A third party of neighbors, the Davises, were not able to attend. Danny went to great lengths to explain the Buffer Rules, as well at his many experiences with the Attorney General's Office in interpreting 401 and Buffer Authorization conditions. John Dorney discussed his many years of involvement in the overall Beacon Hill development which was required due to onsite violations (now in compliance). All parties at the table concurred that the developer was a Bad Actor. The final three lots (248, 249 and 250) are being developed by another party altogether, Noel Taylor (not of Taylor's Nursery, a prior contestant in the Beacon Hill situation). Noel Taylor had previously visited the neighbors personally and Mr. Buddenberg even noted that Taylor was congenial and brave for "going into the lion's den." In years past, Joe Albiston (then of the RRO) had met with Mr. Powell and explained to him that he could not fill the stream and remove its associated buffer on Mr. Powell's property. Mr. Powell's interpretation was that he was stopped from pursuing an impact that had been allowed to Mr. Taylor. We explained in detail the differences between an allowed use (driveway crossing to access lot 250) versus stream fill to remove a slope from the back of one's lot. Based upon careful review of all the file materials for all of Beacon Hill, including the variance issued for lot 249 and the crossing (not a variance) for lot 250, we determined that the authorizations issued to Mr. Taylor were legal and supportable. Over the years Dorney and Bob Zarzecki had tried to persuade the Beacon Hill developers to voluntarily not develop Lot 250, but the fact is that it is an upland wedge that is not part of a legal conservation easement, mitigation plan, or otherwise under our jurisdiction. The fact is that there's a stream that has to be crossed to access it for development. None of the documents which could be used to determine what is permitted, namely, the various buffer and 401 authorizations, would prohibit access to lot 250, nor could we legally prohibit access to this upland property. Mr. Buddenberg and Mr. Powell had pointed to a couple of emails (including one from the City) that they interpreted as prohibiting use of Lot 250, but we think we got them to understand that these would not constitute real application materials. It is important to note that the condition within the variance for lot 249 which does not permit access to lot 250 was intended as a reminder to the applicant that he did not YET have access to lot 250. He had not applied for the crossing to lot 250 within that application. We can't deny a crossing that an applicant has not technically even applied for. And as a reminder, a real denial would have to go to the Director for signature. We think it ended relatively well. Mr. Powell and Mr. Brandenberg are clearly not pleased, but we think they have a better understanding of the rules and the actions we took. They may or may not pursue a civil suit against the developers, depending on whether or not they want to invest the money. Mr. Brandenberg did say that he no longer would plan to chain himself to a tree on Monday to block the construction workers. You requested approval for lots 248 and 249 in exchange for not constructing a home across the tributary stream to lot 250. As stated previously in our last field visit, we are willing to approve this notification in concept. However the Neuse River buffer rules apply to this tributary as stated in our previous correspondence. Please clearly show 1) the stream, 2) building envelopes for these lots and 3) fill slopes for these lots so we can determine whether a Minor Variance will be needed for this construction. Also the area shown previously as lot 250 is now labeled "reserved by owner" with a 10' wide greenway access easement and an unlabeled 10' wide adjacent corridor to this lot. Our agreement in the field was that lot 250 would not be built upon and the stream would not be crossed with a driveway. In order for us to issue the need Notification, we strongly suggest that the area of lot 250 and the access corridor be formally proposed as open space in a similar manner to other open space on the plat labeled "proposed PH7 Open Space". Why is a minor variance needed for lot 249? Response: The building envelop for lot 249 is too shallow for the lot to be buildable without the requested variance. A variance will allow a normal, rectangular house footprint on the lot along while allowing working space for the construction of the house. 2. Where will the houses be built for lots 247 and 248, and can they be built without disturbing zone 1 of the protected buffer? Response: They will be constructed within the shown envelopes without disturbing the Zone 1 of the protected buffer. 3. Do you plan to eliminate your application for driveway access to lot 250 as agreed in the field? Response: It is the intent of the Mr. Marlowe to eventually sell this lot to the adjacent property owner.
