9. Project Description
The project site is an approximately 112 acre tract, averaging twenty to thirty feet above mean high water,
adjacent to Jump and Run Creek and Calf Gully Creek off Highway 133 near Southport in Brunswick
County. The tract actually runs parallel to Dutchman Creek Canal between two of it's tributaries (Jump and
Run Creek and Calf Gully Creek). However, the property does not actually border Dutchman Creek due to a
tract of land owned by Carolina Power and Light Company which also runs parallel to Dutchman Creek
between the applicant's property and Dutchman Creek Canal. The tract is currently wooded. Man-made
features currently on the site include: an old dike probably made from old dredge spoil and unpaved roads.
The tract is basically undeveloped with no wastewater treatment facilities or drinking water supply source.
Since water access to Dutchman Creek is blocked by the tract of land owned by CP&L, the tract's only
waterward boundaries are adjacent to Calf Gully Creek along the southern boundary and Jump and Run
Creek along the northern boundary. The waters adjacent to the site are classified as SA waters by the
Division of Water Quality. They are open to the harvest of shellfish and are designated Primary Nursery
Area by the NC Division of Marine Fisheries.
The applicant proposes to create a subdivision from the tract and to sell individual lots. Lots have not yet
been platted, so the size and number of lots are unknown. As an amenity to the subdivision the applicant is
proposing to construct a 6' x 96' walkway, partially over "404" type wetlands from which a 6' x 24'
walkway and a 6' x 10' walkway would extend. Each walkway would extend towards Jump and Run Creek
with each terminating with a 10 X 20 ft elevated deck over open water. A third elevated deck is proposed to
extend directly from the eastern terminus of the 6 X 120 ft walkway, which is also proposed over open
water. At the location of the piers, Jump and Run Creek is a navigable tidal creek approximately forty feet
wide and five to six feet deep at mean high water. A narrow strip of Smooth Marsh Cordgrass (Spartina
alterniflora) exists along the boundary adjacent to the proposed construction. The applicant is proposing no
construction beyond 1\4 the width of the creek and all construction shall be elevated over coastal wetlands.
No construction is proposed within 15 ft. of the adjacent riparian corridor line.
This project was permitted under CAMA Major Permit #100-98, on 7/27/98, however the permittee at the
time, Bermuda Trace C/o Three Island Partners, LLC, neglected to renew the permit at the time of
expiration. The proposed project is nearly identical to the previously permitted project, with the exception of
the reduction in the overall length of the 6' x 96' walkway (previously permitted at 6' x 120'). Additionally,
at the time Permit # 100-98 was issued, the 15A NCAC 07H .0209 allowed for a pier structure to extend up
to, but not beyond, 1 /3 of the width of the waterbody. The applicant's current proposal would limit the span
of the pier structure to 1/4 of the width of the waterbody.
10. Anticipated Impacts
Impacts to the upland portion of the development will involve the transformation of a moderately wooded
tract to a residential subdivision. Location and number of residences and associated streets have not yet been
determined, so impervious coverage cannot be calculated. However, development of individual lots within
the estuarine shoreline area of environmental concern along both creeks would require minor permits, which
would allow for separate review. The applicant is proposing no other development within the Division of
Coastal Management Areas of Environmental Concern besides the walkway and associated structures.
However, the applicant has been made aware that all future development will be subject to review from the
appropriate agencies and that the Division reserves the right of full disclosure of any subsequent upland
development.

The project as proposed would incorporate approximately 1038 sq. ft. of public trust waters and
approximately 600 sq. ft. of "404" type wetlands. The pier is consistent with the 1/4 Rule and should not
impede navigation. All piers related construction is proposed to be at least fifteen feet inside of each riparian
corridor. There is no proposed excavation associated with the construction of the pier, so turbidity should
be limited to that resulting from the placement of pilings.

other instrument under which the applicant claims title

claiming to be the owner of said property, then

from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

Bill Clark Homes, LLC proposes to build 3 community piers and 3 community platforms
on their property off of Highway 133 (Long Beach Road), within the Carolina Place
Subdivision.
The proposed piers will be 10, 24, and 96 feet long and each will have a 10'x20' platform
at the end of the pier. The platform at the end of the 24 foot long pier will be covered.
There are no boat slips proposed.
There is no dredging or wetland fill proposed. Piers and decks will be elevated over
coastal wetlands a minimum of 3 feet, will not exceed 6 feet in width, and will not extend
more than '/4 of the width of the water body. None of the proposed structures are located
within 15 feet of adjacent riparian corridor lines.
