NOTICE OF FILING OF
APPLICATION FOR CAMA MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Natural Resources and Community
Development hereby gives public notice as required by NCGS
113A-119(b) and 143-215 3(a)(1)(c) that North Topsail Water &
Sewer, Inc. of Onslow County, filed an application on November 9,
1987, for a permit from the Division of Coastal Management to
develop in an Area of Environmental Concern and for certification
from the Division of Environmental Management that a'discharge of
fill material in project wetlands will not violate applicable
water quality standards.
According to said application the applicant is proposing to
expand their service area by constructing a waste water collection
system which will provide sewage service., to additional areas of
Topsail Island in Onslow County. A part of their application
request includes a subaqueous crossing of the AIWW and adjacent
wetland areas.
A copy of the entire application and additional information
may be examined (or copies furnished upon request and payment of
reproduction costs),during normal business hours at the office of
Charles S. Jones, Division of Coastal Management, located in the
Division of Marine Fisheries Building, Morehead City, N.C.,
919/726-7021, and/or the office of Preston Howard, Division of
Environmental Management, NRCD Regional Field Office, Wilmington,
N.C., Telephone (919) 256-4161.
The Division of Environmental Management proposes to take
final action on this water quality certification on or before
February 22, 1988. The issuance of the CAMA Major Development
permit and the Section 401 Certification may deviate from this
projected date depending upon the nature of the comments
submitted and subsequent hearings that may result.
All persons desiring to make comments should do so in
writing to Mr. David Owens, Director, Division of Coastal
Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
February 12, 1988 for consideration in the CAMA permit decision,
and to Mr. Bill Mills, Division of Environmental Management, P.O.
Box 27687, Raleigh, N.C., 27611, prior to February 12, 1988 for
consideration in the water quality certification decision. Later
comments on the CAMA application will be accepted and considered
up to the time of permit decision. Project modifications may
occur based on review and comment by the public and state and
federal agencies. Notice of the permit decision in this mattcr
will be provided upon request.

Your letter to Paul Wilms of February 15, 1988 was
received in our Director's office on February 19. It
reached my desk on February 25. We had issued the 401 Water
Quality Certification on February 24. As a result the
comments you submitted and request for public hearing on the
401 Certification were not considered prior to issuance of
the Certification. A review of your objections
after-the-fact does not indicate that any different decision
or different conditions would have been made on the
Certification for this project.
As you will notice in the Public Notice for this
project, comments on the certification were to have been
made prior to February 12, 1988. Comments should have been
submitted to me as prescribed in the notice since I have
been delegated signature authority for the Director in these
certifications. In the future it would be helpful to submit
a copy of your comments directly to me if you wish to

Enclosed is a letter that we have submitted to comment on North
Topsail Sewer and Waters, Inc. application to construct a
pipeline under Stump Sound. As I'm sure you are aware, these
are waters that are currently being considered by the NC
Environmental Management Commission for classification as
"Outstanding Resource Waters." Construction of this crossing
will violate the water quality standard for turbidity and alter
a designated primary nursery area.
We request that you provide a negative comment on this project
to the NC Division of Coastal Management. An underwater
pipeline cannot be inspected and will eventually endanger the
high quality waters in this area. A clear alternative is to
suspend the pipeline such as is frequently done with
powerlines.
If you are considering issuing a favorable comment on this
project, we request a public hearing before you make any final
determinations.

We have reviewed the application submitted by North Topsail
Sewer and Waters, Inc. to construct a subaqueous crossing for
24" diameter force main under Stump Sound. The permit should
be denied for the following reasons:
1) Pipeline Not a Water Dependent Use: According to 7H
.0208(a)(1), uses which are not water dependent will not
be permitted in coastal wetlands, estuarine waters, and
public trust waters. While the rule states that "utility
easements" may be water dependent, 7H .0208(a)(2)(B)
states that you must determine that no suitable
alternative site or location outside the AEC exists for
the use. One clear alternative is to suspend the pipeline
in the air and avoid all construction impacts to Stump
Sound. This would also allow for easy inspection of the
pipeline whereas an underwater line cannot be inspected at
all.
2) Turbidity Standard Will Be Violated: Dredging will
violate the water quality standard for turbidity.
Therefore, 7H .0208(a)(2)(C) will be violated which states
that a 'permit cannot be issued if water quality standards
are violated.
3) Primary Nursery Area Should Not Be Dredged: The waters on
either side of the Intracoastal Waterway are designated as
a Primary Nursery Area by the NC Division of Marine
Fisheries. These highly productive waters should not be
dredged.
4) Inappropriate Use of Outstanding Resource Waters: A
petition that these waters should be considered as
Outstanding Resource waters has been accepted by the NC
Environmental Management Commission. While in the
hearing process, no development that will cause any
degradation to these waters should be permitted. Sewage
pump stations and pipeline, which will eventually
breakdown and leak, are no more appropriate near
Outstanding Resource Waters than are engineered stormwater
systems. While in the hearing process, the Environmental
Management Commission has ruled that engineered stormwater

systems are not to be allowed within 575 feet of these
waters.
In conclusion, this underway pipeline would require extensive
physical alteration of these high quality estuarine waters.
Clear alternatives to an underway line exist. Future
breakdowns of pump stations and leakage of the force main will
jeopardize the existing uses of these waters. Secondary
impacts of the sewage system should also be considered as part
of this permit review since it is being constructed by private
developers to facilitate their own private development
proposals.
Please notify us immediately of any modifications or permit
decisions made in regard to this application.

Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to North Topsail Water and
Sewer, Inc. pursuant to an application filed on the 8th day of January,
1988 to construct additions to the sewage collection system including a
crossing of the AIWW near NC 210.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of Atlantic
Intracoastal Waterway in conjunction with the proposed sewer line
crossing in Onslow County will not result in a violation of applicable
Water Quality Standards and discharge guidelines. Therefore, the State
of North Carolina certifies that this activity will not violate Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as to prevent
significant increase in turbidity outside the area of
construction or construction related discharge (increases such
that the turbidity in the Stream is 25 NTU's or less are not
considered significant).
2. That the project be performed during periods of low biological
activity, coordinated through the N.C. Division of Marine
Fisheries.
3. That the backfill material shall be of such quality so as to
not to create turbidity violations in the area of the proposed
project.
4. That construction of the collection system must be authorized
by this Division prior to commencement of construction.
5. That silt fences and/or other sedimentation control devices
shall be employed to minimize erosion, sedimentation, and
turbidity in and near wetland areas.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

North Topsail Water and Sewer, Inc.

The applicant proposes to construct a sub-aqueous sewer line
beneath the AIWW and adjacent wetlands on the southside of the
N.C. Highway 210 bridge on North Topsail Island. The proposed
collection system will consist of approximately 12 miles of
gravity sewer and force main from 12 inch to 24 inch diameter and
4 lift stations. The area of construction is from within 2 miles
of the Pender County line, north easterly along Highway 210, then
across the AIWW south of the 210 bridge and along 210 to the
existing North Topsail Water and Sewer, Inc. facility.
A 401 Certification will be required since the project will
require "cut and fill" to bury the 24 inch diameter force main
beneath the AIWW and adjacent wetlands classified SA.
It is recommended that the requested 401 Certification be
approved subject to the following conditions:
1. The project shall be performed during periods of low
biological activity, coordinated through the North Carolina
Division of Marine Fisheries.
2. The turbidity in the waters shall not exceed 25 NTU as a
result of the project activity.
3. Backfill material shall be of such quality so as not to
create turbidity violations in the area of the proposed
project.
4. Construction of the collection system must be authorized by
this Division prior to construction commencement.
5. Silt fences and/or other sedimentation control devices shall
be employed to minimize erosion, sedimentation and turbidity

8. PROJECT SUMMARY: The applicant is proposing to expand their
service area by constructing_ a wastewater collection system which
will provide sewage service to additional areas of Topsail Island
in Onslow County.

9. NARRATIVE DESCRIPTION: The applicant is proposing to expand
their service area by constructing a waste water collection
system which will provide sewage service to additional areas
on Topsail Island, Onslow County. The new system will begin
approximately 6,700' north of the Onslow/Pender County line
(approximately at the location of the Scotch Bonnett Pier)
and will terminate at the existing waste water treatment
plant which is located approximately 5,000' north of the
intersection of NCSR 1518 and is adjacent to NC Hwy. 210 on
the mainland side. There is presently one development
(Permuda Landing) which has been serviced by the applicant's
sewer system in this general area, however, the whole island
area north of SR 1516 has sewer available to them. The
applicant has indicated that a permit has been applied for
to the Division of Environmental Management for the
upgrading of the existing plant from 877,600 gpd to
1,027,600 gpd. Ultimate capacity of this plant is projected
at 6,000,000 gpd according to the applicant.
The sewer system will consist of 1,015' of 12" gravity
sewers, 18,105' of 15" gravity sewers, 4,898' of 18" gravity
sewers, 2,000' of 6" force mains, 19,140' of 16" force
mains, 19,070' of 24" force mains, four (4) duplex
submersible pumping stations in precast concrete structures,
and miscellaneous manholes and appurtenances. The majority
of construction activities associated with the sewer line
will occur on highground and within DOT's right-of-way,
however, the sewer line system will involve a subaqueous
crossing of the AIWW and a canal, and will be trenched
underneath adjacent wetlands vegetation on either side of
the AIWW.
Plans included with the application indicate that the
proposed sewer line will begin to be trenched in coastal
wetlands somewhere close to the location of an abandoned
brick facade pump station on the southwest side of the
high-rise bridge. The sewer line and associated spoil
excavation will then run in a northwesterly direction until
it enters transitional wooded wetland areas at the location
where aerial electrical transmission lines are running,
parallel to the high-rise bridge. The sewer line will then
run generally along the same alignment of this power line
and across the AIWW until it reaches the northwest highway
bridge road shoulder. At this location, the sewer line will
then move back into the road embankment and will run along
and within the highway right-of-way (NC Hwy. 210),
approximately 5,0001, until it reaches the existing
wastewater treatment plant.

