Subject: REQUEST FOR ADDITIONAL INFORMATION
Buffalo Hydraulic Improvements (Project No. 00358-0138, WD -2017-18)

Dear Mr. Hester:
On June 29, 2018, the Division of Water Resources (Division) received your application requesting an
Individual Water Quality Certification from the Division for the above -referenced project. The project
application fee was received August 8, 2018. The Division requested more information on September
10, 2018 and received your response on September 20, 2018. The Division has additional questions
about the proposed work and has determined that your application is incomplete and cannot be
processed. The application is on -hold until all of the following information is received:
1. On September 10, 2018, the Division requested more information regarding the details of the
coffer dams, turbidity curtains and/or sediment barriers to be used in the construction sequence
of the stream crossings. The Division needs to ensure the project will be constructed in the dry
and the proposed structures will not fail when pressurized by the high velocity/volume of rivers
like the Neuse. In your response, you stated:
It is anticipated that the General Contractor will elect to utilize a temporary coffer
dam system, such as Portadam... and Ultimate selection of damming of the River
and streams, as well as specific pump sizes and redundancy, will be at the

discretion of the General Contractor as part of their means and methods to
construct the proposed design.
The Division needs specific design criteria and certainty about construction methodology to fully
evaluate potential impacts on water resources. Please provide specific construction design and
sequence information.
The construction drawings detailing the Stream crossing layout (EC -12) show spoil piles on either
side of the stream. How will the spoil be dewatered? Will any of the spoil be placed back into
the stream (bed/bank, etc)?
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please respond in writing within 30
calendar days of receipt of this letter by sending one (1) copy of all of the above requested information
to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by
submitting all of the above requested information through this link:
https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form (please note that the DWR#
requested on the link is referenced above).
If all of the requested information is not received within 30 calendar days of receipt of this letter, the
Division will be unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the Division for approval, including a complete application package and the
appropriate fee.
Please be aware that you have no authorization under the Water Quality Certification Rules for this
activity and any work done within waters of the state may be a violation of North Carolina General
Statutes and Administrative Code.
