PROJECT DESCRIPTION Cavanaugh and Associates, P.A., on behalf of Cape Fear Trading Group 111, LLC, has requested that the attached application be processed under the Express Permit Review Program. The project site is located at the intersection of Bay Street and Yacht Basin Drive, adjacent to the old Southport yacht basin and Atlantic Intracoastal Waterway (AIWW), in Southport, Brunswick County. To find the property, take Hwy 74/76 west from Wilmington towards Leland. Turn left onto Hwy 133 at the intersection of Hwy 74/76 and Hwy 133, and follow until the road dead ends. Turn left onto Howe Street and travel approximately 2.5 miles. Turn right onto Bay Street and the property will be located on the right and left hand side approximately 0.3 miles. The subject property is approximately 2.07 acres with roughly 130' of shoreline along the AIWW (the southern property line). Three of the Lots within the project boundary are located on the southern side of Bay Street and the remaining Lots are located between Bay Street and Moore Street. Currently, there are several structure located on the property, including a restaurant, motel, warehouse, dilapidated pier and asphalt parking area. Elevation at the site averages approximately 5 to 9 feet above Mean High Water (Ml-1W). Vegetation associated with the high ground portion of the property consists primarily of lawn grasses and understory vegetation including Wax Myrtle, Cedar and Yaupon. Transitional species, including: Sea Oxeye (Rorrichia utescens) and Grounsel-bush (Raccharus halintifolia) are located along the upper edge of the coastal wetlands. High coastal marsh vegetation, including, Black Needle Rush (Juncus roentarianus), Spike Grass (Distichlis spicata), Sea Lavender (Limonhan spp.), and Salt Meadow Grass I nartina patens) complete the transition to the waters edge where Smooth Cordgrass Marsh (Spartina alterniflora) is the predominant species. There is a strip of "404 type" wetlands located along the southern edge of the property between the coastal marsh and the high ground. A "404 type" wetlands delineation has been completed and approved by the U.S. Army Corp of Engineers (COE). The waters of the AIWW, adjacent to the old Southport Yacht Basin and the project site, are classified as SC by the North Carolina Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT As previously mentioned the project site is divided by Bay Street. Three of the Lots (which will be referred to as the "southern tract" and include Lots Al-A3) are located on the southern side of Bay Street and ten Lots (referred to as "northern tract"' and include Lots B 1-B4, C I -C3 and D 1-D2) are located to the north of Bay Street, between Bay Street and Moore Street. The applicant is proposing to demolish the structures located on the property and redevelop the site by constructing an 1 l -Lot residential subdivision. Prior to the initiation of any new development, the property would be cleared, graded and prepped for backfill. Approximately 225,364 cu. ft. (an area approximately 196' x 125') of fill material would be trucked to the site in order to raise the elevation to a sufficient height for installation of the stormwater system. The applicant is proposing to install a retaining wall (approximately 2.5' above grade) around the perimeter of the "northern tract". The retaining wall would enclose the "northern tract", with the exception of the entrance area to the proposed alley, and the proposed walkways that would allow Street access to each of the Lots. According to the applicant, once the wall was installed, the site would be backfilled and prepped for residential development. The proposed alley (15' x 330') would divide the "northern tract", and would run from Bay Street to Moore Street. Mr. 1 Tyson Page Three Of the ten Lots comprising the "northern tract", eight would be developed for residential home sites. The two remaining Lots would be used for tenant/visitor parking, and also for stormwater collection/infiltration. The northern most Lot located within the "northern tract" would serve as a parking area/stormwater infiltration basin for the five Lots located west of the alley. The remaining Lots within the "northern tract" (those located east of the alley) would also be developed for residential home sites, with the exception of the northern most Lot. This lot would be utilized as a parking area and also as a stonrwater infiltration basin. As designed, this basin would collect stormwater runoff from those Lots located on the eastern side of the alley. The three Lots, referred to as the "southern tract", would utilize the Low-Density approach to stonnwater treatment. Two vegetated terrace systems would be constructed on both sides of the interior Lot. These vegetated terrace systems would collect stonnwater runoff from the impervious areas and sheet flow the water towards the north and south. According to the application package, no retaining walls and/or bulkheads area proposed for the Lots located within the "southern tract". Although not proposed as part of this permit application package, the applicant has indicated on the workplat drawings, the location of the proposed 2' wide driveway strips for each Lot. The applicant has identified these driveway strips for impervious surface calculations, and to show that pads are not proposed for future development. As proposed, the density of the project would be eleven single-family Lots, or 5.3 units per acre. The percentage of impervious coverage for each Lot located within 75' of Mean High Water (MHW) would be 1% for Lot A-1, 13% for Lot A-2, 10% for Lot A-3, 50% for Lot C-1, 34% for Lot C-2 and 36% for Lot C-3. As proposed, no portion of the subdivision, including but not limited to the retaining wall, access alley, driveways, parking areas or stornnvater collection systems will impact any portion of coastal wetlands or "404" type wetlands. Additionally, all development would be located outside of the 30-foot Coastal Shoreline buffer. Once the individual Lots within the subdivision are sold, each property owner would be required to obtain a CAMA Minor Permit from the Town of Southport for any subsequent development on/in the property, if any development is proposed within the 75' Estuarine Shoreline Area of Environmental Concern (AEC). The applicant has indicated that water and sewer would be provided and collected by the City of Southport. 10. ANTICIPATED IMPACTS The initial grading and filling of the site for driveway/parking construction, stonnwater system installation and Lot preparation would result in the disturbance of approximately 2.01 acres (87,555 sq. ft.) of high ground. The applicant received a High-Density State Stormwater Permit #SW8060241, on 3/17/06, from the Division of Water Quality. The applicant has also received an approved Sedimentation and Erosion Control Plan (SECP), on 3/13/06, from the Land Quality Section (Bruns-2006-299).
