The Subject application has been reviewed for water
quality impacts and the following comments are offered:
a. The proposed project does require a 401 Water
Quality Certification but does meet the
requirements of General Certification No. 1273 for
discnarge of l?quid?ffluerrt-from-ar?txpland-c?rk-a
disposal area.
b. According to information from Shellfish
Sanitation, an additional 25 feet of closure in
open shellfishing waters will occur should the
expansion of the marina to 57 slips be approved.
C. Information from the Division of Marine Fisheries
indicates that Brown Creek has an existing
shellfish resource. While the additional area to
be closed does not contain a shellfish resource,
other areas nearby which do have an existing
shellfish resource may likely be affected by
pollutants from the expanded marina. If these
areas are eventually closed due to the marina,
Antidegradation Policy would be violated.

d. Should the expansion be allowed, the following
should be addressed in the CAMA permit:
1. Any discharge of sewage into these SA waters
is prohibited and would be a violation of SA
water quality standards.
2. A locked-head policy shoul d be required and
strictly enforced.
3. A pumpout facility should be available and
signs posted on the docks notifying users of
the locked-head policy and location of the
pumpout.
4. Live-aboards should not be allowed.
5. Development on shore which is not included in
this application should be submitted as a
major modification so that stormwater
evaluations can be made.

Dear Mr. Cowden:
On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (copy enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received April 5, 1988, for
Department of the Army authorization to maintain a basin and
construct additional boat slips at commercial marina facilities on
Brown and Coffey Creeks, near Whortonsville, in Pamlico County,
North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the

by the North Carolina Division of Coasta anag mt: -Gemme-n*G____
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be informed regarding its further
management. If there are no unresolved differences in State-
Federal positions or policies, the final action taken on your
application by the State will result in your receiving written
notice from us that your application is consistent with the
general permit and you may commence your activity. Only after
receiving such confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act, has been assigned No. SAWC088-N-069-0268 and will be
coordinated by Mr. Ernest Jahnke. He is available at telephone

8. PROJECT SUMMARY: Applicant proposes to expand existing marina from
31 slips to 57 slips and perform maintenance dredging.

9. NARRATIVE DESCRIPTION: The applicant's'property is a 1.5
acre tract located at the end of SR 1326, near Brown and
Coffey (Lindsey) Creeks, near Whortonsville, in Pamlico
County. The property has been historically used primarily
as a fish processing and shipping facility. However, it
appears the project is making the transition from a
commercial fishing operation to a commercial marina.
The applicant received CAMA/Dredge & Fill Permit #85-85, on
June 11, 1985, and all new proposed work under this new
application is for a revised major modification to the
existing permit. Also, a CAMA Minor Development Permit for
piling placement was issued several years ago. The current
Major Permit #85-85, and a prior modification authorized a
241' bulkhead, pier expansion, and finger pier construction.
The waters of Browns Creek and Lindsey Creek are designated
as Primary Nursery Areas by the Division of Marine
Fisheries. The existing main pier is situated outside of
the Primary Nursery Areas, but the'existing dock on the east
side is located within the nursery area of Lindsey Creek.
There is a 150' area extending from all of the existing
docks which is closed (effective 3/14/88) to shellfishing by

to the marina are classified "SA" by the Division of
Environmental Management.
The applicant proposes to perform maintenance dredging with
a hydraulic dredge in a 300' x 200' area, and remove
approximately 10,444 cu. yds. of material. The existing
water depths range from 1' to 5Z' to 61. The applicant is
requesting a uniform depth of -6' normal water level (NWL).
The spoil materials are proposed to be pumped to farmland
east of the project. A portion (approximately 250' x 101)
of the proposed maintenance dredging is within the Primary
Nursery Area of Lindsey Creek.
The proposed maintenance dredging area has reportedly been
dredged in the past but no permits exists under the previous
owner's name, Wilson Whorton.
In addition to the "maintenance" dredging, the applicant
also proposes to increase the number of slips from the
current number of 31 up to a total of 57 slips. This
request will increase the effective length of the pier (by
tie pilings extending out 40' from the existing pier) to a
total of 305' from the bulkhead. The proposed increase in
the number of slips is to be accomplished by adding .
approximately 46 new tie pilings and 12 new finger piers.

10. ANTICIPATED IMPACTS: The proposed hydraulic dredging will
disturb approximately 60,000 sq. ft. of shallow water
bottom and place approximately 10,444 cu. yds. of sand, clay
and mud on a diked spoil disposal area in an existing
agricultural field.
Productive shellfish areas have been delineated by the
Division of Marine Fisheries in Browns Creek within 3/4 of a
mile of this proposed project.
The proposed new slips will increase the existing 31 slips
to 57 slips total. The new slips will be created by the
placement of 46 new tie pilings and 12 new finger piers.
The water depths of the total proposed project is proposed
for -6'NWL. The proposed tie pilings which would be placed
40' out from the existing pier could possibly create some
navigational problems for in and out of Lindsey Creek.
No wetlands are proposed to be excavated or filled, and at
this time, no new upland development is proposed.

