Street New Bern, NC, 28560 APPROVAL of 401 Water Quality Certification Dear Ms. Meldau: You have our approval, in accordance with the attached conditions, to place fill in and dredge 0.70 acre and to usurp 12.93 acres of non-vegetated wetlands in order to redevelop a commercial marina at the B Street Marina in Craven County, as described in your application received by the Division of Water Quality on June 25, 2002. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when it Is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. PROJECT SUMMARY: Applicant proposes to redevelop a commercial marina with a clubhouse, travel lift, boatramp, parking area, and boat and fiberglass fabrication shop with proposed excavation adjacent to the travel lift and boatramp. B Street Marina c/o Rhoda and Frank Meldau Craven County Project Setting The applicant owns a 2.54-acre parcel of land adjacent to the Neuse River in Bridgeton, Craven County, North Carolina. The property is located at 1101 B Street off of US Highway 70 on the west side of Bridgeton. The site is the previously permitted Cypress Point Marina, which was permitted in 1995 after going through the SEPA process. The original marina included three 732' long piers with slips for 202 vessels, and occupied approximately 5.5 acres of public trust waters. The property is bordered on the north by the Norfolk and Southern Railroad trestle and right-of-way. B Street, a two lane paved road, forms the eastern property line. A construction company owns the property west of B Street, which is used for storage of equipment and vehicles used by the company. The property to the south of the project area is a developed residential lot, vegetated with mixed upland grasses, scattered pine trees and wildflowers. The shoreline of this lot has not been hardened. The project property has a shoreline of 1,119 linear feet on the Neuse River. The high ground areas are vegetated with a mix of upland grasses with scattered shrubby wax myrtles. There is a fringe of delineated 404 Wetlands along the shoreline, and an existing retaining wall demarcates the upland/wetland border. Coastal wetland species vegetate portions of the shoreline waterward of the retaining wall and 404-wetland fringe. Coastal wetland species include Spartina patens and Juncus roemerianus. The shoreline is a gently sloping sand bottom with no visible erosion problem. Elevation of the property is 9 feet. The site contains a 40' by 100'metal building and 119' by 35' concrete pad that were the site of some commercial activity in the past. There were bathhouse and storage buildings on the site that have recently been removed. Railroad timbers delineate an existing 115' by 140'gravel parking area. Portions of piers designed to support a travel lift are waterward of the retaining wall, approximately 60' from the northern property line. A concrete boatramp is located between the travel lift piers. Four foot wide slatted wooden walkways line the landward side of an existing retaining wall from the existing travel lift area to the southern property line. There are several areas where the fill behind the retaining wall has washed out, and the north end of the wall was not completed. Portions of the originally permitted docks remain, but are in poor condition. There are approximately 84 fixed slips associated with the remaining dock structures. There are scattered hunks of concrete approximately 10' waterward of the normal water level (NWL) on the southern end of the project area. The existing marina structures extend 475 feet offshore and occupy approximately 118,750 square feet of public trust waters. The piers and fingers shade 9,651 square feet of river bottom. Water depths in the project area range from 1' at the shoreline to -10'NWL at the most waterward point of the proposed work. There are areas of submerged aquatic vegetation close to the shoreline adjacent to B and C Docks. The vegetation drops off quickly as water depth increases, and extends approximately 10 feet waterward of the normal water level. At this location, the Neuse River is classified SA HQW NSW by the Environmental Management Commission. It is closed to shellfish, and is classified as a joint waterbody by the NC Wildlife B Street Marina Craven County Page 2 Resources Commission and the NC Division of Marine Fisheries. The property is located in the Neuse River Basin. Project Description The applicant proposes to upgrade and expand an existing marina facility and to construct a custom fiberglass and boat manufacturing facility at their property. The project area would be expanded into the adjacent lot, currently owned by Mr. Zack Taylor and leased to B Street Enterprises. They propose to replace the existing fixed pier structures with floating docks, and to install wave attenuators on the docks on the north, south, and west sides of the marina. The marina would consist of four pier structures, and an independent floating wave attenuator. The pier widths are proposed wider than 6' to create stability for the wave attenuators and to allow safe use by the public. Dock A would be located 30' south of the Norfolk and Southern Railroad trestle and would be 1085' long by 10' wide with a 12' by 124' L-head at the waterward end. Dock A and its associated platform would be constructed to act as wave attenuators. Dock A would have seven 28' by 4' finger piers, and fifteen 43' by 4' finger piers on its southern side, creating slips for 45 vessels. Water depth is 9.5' at the waterward end of the proposed