The proposed wetland and open water impacts in Phase I of the project are for the purpose of constructing a bulkhead. In addition, a parking lot and a gazebo are proposed as part of the Phase I construction. The parking lot has been designed to accommodate vehicles with boat trailers and a future boat ramp (depicted on the site plan). The application states that Phase II of the project will include the construction of the boat ramp and a floating dock, and new dredging of the Intracoastal Waterway, which is open to the taking of shellfish and designated Primary Nursery Area (PNA) by the NC Division of Marine Fisheries. Although Phase I of the project can be constructed under General Water Quality Certification #3490 without written authorization from the Division of Water Quality (DWQ), DWQ objects to the project as proposed. New dredging of a Primary Nursery Area will result in the degradation and/or removal of the existing uses of the waters, classified SA HQW by the DWQ. The NC Division of Marine Fisheries has also stated that they will object to any new dredging in a PNA; therefore, the DWQ Wilmington Regional Office will move towards a recommendation for denial of the 401 Water Quality Certification if dredging is proposed in the future. This office strongly encourages you to redesign the project. Designing the site to accommodate boat trailers and a future boat ramp, which may have no future use if dredging is not allowed, is not a reasonable use of public funds. Specifically, the Town of Oak Island must not anticipate that a 401 Water Quality Certification will be issued for Phase II of the project. PROJECT SUMMARY: The Town of Oak Island proposes to construct a public waterfront park facility. Town of Oak Island / Waterway Park April 11, 2006 Page 2 9. PROJECT DESCRIPTION The project site is located at 1404 East Yacht Drive, between N.E. 14' Street and N.E. 15"' Street, adjacent to the Atlantic Intracoastal Waterway, within the Town of Oak Island, in Brunswick County. To find the property from NC Highway 210 and Long Beach Road (NC Highway 133), take Long Beach Road to the Oak Island High Rise Bridge. Cross the Atlantic Intracoastal Waterway (AIWW) to The Town of Oak Island. Turn Right at the stop light onto East Oak Island Drive and continue to N. E. 14`'' Street. Turn right onto N.E. 14' Street and continue to the AIWW. The project site encompasses the vacant land between N.E. 14' Street and N.E. 15' Street. The property is a 1.38 acre tract of land owned by the Town of Oak Island. The property has approximately 360 linear feet of shoreline frontage along the AIWW and has an average elevation of approximately 10 feet above normal high water (NHW). The site is heavily wooded, with highground vegetation consisting primarily of Loblolly Pine (Pinus taeda), Cat-briar (Smilax bona-nox and Smilax laurifolia), Yaupon Holly (Ilex vomitoria) and Red Cedar (Juniperus virginiana). Along the waters edge Common Reed (Phragmites australis) dominates. Existing structures on the property include two wooden decks and stairs providing access to the estuarine beach area at the street ends of both N.E. 14`' and 15`' Streets, and bulkheads stabilizing the shoreline at the two street ends. The remainder of the shoreline is currently unstabilized and exhibits an erosion escarpment averaging approximately 2.5 to 3 feet in height. The applicant's site plans (Cl and C2) depict a coastal vegetation line along the entire shoreline of the property. This line was flagged by DCM Staff in August 2005. During a site visit on February 17, 2006, it was determined that coastal wetland vegetation was only present at the street ends of N.E. 14`' and N.E. 15' Streets, however, according to the applicant's consultant this line was delineated as a joint 404/Coastal Wetland line. The waters of the AIWW in this location are classified as "SA" by the North Carolina Division of Water Quality. The area is designated as a Primary Nursery Area by the North Carolina Division of Marine Fisheries and is Open to the harvest of shellfish. PROPOSED PROJECT The Town of Oak Island is proposing to construct a public recreation / water access park facility along the AIWW including bulkhead, gravel parking lot, gravel access roads and utilities. The applicant's original application included the construction of a boat ramp, docking facility and dredging. It was determined that the excavation portion of the project would be subject to the