In accordance with your permit minor modification request received July 14, 2009, we are
forwarding herewith Permit No. WQ0032821 for the continued operation of the conjunctive reclaimed
water utilization system, dated August 20, 2009 to Durham County, which has been modified to allow for
the removal of the bulk loading flow monitoring device during those times when bulk loading of
reclaimed water is not taking place.
The following modifications to the subject permit are as follows:
> Permit Condition IV. 3. has been changed to allow for the removal of the continuous
flow meter for measuring bulk reclaimed water flow during those times when the hydrant
is connected to the portable belt presses and the hydrant will not be used for the bulk
loading of reclaimed water.
This permit shall be effective from the date of issuance until February 28, 2013, shall void Permit
No. WQ0032821 issued March 14, 2008, and shall be subject to the conditions and limitations as
specified therein. Failure to establish an adequate system for collecting and maintaining the required
operational information shall result in future compliance problems.
If any parts, requirements or limitations contained in this permit are unacceptable, the Permittee
has the right to request an adjudicatory hearing upon written request within 30 days following receipt of
this permit. This request shall be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings at 6714 Mail
Service Center, Raleigh, NC 27699-6714. Unless such demands are made, this permit shall be final and
binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules and Regulations

FOR THE
continued operation of the Triangle Wastewater Treatment Plant reclaimed water bulk fill station located
at the designated loading station and consisting of a hydrant meter, flexible hose and associated piping
and valves. Reclaimed water, following treatment and testing according to the most recent issuance of the
Triangle Wastewater Treatment Plant's NPDES permit (NC0026051) and compliance with the conditions
provided herein, may be diverted to the permitted reclaimed bulk fill station. The bulk reclaimed water
distribution system will have an estimated maximum flow of 250,000 gallons per day. The Reclaimed
wastewater system shall be designed and operated with no discharge of wastes to surface waters, pursuant
to the application received July 14, 2009, and in conformity with the project plans, specifications, and
other supporting data subsequently filed and approved by the Department of Environment and Natural
Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until February 28, 2013, shall void Permit No.
WQ0032821 issued March 14, 2008 and shall be subject to the following specified conditions and
limitations:

No later than six months prior to the expiration of this permit, the Permittee shall request renewal of
this permit on official Division forms. Upon receipt of the request, the Division will review the
adequacy of the facilities described therein, and if warranted, will renew the permit for such period of
time and under such conditions and limitations as it may deem appropriate. Please note Rule 15A
NCAC 02T .0105(d) requires an updated site map to be submitted with the permit renewal
application.

H. PERFORMANCE STANDARDS
The subject non -discharge facilities shall be effectively maintained and operated at all times so there
is no discharge to surface waters, nor any contravention of groundwater or surface water standards.
In the event the facilities fail to perform satisfactorily, including the creation of nuisance conditions
due to improper operation and maintenance, or failure of the utilization areas to adequately assimilate
the reclaimed water, the Permittee shall take immediate corrective actions including Division required
actions, such as the construction of additional or replacement wastewater treatment or utilization
facilities.
2. This permit shall not relieve the Permittee of their responsibility for damages to groundwater or
surface water resulting from the operation of this facility.
3. Reclaimed water distributed through bulk fill operations shall not exceed the effluent limitations
specified in Attachment A.
4. Reclaimed water distributed through bulk fill operations shall be limited to the uses specified in
Attachment: Approved Bulk Fill Reclaimed Water Uses.
5. The conjunctive use of reclaimed water permitted herein in no way negates, precludes, or invalidates
the most recent reissuance of the Permittee's NPDES permit (NC0026051), and the Permittee shall
continue to comply with all conditions provided for therein.
6. The following shall be requirements for the reclaimed water distribution, storage and utilizatio4
facilities:
a. All reclaimed water valves, storage facilities and outlets shall be tagged or labeled to warn the
public or employees that reclaimed water is not intended for drinking. Where appropriate, such
warning shall inform the public or employees to avoid contact with reclaimed water.
b. All reclaimed water piping, valves, outlets and other appurtenances shall be color -coded, taped or
otherwise marked to identify the source of the water as being reclaimed water.
i. All reclaimed water piping and appurtenances shall be either colored purple (i.e., Pantone
522) and embossed or integrally stamped or marked "CAUTION: RECLAIMED WATER —
DO NOT DRINK" or be installed with a purple (i.e., Pantone 522) identification tape or
polyethylene vinyl wrap. The warning shall be stamped on opposite sides of the pipe and
repeated every three feet or less.
ii. Identification tape shall be at least three inches wide and have white or black lettering on
purple (i.e., Pantone 522) field stating "CAUTION: RECLAIMED WATER — DO NOT
DRINK." Identification tape shall be installed on top of reclaimed water pipelines, fastened
at least every 10 feet to each pipe length and run continuously the entire length of the pipe.
iii. Existing underground distribution systems retrofitted for the purpose of distributing
reclaimed -water shall be taped or otherwise identified as noted above. This identification
need not extend the entire length of the distribution system, but shall be incorporated within
10 feet of crossing any potable water supply line or sanitary sewer line.
c. All reclaimed water valves and outlets shall be of a type, or secured in a manner, that permits
operation by authorized personnel only.
7. The Permittee shall maintain an active cross -connection control program that shall have the following
minimum requirements:
a. No direct cross -connections shall be allowed between the reclaimed water and potable water
systems.