structure. B Dock would be positioned 145' south of A Dock. It is proposed to be 752' long and 8' wide with a 10' by 96' T-head at the waterward end. It would have five 28' by 4' finger piers, six 33' by 4' finger piers, eight 38' by 4' finger piers, and eighteen 43' by 4' finger piers, providing slips for 76 vessels. Water depth at the end of the proposed T-head is 8.9'. C Dock would be similar to B Dock, and would be positioned 160' south of B Dock. The total length would be 598' with a width of 8'. A 10' by 104' T-head is proposed at the waterward end of the structure. C Dock would have five 33' by 4' finger piers, four 38' by 4' finger piers, and eighteen 48' by 4' finger piers. There would be 55 slips associated with C Dock. The water is 9.5' deep at the waterward end of the proposed T-head. D Dock and its associated platform would be constructed to act as wave attenuators, and would provide protection to the south side of the marina area. It is proposed to be 678 ` long and 12' wide. It would have a 12' by 148' L-head, with the L facing to the north. The applicant proposes to place fuel pumps on the L platform. There are twelve finger piers proposed on D Dock, two 33' by 4', two 43' by 4', and eight 53' by 4', creating slips for 25 vessels. By DCM calculations, the total number of slips on all four docks is 201. The three-slip difference in number of total slips from what the applicant describes is based on differences in the definition of a slip. Water depth is 9.8' at the waterward end of the proposed structure. The applicants propose to conduct maintenance excavation in an area adjacent to the travel lift, and to install a new boatramp on the southern portion of the project area using a clamshell excavator and B Street Marina Craven County Page 3 barge. These activities would result in the excavation of 29,570 square feet of estuarine river bottom that will be disposed of on the high ground portions of the property. If permitted, the 20' by 6' piers for the travel lift will be repaired, and two 58' long wooden groins will be constructed to help keep the newly excavated area open. The groins will be placed immediately adjacent to the travel lift. The existing concrete boatramp under the travel lift will be removed during excavation. There are scattered hunks of concrete approximately 10 feet waterward of the shoreline on the southern potion of the tract. The applicant proposed to move those hunks to the approximate normal water level, and to cover them with granite riprap. The riprap would be positioned 3 feet waterward of the NWL. The riprap would extend from the southern end of the existing retaining wall to a point 20' south of where D Dock intersects the land. A 17' by 20' boatramp with an associated 3' by 30' launch pier are proposed for the south side of the project area. The new boatramp would be connected to the existing parking area by a 15' wide gravel drive. The drive would also provide access to the proposed elevated fuel tanks on the property. The applicant proposes to extend the 8' wide wooden boardwalk from the southern end of the existing retaining wall to connect with the fixed portion of D Dock. The walkway would also be extended on the northern side of the property from the landward end of B Dock to the landward end of A Dock. All of the proposed additions to the boardwalk would be located within 50' of NWL. Two 4' wide concrete tracks are proposed from the existing concrete pad to the travel lift piers. This would allow easier movement of the travel lift. The existing electrical building would be moved and enlarged to house a dockmaster's office. An addition is proposed on the metal building to house offices and restroom facilities for the fiberglass fabrication operation. The inside of the existing building will be remodeled to accommodate this commercial operation. The largest portion of the proposed upland development involves the construction of a clubhouse building. The clubhouse would be 4,000 square feet, with a 3,850 square foot wooden deck. The clubhouse would contain showers, a snack bar, and ships store. The clubhouse would be connected to the fiberglass facility, B Dock, and C Dock by 8' wide wooden walkways. An additional walkway will form the western border of the parking area, and will extend from the parking area to the end of the existing retaining wall. The clubhouse, deck, and addition to the existing metal building will be outside the 50' EMC Neuse River Basin Buffer area. Anticipated Impacts The proposed marina would extend 1,085 feet waterward of the NWL and would usurp 563,115 square feet of public trust waters. The floating piers and fingers would shade 53,290 square feet of river bottom. The increased access pier width will result in the applicant exceeding the "4 square foot rule" limitation by 48,814 square feet. This limitation is based on shoreline length. According to rule, any portion of the structure that is greater than 6' wide is calculated into the platform square footage. The proposed riprap would fill 690 square feet of shallow bottom, and the boatramp would fill an B Street Marina Craven County Page 4 additional 340 square feet. If permitted, approximately 29,570 square feet of Neuse River bottom will be excavated to allow operation of the travel lift and to site the boatramp. The applicant does not propose any slips in water less than -4' NWL, and no excavation is proposed in the area containing SAV's. Therefore, any impact to submerged aquatic vegetation should be