requirements of the North Carolina Environmental Policy Act. The applicant has now divided the project into two phases. Phase I consists of highground development and bulkheading. Phase II will consists of the development of the boat ramp, docking facility and dredging. This application is for the Phase I development plans only. (See Site Plan Cl for Phase I / Phase II boundaries) The proposed bulkhead would begin near the eastern right-of-way line of N.E. 14' Street and would follow the erosion escarpment along the northern property boundary for approximately 404 linear feet to a point near the western right-of-way line of N.E. 15' Street. In order to maintain somewhat of a straight line, the bulkhead would be waterward of MHW and the 404/Caoastal Wetland line in several locations. Overall, the bulkhead alignment would average the MHW contour and would be a Town of Oak Island / Waterway Park April 11, 2006 Page 3 maximum of 13 feet waterward of the MHW contour line at the worst escarpment area near the center of the property. The proposed gravel, drives would provide two entrances and exists from the property at the street ends of N.E. 14`' and N.E. 15`' Streets. The access drives would measure approximately 30 feet in width and would widen into a gravel parking lot providing approximately 26 parking spaces, including two handicap spaces. The total built-upon area for the gravel drives and parking area would be 30,517 sq. ft. The applicant is also proposing a gazebo which would be located adjacent to the northwest corner of the parking lot: The gazebo would measure approximately 16 feet in diameter and would be located landward of the 30 foot Coastal Shoreline Buffer Area. Stormwater runoff at the site would be controlled by an engineered infiltration system. The applicant states that the system would be designed to provide attenuation for the pre/post 10-year storm event, as required by the Town of Oak Island and to treat the first 1.5 inches of rainfall. Storm events greater than 1.5 inches would bypass the infiltration basin and overland flow via a 50' minimum grassed swale before discharging into the AIWW. The applicant has submitted an application for the stormwater management system to the Division of Water Quality. The Division of Water Quality has assigned the project No. SW* 051048. 10. ANTICIPATED IMPACTS: The proposed bulkhead construction would result in the filling of approximately 135 sq. ft. of 404 type wetlands and approximately 631 sq. ft. of estuarine waters and public trust area. Upland development would result in the disturbance of approximately 1.3 acres of highground and the creation of approximately 30,517 sq. ft. of impervious area (approximately 38% of the 75' Estuarine Shoreline AEC). ''A/ILMINGTON, NC 0 6 2006 11 Section 3a Proposed Improvements DUE TO UNEXPECTED CAMA ISSUES THIS PROJECT HAS BEEN DIVIDED INTO TWO PHASES. PHASE I WILL CONSIST OF THE BULHEADING AS SHOWN ON THE PLANS AND THE UPLAND DEVELOPMENT (DRAINGE, FILLING PARKING LOT). THIS APPLICATION IS FOR PHASE I ONLY. PHASE II APPLICATION WILL BE DELIVERED UNDER SEPARATE COVER. The development of this site will be for a public boat ramp and park. The proposed development will consist of a bulk head along the shore line, gravel parking area, gravel access roads, concrete boat ramps and the necessary onsite utilities. To accommodate the new construction an existing bulkhead and, deck and stairway will be removed from the site. Listed below is a detailed list of activities: 1. Removal of approximately 135 LF of existing bulkhead. This is on the northeast side of the property in the vicinity of the proposed boat ramp. 2. Removal of attached wooden dock and stairway. This is associated with the bulkhead mentioned above. 3. New construction of a double concrete boat ramp on the northeast portion of the project site. 4. New Construction of approximately 430 LF of bulkhead around the boat ramp area and across the majority of the property interface with the ICWW 5. New Construction of ramp and floating dock. The ramp is approximately 170 LF to facilitate ADA requirements and the floating dock is 80 LF by 8' wide. 6. Dredging associated with the boat ramp and floating dock. Approximately 2,000 cu yds will be required for removal. The dredged material will be dewatered on site and if acceptable will be used as fill on the upland portions of the site. 7. Backfilling behind the proposed bulkhead. 