b. Where both reclaimed water and potable water are supplied to a reclaimed water utilization site, a
reduced pressure principle backflow preventer, an approved air gap separation or other Division
of Environmental Health approved device shall be installed at the potable water service
connection to the use area. The installation of the reduced pressure principle backflow prevention
device shall allow proper testing_
c. Where potable water is used to supplement a reclaimed water utilization system, the Permittee or
potable water supplier shall approve and regularly inspect the air gap separation.
8. Compliance and review boundaries for the reclaimed water utilization areas have not been established
pursuant to 15A NCAC 02T .0905. Any exceedance of groundwater standards at any location shall
require action in accordance with 15A NCAC 02L .0106.
9. The facilities permitted herein shall be constructed according to the following setbacks:
a. The setbacks for reclaimed utilization sites shall be as follows (all distances in feet):
i. Surface waters not classified SA: 25
ii. Surface waters classified SA: 100
iii. Any well with exception to monitoring wells 100
b. The setbacks for storage and treatment units shall be as follows (all distances in feet):
L Any habitable residence or place of public assembly under separate ownership:
ii. Any private or public water supply source:
iii. Surface waters:
iv. Any well with exception of monitoring wells:
v. Any property line:
* Treatment and storage unit setbacks were established and met during construction of the
existing facility. Any new treatment and storage units would need to meet all setback
requirements established in 15A NCAC 02T .0912.
III. OPERATION AND MAINTENANCE REQUIREMENTS
l . The facilities shall be properly maintained and operated at all times. The facilities shall be effectively
maintained and operated as a non -discharge system to prevent the discharge of any wastewater
resulting from the operation of this facility. The Permittee shall maintain an Operation and
Maintenance Plan pursuant to 15A NCAC 02T .0913, which at a minimum shall include operational
functions, maintenance schedules, safety measures and a spill response plan.
2. Upon the Water Pollution Control System Operators Certification Commission's (WPCSOCC)
classification of the subject non -discharge facilities, in accordance with 15A NCAC 08G .0200 the
Permittee shall designate and employ a certified operator in responsible charge (ORC) and one or
more certified operator(s) as back-up ORC(s). The ORC or their back-up shall visit the facilities in
accordance with 15A NCAC 08G .0200, and shall comply with all other conditions specified in the
previously cited rules.
No type of wastewater other than that from the Triangle WWTP, Permit Number NC0026051, is
approved for bulk distribution under the conditions of this permit.
4. Public access to the reclaimed water bulk distribution operation and utilization sites shall be
controlled during active site use. Such controls may include the posting of signs indicating the use of
reclaimed water and appropriate restrictions. Public access to the wastewater treatment facilities shall
be prohibited.

