dead (snags) and therefore unusable for RCWs, one was still alive and appeared to have recent
"scaling" of the bark suggesting that RCWs may utilize the area for foraging. None of the trees had
active resin wells. According to NHP data, the cluster was active or birds were seen there in 1999.

RCWs are listed as Endangered by both the state and federal government. We recommend that a
survey be conducted for RCWs within a half-mile of the project and if they are found, the applicant
coordinate with NCWRC and USFWS biologists to ensure that suitable foraging habitat be
maintained on-site.
We recommend that all RCW cavity trees on-site be protected from removal to allow for potential
reactivation of the cluster by individuals dispersing from surrounding areas.
We recommend a 100 ft native forested buffer is maintained or created on each side of Jump and Run
Creek. Further, stream crossing by bridging is recommended where practicable. Where culverts must
be used, we recommend "bottomless" culverts or culverts imbedded sufficiently to allow for passage
and settlement of aquatic organisms. We recommend utility crossings be accomplished using
directional boring with the bore beginning and ending outside the 100 ft buffers or 100 year flood
plain, whichever is greater.
• We recommend that all remaining and restored wetlands on-site be preserved through permanent
conservation easement, rather than restrictive covenants, to prevent further impacts. This easement
should prohibit any cutting, mowing, or disturbance of vegetation; soil disturbance; or construction of
any kind (including walkways, piers, platforms, etc.) within the wetlands.
A Federal Species of Concern, the Carolina goldenrod (Solidago pulchra) has been observed just to
the south of the property. We recommend that a survey be conducted for this species and appropriate
protection be afforded any populations discovered.
We have no objection to the project provided our recommendations are included as permit conditions. Thank

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;

The 404 wetland line was delineated by Land Management Group Inc. Mr. Tom Farrell of the
U.S. Army Corps of Engineers reviewed the line and then signed the wetland survey on 4/25/05

VI. Proposed Impacts to Waters of the United States/Waters of the State

wetlands, open water, and stream channels associated with the project. The applicant must also

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The applicant has taken jareat care in the site design in order to avoid 404 wetlands and streams.
However, almost half of the site is wetlands and wetland fingers and a stream cross the site. Six
road crossings are needed to gain access to uplands within the site. Wetlands will be crossed at
narrow points. No wetland impact is requested for lot fill.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted

aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
