After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). PROJECT SUMMARY: The applicant proposes to construct a 190-ft. long wooden bulkhead, 15-ft. wide by 40- ft. long boat ramp addition to an existing 15-ft. wide by 20-ft. long concrete ramp, 3-ft. wide by 80-ft. long drainpipe, and pier with platform, boathouse, boatlift and three mooring pilings on their property located at 129 Camden Ave. (Lots 24, 25, and 26), Taylor's Beach Community, Camden County, and on the Pasquotank River. PROJECT SETTING The property is 13,500 sq. ft. (0.31 acre) located at Lots 24, 25, and 26 Sunset Ave. (SR 1126), Taylor's Beach Community, in Camden County and adjacent to Pasquotank River. The property has an elevation of approximately 4 ft. above normal water level (NWL) and has Roanoke silt loam soil type. Vegetation on the property consists of Loblolly Pine, Laurel Oak, and a few other indigenous shrubs and grasses. Adjacent property consists of similar size building lots. Both properties to the northwest and southeast have been developed with single-family dwellings on them. Both adjacent properties are bulkheaded and the property to the northwest has riprap along the shoreline just northeast of the bulkhead. The applicant's property has experienced considerable erosion along the shoreline, and Hurricane Isabelle caused the majority of the erosion. The alignment of the proposed bulkhead is located approximately where NWL was pre-Hurricane Isabelle (September, 2003). The current NWL is approximately 45-ft. from Sunset Avenue, and the NWL was approximately 75-ft. from Sunset Avenue before Hurricane Isabelle. The existing bulkhead of the applicant southeast of the erosion and the existing northeastern alignment of bulkhead and riprap of the northwestern property owner have accelerated erosion on the applicant's lot. A 30-ft. long by 5-ft. wide manmade ditch exists and appears to have been excavated from uplands located at the applicant's northern property line. The ditch connects the Pasquotank River with a ditch and series of culverts under driveways along Sunset Avenue. It also connects to a culvert under Sunset Ave. to farm ditches to the north. The water depth close to shore ranges from 0.5-1ft. and gradually deepens to 2 ft. at the waterward end of the pier. The waters of the Pasquotank River in this area are classified as SB by the Division of Environmental Management and are closed to shellfish harvesting. There was no observed presence of submerged aquatic vegetation or shellfish in the vicinity of the proposed fill for the bulkhead or the pier site on October 26, 2005. Reviews of available information suggest that there are no known archeological sites or geologic formations associated with the applicant's property. DEVELOPMENT PROPOSAL In order to prevent further erosion, the applicant proposes to construct a 190-ft. long wooden bulkhead to connect with the corner of the adjacent southeastern lot bulkhead, maintain a straight alignment, then curve to the west 25-ft from the property line to Alfred and Susan Thompson Field Investigation Report Page 3 connect with the corner of the adjacent northwestern lot bulkhead. The proposed bulkhead alignment will have a maximum distance of 55 ft. from the shoreline and an average distance of 30 ft. Clean, dry fill will be used for backfill from an upland pit. The applicant is requesting this bulkhead alignment to regain eroded uplands and prevent erosion from threatening Sunset Avenue. The applicant proposes to fill a 15-ft. wide by 10-ft. long area below NWL to add to an existing 15-ft. wide by 20-ft. long concrete boat ramp. The applicant proposes a 15-ft. wide by 30-ft. long concrete addition to existing boat ramp on uplands. The applicant proposes to construct a 6 ft. wide pier with a 15-ft. wide by 20-ft. long "L" shape platform. The total length of the pier structure will be 50 ft. The applicant proposes to construct a 15-ft. wide by 20-ft. long boathouse with boatlift. The applicant proposes to place three pilings east of the "L" in order to create a 10 ft. by 20 ft. slip. With the slip created from three pilings and the boathouse, the applicant proposes to create 2 slips in total. The applicant proposes to fill the 30-ft. long by 5-ft. wide ditch and install an 80-ft. long by 3-ft. diameter drainpipe to maintain the connection between the road ditch and the Pasquotank River. ANTICIPATED IMPACTS The proposed bulkhead alignment with backfill, boat ramp, and drain pipe will result in the filling of approximately 7,198 sq. ft. of Public Trust Area (PTA), Estuarine Waters (EW). Approximately 116 cubic yards of fill material will be placed below NWL for the backfill, boat ramp, and drainpipe. This project will result in a loss of approximately 7,198 sq. ft. (0.16 acres) of shallow water habitat in Pasquotank River. The proposed boat ramp addition will fill approximately 450 sq. ft. in the upland Estuarine Shoreline (ES) Area of Environmental Concern (AEC). The proposed pier will shade 180 sq. ft., the "L" platform will shade 300 sq. ft., and the boathouse with boatlift will shade 300 sq. ft. of PTA, EW. There are no expected navigational impacts due to the pier structure. Temporary water turbidity will occur during construction. The use of a filter cloth behind the bulkhead will minimize future erosion and turbidity. Submitted by: Kimberly A. MANAGEMENT EI-LASE i 11 CITY The proposed project is requested to bulkhead Lots 24, 25, and 26 to tie in to the existing bulkhead on either side of these lots to prevent further erosion. At this time the erosion of these lots is threatening to wash out Sunset Avenue. The bulkhead would begin at point A, on the southern boundary of Lot 26, and go straight across, then begin to curve up midway thru Lot 24 to connect with the end of the bulkhead on the southern boundary of Lot 23, point B. A drainage pipe will be installed between Lots 23 and 24 where there is now a drainage ditch and the existing riprap on Lot 23 will be removed to allow Lot 24 to connect seamlessly with Lot 23. Since Isabelle there has been a lot of erosion. During the hurricane, quite a few trees on Lots 24, 25, and 26 were felled and since that time additional trees have fallen from other storms. Some of these trees are currently lying in the water. Since these trees were felled by storms, the root balls, which were stabilizing the lots, were ripped out and the erosion has continually progressed at a very fast pace with each subsequent storm. Approximately 45 feet has eroded since Isabelle including 10-20 feet this past year after more trees fell. Multiple owners owned these 3 lots and thus nothing was done after the damage of Isabelle. Thru a court ordered auction we have become the sole owner and are now trying to fix the damage to these lots and to prevent further erosion. The proposed fill area on the lots is sand and there is no aquatic vegetation other than the felled trees lying in the water. This will not disturb any habitat since none exists in this area. We had first considered going straight across from Lot 26 to the existing riprap on Lot 23, but to control further erosion, the connection to the other existing bulkhead made more sense.