The residuals generated from the wastewater treatment facilities shall be disposed or utilized in
accordance with 15A NCAC 02T .1100. The Permittee shall maintain a residual management plan
pursuant to 15A NCAC 02T .0914.
6. Diversion or bypassing of untreated or partially treated wastewater from the treatment facilities is
prohibited, unless diverted to an alternate treatment or collection system.
7. For use of the bulk fill operation, an education program shall be developed and implemented to
inform reclaimed water users, which include County employees and bulk reclaimed water users, of
the proper use of reclaimed water for each of the approved uses. Educational material shall be
provided to all individuals/facilities provided with reclaimed water, and these materials shall be
maintained consistent with the reclaimed water uses. All educational materials shall be made
available to the Division upon request.
8. For use of the bulk fill operation, where reclaimed water is used for industrial purposes, disposal of
the utilized reclaimed water shall meet the conditions included in all State approved, permits held by
the industry (e.g. NPDES, Non -Discharge, or Pretreatment permits).
9. For use of the bulk fill operation, the Permittee shall approve truck drivers for participation in the
bulls reclaimed water distribution program prior to distribution of reclaimed water. In addition, the
Permittee shall provide bilingual (English and Spanish) training to all tank truck drivers approved to
participate in the bulk reclaimed water distribution program at a regular frequency. These sessions
shall provide training on, but not limited to, the following topics:
i. Reclaimed water description and safety,
ii. Approved and disapproved uses of reclaimed water,
iii. Procedures for the application (including buffer maintenance), uses, and storage of
reclaimed water as well as the disposal of unused reclaimed water,
iv. Procedures for spill prevention, countermeasures, and control as well as notification
requirements,
v. Personal safety and hygiene issues, and
vi. Interaction with the general public.
10. For use of the bulk fill operation, tank trucks used to transport reclaimed water shall meet the
following requirements:
a. Tank trucks and other equipment used to distribute reclaimed water shall be clearly
identified with advisory signs. Signage could include but is not limited to "CAUTION:
RECLAIMED WATER — DO NOT DRINK", "NON -POTABLE WATER", or a
combination of similar phrases.
ii. Tank trucks used to transport reclaimed water shall not be used to transport potable water
that is used for drinking or other potable purposes.
iii. Tank trucks used to transport reclaimed water shall not be filled through on -board piping
or removable hoses that may subsequently be used to fill tanks with water from a potable
water supply. Tank trucks owned and operated by the Permittee and dedicated to be filled
by reclaimed water only may be filled through on -board piping.
iv. Tank trucks shall not have been used to haul septage, biosolids, or other waste or
chemical transport.
V. Tank trucks shall not have any type of removable container or portable bladder except if
the tank/bladder is permanently labeled for reclaimed water use only and a letter from the
truck owner is submitted to the Permittee indicating that in no case shall any removable
container or portable bladder be used for both reclaimed and potable water at any time.

11. The Permittee shall develop and maintain a program of routine review and inspection of reclaimed
water users.
12. For the use of the bulk fill operation, the Permittee shall develop and implement an operation and
maintenance plan which includes but is not limited to the following:
Description of operation,
ii. Description of anticipated maintenance,
iii. Safety measures, including site restrictions,
iv. Spill prevention and spill response plan,
V. Contact information for plant personnel, emergency responders, and regulatory agencies,
vi. Approval procedures of users,
vii. Operational requirements for users, and
viii. If reclaimed water is to be stored for greater than 72 hours prior to use, include
description of how reclaimed water quality standards will meet at the time of use.
IV. MONITORING AND REPORTING REQUIREMENTS
Any Division required monitoring (including groundwater, plant tissue, soil and surface water
analyses) necessary to ensure groundwater and surface water protection shall be established, and an
acceptable sampling reporting schedule shall be followed.
2. Per 15A NCAC 02H .0800, a Division certified laboratory shall conduct all laboratory analyses for
the required effluent, groundwater or surface water parameters.
3. Flow distributed to the conjunctive reclaimed water system shall be continuously monitored, and
daily flow values shall be reported on Forth NDMR.
The Permittee shall install and maintain an appropriate flow measurement device to ensure the
accuracy and reliability of flow measurement consistent with accepted engineering and scientific
practices. Selected flow measurement devices shall be capable of measuring flows with a maximum
deviation of less than ten percent from true flow; accurately calibrated at a minimum of once per year;
and maintained to ensure the accuracy of measurements is consistent with the selected device's
accepted capability. The flow meter may be removed from the line during those times when the bulk
loading of reclaimed water is not taking place_ The Permittee shall maintain records of flow
measurement device calibration on file for a period of at least five years. At a minimum,
documentation shall include:
a. Date of flow measurement device calibration,
b. Name of person performing calibration, and
c. Percent from true flow.
4. The Permittee shall monitor the effluent from the subject facilities at the frequencies and locations for
the parameters specified in Attachment A.

