(USACE) and the N. C. Division of Water Resources (NCDWR) that the activities proposed below may proceed under
Nationwide Permit 12 and Water Quality Certification 4133. In addition, the applicant would like to request a Neuse
Riparian Buffer No Practical Alternatives Determination from the NCDWR for the proposed impacts to riparian

3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application: The existing conditions of the project area consist of forested land on the east side of Middle Creek, within
the floodplain. Perennial streams, intermittent streams and jurisdictional wetlands are present within the proposed 60'
easement. The general land use in the vicinity of the project is residential, forested land and a wastewater treatment
plant at the northern terminus.

Apex.

The overall project consists of the construction of a regional wastewater pump station, and approximately 8, 000 linear
feet of a 16-inch force main, and a gravity sewer line. This project has been on the Town's Sewer System Master Plan
for several years (copy attached) and will ultimately allow the Pinnacle Park Pump Station to be taken out of service.
There will be a total of nine (9) wetland impact areas and five (5) stream crossings. Typical equipment used for
excavation and construction will be utilized for this project.

Impact Justification and Mitigation
1.
Avoidance and Minimization
1 a.
Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
S&EC completed a wetland & stream delineation for the entire easement in order to identify natural resources so that
impacts could be avoided & minimized to the maximum extent practicable. The proposed project includes nine (9)
wetland crossings, and five (5) stream crossings. Directional drill or Bore & Jack construction methods are not being
proposed because the town requires that the project includes a permanent rip -rap lined maintenance vehicle crossing for
each stream. It was determined to not be practical to use directional drill or Bore & Jack techniques to install the pipe
lines, and then impact the streams and wetlands above the pipe lines by constructing the required maintenance vehicle
access crossings. The rip -rap lined maintenance vehicle crossings have been minimized to 10 ft. wide at each crossing
and compensatory mitigation is being proposed at a 1:1 ratio. The proposed easement falls on numerous tracts of land
owned by different individuals. Each impact area was evaluated to minimize stream & wetland impacts to the maximum
extent practicable and also minimize the encroachment on the individual properties. At Impact #8 there is an existing
stormwater management BMP that is adjacent to the proposed force main and easement. The easement is positioned as
close to the BMP as allowed by regulation. The town is requiring the constructed rip -rap lined swale across the easement
to convey discharge from the existing stormwater BMP. At Impact #10, the force main will be directionally drilled under
the wetland and Pristine Water Drive and will avoid impacts to wetlands. The gravity line will terminate on the north side
of Pristine Water Dr. At Impact #10, there is also an existing stormwater BMP on the upslope (eastern) side of the
proposed gravity sewer easement, and the stream and twin 60 -inch culverts on the downslope (western) side of the
proposed easement. These existing constraints made is difficult to avoid wetland and parallel riparian buffer impacts
within this location. All remaining wetland, stream & riparian buffer impacts have been designed to cross the wetlands
and streams at a near perpendicular angle. All temporary wetland impacts will be brought back to pre -construction
contours and vegetated with a wetland seed mix. All temporary stream impacts will be brought back to pre -construction
elevations and the stream banks will be stabilized.

As per the project engineer; There will be silt fence along all of the disturbed areas, to prevent any sediment from leaving
the site. The proposed stream crossings all have minimal dry weather flows, which should allow the pipeline installation
across the stream to be relatively quick. There will be the opportunity to use a cofferdam and bypass pipe if there is any
stream flow at the time of the crossing.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft
states that other publically funded projects mayor may not result in cumulative impacts. The Middle Creek Regional
Pump Station, Force Main and Interceptor project is a privately funded (with partial public reimbursement) within a
partially developed watershed. Please note that this project is located within the Town of Apex, therefore the adjacent
properties that have potential for development will have the following regulations to protect downstream waters: 1) the
Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited activities within the riparian
buffer areas, in addition to "diffuse flow" requirements, and could require Best Management Practices that treat nitrogen if
diffuse flow cannot be achieved; 2) the Phase II NPDES Stormwater Permit Program, this program includes permitting
requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater
management requirements. We anticipate that the DWR will advise us if any additional information is needed.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the -proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
