Dear Mr. Riddick, Jr.:
On August 19, 2005, you requested a 401 Water Quality Certification from the Division of Water
Quality (DWQ) for your project. We wrote to you on September 23, 2005 discussing concerns that
we have regarding the design of the project and stating that it would be placed on hold for three
weeks giving you time to address DWQ's concerns. As of today, DWQ has not received a response
to this request. Therefore, your file is hereby considered withdrawn and will not be reviewed until
DWQ's earlier concerns are addressed. Once you have collected sufficient information to have a
complete application (please see our September 23, 2005 letter for the missing information), you will
need to reapply for DWQ approval. This includes submitting a complete application package with
the appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this
activity and any work done within waters of the state would be a violation of North Carolina General
Statuses and Administrative Code. Please call Mr. Ian McMillan at 919-715-4631 if you have any

Dear Mr. Riddick:
On August 19, 2005, the Division of Water Quality (DWQ) 401 Oversight/Express Review Permitting
Unit received your Variance Request Form dated July 14, 2005 regarding your request for a Minor
Variance from the Neuse Buffer Rules (15A NCAC 2B .0233) for the subject property. The Division of
Water Quality (DWQ) is required to prepare a "preliminary finding" /"finding of fact" as to whether the
variance request meets the requirements of 15A NCAC 02B .0233(9)(a). The DWQ may attach
conditions to a variance approval that support the purpose, spirit and intent of the riparian buffer
protection program. Conditions usually include stormwater management and buffer mitigation.
Additional information will be required before we can proceed with the review of your variance request.
Therefore, unless additional information is provided as described below, we will have to move toward
denial of your request per 15A NCAC 2B .0233 and will place this project on hold as incomplete until we
receive this additional information.
Additional Information Requested:
1. Buffer Mitigation
Buffer mitigation will most likely be required as a condition if you choose to proceed with either
the Minor or Major Variance. If you choose to proceed with a variance, then please provide a
buffer mitigation plan pursuant to 15A NCAC 02B .0233.
2. Stormwater Management
Stormwater management will be required as a condition if you choose to proceed with either the
Minor or Major Variance. Please provide a detailed stormwater management plan depicting how
you intend to treat the stormwater running off the proposed impervious surfaces.

3. Avoidance and Minimization
• It is unclear to this office why the additional impact is needed. The existing deck is
approximately 1/3 the size of the house footprint. Please consider screening in a portion
of the existing deck or screening in an area to the east of the existing deck.
• The variance request form request additional impacts than that are shown on the plan.
This plan should be drawn to scale, please draw accurately.
Please respond in writing within three weeks of the date of this letter by sending a copy of this
information to me and to Eric Kulz of the DWQ Raleigh Regional Office at 3800 Barrett Drive, Raleigh,
NC 27609. If we do not hear from you in writing within three weeks, we will assume that you no longer

Re: Wishing Well S/D Lot 22 (20051601), I looked at this when the contractor first
found out about the buffer. The foundation and several rows of cinder block were
already up. They were at first going to move the structure, but due to the presence
of some large hardwood trees, it looked like any place they moved it to would
probably damage the roots of the trees. I really don't have a problem with this one,
although they did buy the house in 2002 (not that anyone would have told them about
the buffer rules).
Re: William Riddick (20051595) I will get out to look at this after the travel
restrictions are lifted.