5. The Permittee shall maintain adequate records. These records shall include, but are not necessarily
limited to, the following information:
a. Date of distribution or utilization;
b. Name and drivers license number of truck operator,
c. Bulk fill certification number or equivalent (proof of certification provided to reclaimed water
user),
d. Name of end user,
e. Intended use of the bulk reclaimed water,
f. Number of gallons provided at each bulk distribution event,
g. Turbidity measurement results, and
h. Total volume of bulk reclaimed water distributed each month.
6. Three copies of all monitoring data (as specified in Conditions IV.3.? and IVA.?) on Form NDMR for
reclaimed water bulk fill pump station, as specified in Attachment A shall be submitted on or before
the last day of the following month. If no activities occurred during the monitoring month,
monitoring reports are still required documenting the absence of the activity. All information shall be
submitted to the following address:

7. A maintenance log shall be maintained at this facility. This log shall be maintained at the facility for
a period of no less than five years, and shall be made available to the Division upon request. At a
minimum, this log shall include:
a. Date of calibration of flow measurement device;
b. Date of calibration of the portable turbidity meter;
c. Visual observations of the plant and plant site; and
d. Record of preventative maintenance (e.g., changing of equipment, adjustments, testing,
inspections and cleanings, etc.).
8. Inspection and maintenance records shall be maintained for a period of at least three years.
9. Noncompliance Notification:
The Permittee shall report by telephone to the Raleigh Regional Office, telephone number (919) 791-
4200, as soon as possible, but in no case more than 24 hours, or on the next working day following
the occurrence or first knowledge of the occurrence of any of the following:
a. Any occurrence at the facility resulting in the treatment of significant amounts of wastes that is
abnormal in quantity or characteristic, including the known passage of a hazardous substance.
b. Any process unit failure (e.g., mechanical, electrical, etc.), due to known or unknown reasons,
rendering the facility incapable of adequate wastewater treatment.
c. Any facility failure resulting in a by-pass directly to receiving surface waters.
d. .Any time self -monitoring indicates the facility has gone out of compliance with its permit
limitations.

Any emergency requiring immediate reporting (e.g., discharges to surface waters, imminent failure of
a storage structure, etc.) outside normal business hours shall be reported to the Division's Emergency
Response personnel at telephone number (800) 662-7956, (800) 85.8-0368, or (919) 733-3300.
Persons reporting such occurrences by telephone shall also file a written report in letter form within
five days following first knowledge of the occurrence. This report shall outline the actions taken or
proposed to be taken to ensure the problem does not recur.
V. INSPECTIONS
1. The Permittee shall provide adequate inspection and maintenance to ensure proper operation of the
wastewater treatment and utilization facilities.
2. The Permittee or their designee shall inspect the wastewater treatment and utilization facilities to
prevent malfunctions, facility deterioration and operator errors resulting in discharges, which may
cause the release of wastes to the environment, a threat to human health or a public nuisance. The
Permittee shall maintain an inspection log that includes, at a minimum, the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken. The
Permittee shall maintain this inspection log for a period of five years from the date of the inspection,
and this log shall be made available to the Division or other permitting authority upon request.
3. Any duly authorized Division representative may, upon presentation of credentials, enter and inspect
any property, premises or place on or related to the wastewater treatment and utilization facilities
permitted herein at any reasonable time for the purpose of determining compliance with this permit;
may inspect or copy any records required to be maintained under the terms and conditions of this
permit, and may collect groundwater, surface water or leachate samples.
4. If any single party obtains more than 25,000 gallons of reclaimed water from the bulk fill operation in
any single day, or more than 100,000 gallons in any single week, The County shall inspect the sites
where the party is using the reclaimed water to ensure compliance with the conditions of this permit.
Inspections of high volume users do not need to exceed one inspection per quarter. The County shall
maintain records of those site visits for at least three years.
5. In accordance with 15A NCAC 02T .0911(f) and to ensure compliance with the conditions of this
permit, the Permittee shall inspect the utilization sites of all reclaimed water users who obtain more
than 10,000 gallons per day of bulk distributed reclaimed water. Permittee inspection of these bulk
distribution reclaimed water utilization sites does not need to exceed one inspection per quarter. The
Permittee shall maintain records of these inspections for at least five years, and shall make them
available to the Division upon request.
VI. GENERAL CONDITIONS
1. Failure to comply with the conditions and limitations contained herein may subject the Permittee to
an enforcement action by the Division in accordance with North Carolina General Statutes 143-
215.6A to 143-215.6C.
2. This permit shall become voidable if the permitted facilities are not constructed in accordance with
the conditions of this permit, the Division approved plans and specifications, and other supporting
documentation.
3. This permit is effective only with respect to the nature and volume of wastes described in the permit
application; Division approved plans and specifications, and other supporting documentation. No
variances to applicable rules governing the construction or operation of the permitted facilities are
granted, unless specifically requested and approved in this permit pursuant to 15A NCAC 02T
.0105(n).