In addition to the completed application form, the
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 V2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7).0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's usse of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.

9. NARRATIVE DESCRIPTION: The applicant's property is a 1.5
acre tract located at the end of SR 1326, near Brown and
Coffey (Lindsey) Creeks, near Whortonsville, in Pamlico
County. The property has been historically used primarily
as a fish processing and shipping facility. However, it
appears the project is making the transition from a
commercial fishing operation to a commercial marina.
The applicant received CAMA/Dredge & Fill Permit #85-85, on
June 11, 1985, and all new proposed work under this new
application is for a revised major modification to the
existing permit. Also, a CAMA Minor Development Permit for
piling placement was issued several years ago. The current
Major Permit #85-85, and a prior modification authorized a
241' bulkhead, pier expansion, and finger pier construction.
The waters of Browns Creek and Lindsey Creek are designated
as Primary Nursery Areas by the Division of Marine
Fisheries. The existing main pier is situated outside of
the Primary Nursery Areas, but the existing dock on the east
side is located within the nursery area of Lindsey Creek.
There is a 150' area extending from all of the existing
docks which is closed (effective 3/14/88) to shellfishing by
the Division of Health Services. All other water-s_adj-acer?t ----

Environmental Management.
The applicant proposes to perform maintenance dredging with
a hydraulic dredge in a 300' x 200' area, and remove
approximately 10,444 cu. yds. of material. The existing
water depths range from 1' to 52' to 6'. The applicant is
requesting a uniform depth of -6' normal water level (NWL).
The spoil materials are proposed to be pumped to farmland
east of the project. A portion (approximately 250' x 101)
of the proposed maintenance dredging is within the Primary
Nursery Area of Lindsey Creek.
The proposed maintenance dredging area has reportedly been
dredged in the past but no permits exists under the previous
owner's name, Wilson Whorton.
In addition to the "maintenance" dredging, the applicant
also proposes to increase the number of slips from the
current number of 31 up to a total of 57 slips. This
request will increase the effective length of the pier (by
tie pilings extending out 40' from the existing pier) to a
total of 305' from the bulkhead. The proposed increase in
the number of slips is to be accomplished by adding
approximately 46 new tie pilings and 12 new finger piers.

10. ANTICIPATED IMPACTS: The proposed hydraulic dredging will
disturb approximately 60,000 sq. ft. of shallow water
bottom and place approximately 10,444 cu. yds. of sand, clay
and mud on a diked spoil disposal area in an existing
agricultural field.
Productive shellfish areas have been delineated by the
Division of Marine Fisheries in Browns Creek within 3/4 of a
mile of this proposed project.
The proposed new slips will increase the existing 31 slips
to 57 slips total. The new slips will be created by the
placement of 46 new tie pilings and 12 new finger piers.
The water depths of the total proposed project is proposed
for -6'NWL. The proposed tie pilings which would be placed
40' out from the existing pier could possibly create some
navigational problems for in and out of Lindsey Creek.
No wetlands are proposed to be excavated or filled, and at
this time, no new upland development is proposed.

Reference the application of Sound Packing Company,
represented by Mr. Bob Cowden, for a Department of the Army permit
to maintain a basin and construct additional boatslips at
commercial marina facilities on Brown and Coffey (Lindsey) Creeks,
near Whortonsville, Pamlico County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. All excavated materials will be confined landward of the
normal water elevation contour within adequate dikes or other
retaining structures to prevent spillover of solids into any
vegetated wetlands or surrounding waters.
b. The terminal end of the pipeline from the dredge into the
diked retention area will be positioned at or greater than 50 feet
from any part of the dike and a maximum distance from spillways to
prevent dike erosion and to allow adequate settlement of suspended
solids.
c. A water control structure will be installed at the intake
end of the effluent pipe leading from the retention area in order
to ensure maximum settlement of suspended solids.

d.' Flow from the diked retention area will be confined by
pipe, trough, or similar device to a point at or below the normal
water elevation contour to prevent gully erosion and siltation.
e. No vegetated wetlands will be excavated or filled.
f. Excavation will not exceed 6 feet below the elevation of
normal water.
g. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of this
permit. The permittee`is not relieved of this requirement if he
abandons the permitted activity without having it transfered to a
third party.
h. The authorized structure and associated activity will not
cause an unacceptable interference with navigation.
i. The activity will be conducted in such a manner as to
prevent a significant increase in turbidity outside the area of
construction or construction-related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less are not
considered significant.