8. The construction of a vegetated filter parallel to the new bulkhead in order to meet NCDENR DWQ requirements. Items 1 through 8 above are proposed for the area forward of the 30' Coastal Shoreline Setback. 9. Installation of approximately 30,000 square feet of crusher run parking area and associated access roads for the boat ramp. 10. New Construction of an approximately 187 sq ft picnic gazebo structure. Although not budgeted within the framework of this project it is anticipated that the Town will construct this facility in the future, This structure is anticipated to be a wooden open wall platform with a attached roof. CAMA Application - Clarification Purpose & Use The purpose of the proposed project is to provide the citizens of Oak Island and surrounding communities a location to safely load and unload recreational boating and fishing vessels. The park provides auto/trailer parking for these activities. As a side benefit the facility also provides ICWW frontage recreational area for picnicking and other passive recreational uses. The park also provides a floating dock system that will provide access for fishing opportunities. These facilities will also supply access for handicapped individuals. Daily Operations of Completed Facility The park will be maintained by the Public Works Department of the Town of Oak Island. The facility will not have a full time staff but the PW department will provide trash collection, Operation and Maintenance of the Storm Water Management System. General wear and tear of the boat ramp, the floating dock and the bulkhead system will be the responsibility of the Public Works Department. Methods of Construction The specific means and methods of the construction will be the responsibility of the general contractor chosen to do the construction work. The plans call for the bulkhead and upland work to be performed first. At the same time all BMP's described in the NCDENR approved S&E permit will be enacted. After the major upland work has been completed and the S&E BMP's installed the Contractor will begin dredging operations for the placement of the boat ramp and floating dock. Provisions for the dewatering of dredged materials is shown on the plans and detailed on Sheet C3. Based on preliminary data the dredged material will be used as fill on the site. If is determined that the dredge spoils are not suitable for fill the material will be deposited at an offsite location approved by the Engineer, Owner and NCDENR. I.e Figure 1 - USGS The existing Property is currently used for limited public access to the InterCoastal Waterway, there have been no improvements made to the property other than the construction of some wood bulk heads, 2 small piers and shore line rip-rap protection. The site's vegetation is made up of mature trees with under story growth, grasses and weeds. The property also bound by the Intercoastal Waterway, the predominate vegetation in this area is cord'-grams 0A0,jn t dlerush. DCM !,ni NA1Mr1Tr)N `N(; The Brunswick County SCS Soil Survey indicates that the property's soil is Leon sand (Lo). Leon sand is a poorly drained soil, surface runoff is slow and infiltration is rapid the seasonal high water table is at or near the surface. Proposed Improvements The development of this site will be for a public boat ramp and park. The proposed development will consist of a bulk head along the shore line, gravel parking area, gravel access roads, concrete boat ramps and the necessary onsite utilities. DUE TO UNEXPECTED CAMA ISSUES THIS PROJECT HAS BEEN DIVIDED INTO TWO PHASES. PHASE I WILL CONSIST OF THE BULHEADING AS SHOWN ON THE PLANS AND THE UPLAND DEVELOPMENT (DRAIANGE, FILLING PARKING LOT). THIS APPLICATION IS FOR PHASE 1 ONLY. PHASE II APPLICATION WILL BE DELIVERED UNDER SEPARATE COVER. The facility will be accessed from the existing paved East Yacht Drive, to the south of the property. The total property area is 1.38 acres. The developments impervious area will be 30,517sf of gravel paved areas (including the handicap spots), 187sf gazebo making the total built upon area 30,703 sf, or 51% of the 1.38 acre total. A stormwater management system will provide attenuation for the pre/post 10 year storm, required by the Town of Oak Island and the same storm water drainage basin has been sized to treat the 1 W storm even. Storm events greater than the 1 W will bypass the drainage basin and overland flow a 50' min. in grassed swales before discharging to the Intracoastal Waterway.