4. The issuance of this permit does not exempt the Permittee from complying with any and all statutes,
rules, regulations, or ordinances, which may be imposed by other jurisdictional government agencies
(e.g., local, state, and federal). Of particular concern to the Division are applicable river buffer rules
in 15A NCAC 02B .0200; erosion and sedimentation control requirements in 15A NCAC Chapter 4
and under the Division's General Permit NCGO 10000; any requirements pertaining to wetlands under
15A NCAC 02B .0200 and 02H .0500; and documentation of compliance with Article 21 Part 6 of
Chapter 143 of the General Statutes.
5. In the event the permitted facilities change ownership or the Permittee changes their name, a formal
permit modification request shall be submitted to the Division. This request shall be made on official
Division forms, and shall include appropriate property ownership documentation and other supporting
documentation as necessary. The Permittee of record shall remain fully responsible for maintaining
and operating the facilities permitted herein until a permit is issued to the new owner.
The Permittee shall retain a set of Division approved plans and specifications for the life of the
facilities permitted herein.
7. The Permittee shall maintain this permit until all permitted facilities herein are properly closed or
permitted under another permit issued by the appropriate permitting authority pursuant to 15A NCAC
02T .0105G).
8. This permit is subject to revocation or unilateral modification upon 60 days notice from the Division
Director, in whole or part for the requirements listed in 15A NCAC 02T.01 10.
9, Unless the Division Director grants a variance, expansion of the permitted facilities contained herein
shall not be granted if the Permittee exemplifies any of the criteria in 15A NCAC 02T .0120(b).
10. The Permittee shall pay the annual fee within 30 days after being billed by the Division. Failure to
pay the annual fee accordingly shall be cause for the Division to revoke this permit pursuant to 15A
NCAC 02T .0105(e)(3).

a Effluent sample location for all parameters except turbidity and fecal coliform shall be sampled at the effluent sampling point associated with NPDES permit
NC0026051. Fecal coliform sampling shall be sampled at the bulk fill station.
b Sampling frequency is set to match NPDES permit sampling frequency. Sample results associated with NPDES permitting requirements can be used for meeting
the sampling requirements for this permit as long as the sampling locations remain the same in both permits. The County may request reduced sampling
frequency for parameters with sampling frequencies matching the NPDES monitoring frequencies.
Monthly average for fecal coliform shall be a geometric mean.
d Turbidity sampling shall be performed immediately prior to all bulk filling procedures. Recorded turbidity meter results shall be documented and maintained
with each bulk filling event. The highest turbidity value recorded for each day of operation shall be reported.
The effluent pH shall not be less than 6.0 standard units nor greater than 9.0 standard units
r Submittal of monitoring data during time periods where no bulk reclaimed water is distributed is not required. The Perinittee must still indicate zero flow on the
DMR for the appropriate time period.

Fire fighting and fire extinguishing
Must meet Public Water Supply requirements
Reclaimed water distribution line pressure testing
Provided the water is returned to the sanitary sewer, or used for other approved reclaimed
water uses after testing.
Sewer cleaning (not washing)
Street sweeping (not street cleaning)
Vehicle and equipment washing
Provided that no ponding or run-off of the reclaimed water occurs.
For use by certified bulk reclaimed water users.'
Concrete cutting
Decorative ponds and fountains that drain to sanitary sewer systems
Hydro -seeding and fertilizer mixing
Industrial and commercial cooling water or boiler blow down water
Provided that cooling water or boiler blow down water is disposed of according to any
necessary dis osal pen -nit.
Industrial and commercial fire prevention systems where there are separate
non -potable plumbing lines
Irrigation of public and private landscapes and turf
Make-up water for brine slurry or similar
Brine slurry to be applied to roads to prevent freezing. Brine solutions using reclaimed
water are exempt from maximum hold time prior to use established in Condition III.5.a.viii
of this permit

Use of reclaimed water does not exempt user from meeting the use and disposal
Make-up water for preparation of pesticide solutions or similar
requirements of the created solution. Pesticide solutions using reclaimed water are exempt
from maximum hold time prior to use established in Condition III.5.a.viii of this permit.
Non -potable processes such as concrete production and compost production
Must meet compost permit requirements.
Soil compaction and dust suppression
May including irrigation to clay or synthetic clay tennis courts, or similar.
Subsurface Directional Boring
Does not include borings into bedrock or installation of any wells subject to 15A NCAC 2C
- Well Construction Re ulations.
Vehicle washing and power washing
Provided that dual disinfection with UV and chlorination is provided, and that no ponding or
run-off of the reclaimed water occurs.
'All users, either under control of Permitee or not must complete educational training and receive certification prior to receiving bulk reclaimed water from the permitted facility.