negligible. Approximately 39,000 square feet of upland area will be filled, graded, or disturbed during construction of the proposed facilities. The walkways would cover 1,065 square feet of upland, and the proposed fuel talks would cove an additional 216 square feet. The 15' wide gravel road would impact approximately 6,000 square feet. Construction of the clubhouse will result in the loss of 4,000, and the deck would cover an addition 3,865 square feet. The applicant proposes a 1,600 square foot addition to the existing metal building, and proposes 210 square feet of impact when installing the access strips to the travel lift. The proposed extension of the retaining wall, and additional riprap at the northern property line would result in the filling of 500 square feet of upland. The parking area will be reconfigured, but will not change in size. Approximately 14,000 square feet of upland will be graded and landscaped. These areas will be stabilized and vegetated with grasses and landscape plants. Existing impervious surface covers approximately 2,087 square feet within the 75' CAMA AEC. The proposed upland development would result in a 520 square foot reduction in impervious coverage. The applicant has already received approval from the Town of Bridgeton to connect to the existing sewer system, and the Town has granted a variance to allow operation of the fiberglass and boat fabrication facility. Temporary short-term turbidity increases may occur during the proposed construction. Tracey L. Wheeler -18 June 2002 Project Narrative B STREET MARINA Craven County OO In the fall of 2001, the extended Meldau family became interested in the redevelopment of the Cyprus Point Marina in Bridgeton, NC on the Neuse River. Cyprus Point is a previously permitted 202-slip marina owned by Willie Stallings that was foreclosed on by the bank. The site is heavily impacted and in great disrepair. Cyprus Point Marina was originally permitted for 4 docks with 202 slips. The permit was granted, but the original marina was not properly designed. The water area, 7.5 acres, was not great enough; consequently the fairways are not wide enough, docks and fingers are too narrow and pilings are not properly placed. Wave attenuation was ignored. After several storms, only two docks (B and C) remain with 72 slips and part of third dock (A) is in place. At this time, we are proposing to redevelop the site to create a 198-slip marina. The new facility will be named B STREET MARINA. The family members will own and operate the businesses at the site. These businesses will include the marina, ships store, snack bar and a small boat and custom fiberglass fabrication shop. In order to create this marina as a safe and pleasant harbor, the original project area will need to be enlarged to 12.8 acres. Moving the original D dock down 107' along the shore will open the fairways to a safe and useable width. Rebuilding A dock, making the dock a wave attenuating dock and extending it 200' will protect the inner harbor from the Northwest wind. D dock will also be a wave attenuating dock to protect the marina from the Southwest wind. These floating wave attenuator docks are professionally designed and engineered to easily allow the passing of water and do not touch the bottom of the river. These floating attenuators coupled with the extension of the fixed dock out from the shore should greatly diminish impact on water quality and the shore environment. B Street is proposing docks wider than 6 feet. The 10' and 12' design width is necessary for the floating wave attenuating docks to be successful. Also public safety is a concern with narrow docks. The proposed 8' width would allow safe passage of people with supply carts, people in wheelchairs, and people on bikes; and space would be available for temporary storage lockers, gear and supplies. The existing part of A dock will need to be removed; however, with repair dock B and C could slip boats while construction of the marina proceeds. Eventually, dock B and C will need to be completely replaced; floating docks are planned. Dredging was allowed at this site under the original permit. We propose only maintenance dredging. B Street Marina will welcome motor and sailing yachts with provision for large multihulls. The marina will offer slips for lease and slips for transients. With the completion of the travel lift area, B Street can offer haul out and repair; a greatly needed service in the area. The existing building will be used for repairs that need to be done inside for control of industrial type pollutants. Easily accessible fuel services on the Neuse River are needed in this area and are planned at B Street. A van and water taxi service to New Bern will be pursued. In the design and development of the land site, care has been taken to meet all of the regulations and environmental concerns. Our plan reduces the on site impervious area to 31 %. A single well- planned building will house a ships store with favored and required BMP supplies, an office, a snack bar, lounge area, and a bathhouse with laundry. The small boat and custom fiberglass fabrication business will occupy part of the existing building. This company builds the Isotope and Cheshire Catamarans and hopes to add new fleets to the local regattas and to service small sailboats. Keeping in mind the importance of the environment and preserving natural resources, our plan is to create an attractive and safe marina offering needed services, employment and water recreation to the community.