Along the wetland areas, the applicant indicates that the
sewer line will be placed a minimum of 3' below the original
wetland elevations with the stockpiled material from the
trenching (backhoe) excavation being used to restore the
wetland areas back to their original elevation. The total
disturbance area is approximately 2500 linear feet x 10' in
width. The crossing of the AIWW is proposed to be achieved
by the excavation of an approximately 300' long x up to 33'
wide trench which will be excavated by a dragline. Spoils
excavated will be placed on a barge and will be returned
back to the trench (only suitable material) after the pipe
is placed. The pipe will be a minimum of -6' below the
project depth of the AIWW channel. The remaining waterway
to be crossed is an existing man-made canal which is
approximately 40' in width and -2' MLW deep. An
approximately 10' wide trench will be excavated by dragline
and the sewer pipe will be placed approximately -3' below
the existing bottom contour. Suitable materials will also
be used to backfill this trench. Adjacent waters outside
the AIWW channel itself have been designated by the N.C.
Division of Marine Fisheries as primary nursery areas and
are classified by the Division of Environmental Management
as "SA" waters.
10. ANTICIPATED IMPACTS: The project as proposed will result in
excavation and temporary filling of approximately 25,000 sq.
ft. of wetland type vegetation (a majority of which is
transitional, wooded wetlands). Additionally, approximately
1,489 sq. ft. of bottom area below the MHW line will be
excavated in conjunction with the sewer line construction
with approximately 2,500 cubic yards of sand, mud and silt
materials being excavated. The applicant proposes to "fill
in" the trenches with suitable materials which are obtained
from the excavation activity. Increased levels of turbidity
can certainly be expected from the excavation and filling
activity as they occur in the areas below the MHW line.
These impacts could be minimized however, if construction is
timed to periods of least biological activity, and
appropriate backfill material is used. The applicant
indicates that the excavation of the bottom areas cannot be
avoided since the Department of Transportation will not
allow these sewer lines to be attached to the bridge
structure itself. Sediment runoff from upland disturbed
areas could also cause significant impacts to adjacent
wetlands and water areas unless adequate sedimentation and
erosion control techniques are employed.
Certainly, one of the most obvious secondary impacts of this
project will be the availability of sewer to a significant

amount of undeveloped and existing built upon areas.
Whereas, in the past when soil conditions have either
prohibited or limited the density of development, the
availability of a sewer system will now allow these areas to
develop to their full potential in accordance with local
zoning and subdivision regulations.

will provide sewage service to additional areas of Topsail Island
in Onslow County.

9. NARRATIVE DESCRIPTION: The applicant is proposing to expand
their service area by constructing a waste water collection
system which will provide sewage service to additional areas.
on Topsail Island, Onslow County. The new system will begin
approximately 6,700' north of the Onslow/fender County line
(approximately at the location of the Scotch Bonnett Pier.}
and will terminate at the existing waste water treatment
plant which is located approximately 5,000' north.of the
intersection of NCSR 1518 and is adjacent to NC Hwy. 210 on
the mainland side. There is presently one development
(Permuda Landing) which has been serviced by the.applicant's
sewer system in this general area, however, the whole island
area north of SR 1516 has sewer available to them. The
applicant has indicated that a permit has been applied for
to the Division of Environmental Management for the
upgrading of the existing plant from 877,600 gpd to
1,027,600 gpd. Ultimate capacity of this plant is projected
at 6,000,000 gpd according to the applicant.
The sewer system will consist of 1,015' of 12" gravity
sewers, 18,105' of 15" gravity sewers, 4,898' of 18" gravity
sewers, 2,000' of 6" force mains, 19,140' of 16" force
mains, 19,070' of 24" force mains, four (4) duplex
submersible pumping stations in precast.concrete structures,
and miscellaneous manholes and appurtenances. The majority
of construction activities associated with the sewer line
will occur on highground and within DOT's right-of-way,
however, the sewer line system will involve a subaqueous
crossing of the AIWW and a canal, and will be trenched
underneath adjacent wetlands vegetation on either side of
the AIWW.
Plans included with the application indicate that the
proposed sewer line will begin to be trenched in coastal
wetlands somewhere close to the location.of an abandoned
brick facade pump station on the southwest side of the
high-rise bridge. The sewer line and associated spoil
excavation will then run in a northwesterly direction until
it enters transitional wooded wetland areas at the location
where aerial electrical transmission lines are running
parallel to the high-rise bridge. The sewer line will then
run generally along the same alignment of this.power line
and across the AIWW until it reaches.the northwest highway
bridge road shoulder. At this location,.the sewer line will
then move back into the road embankment and will run. along
and within the highway right-of-way (NC Hwy. 210),
approximately 5,0001, until it reaches the existing
wastewater treatment plant.

Along the wetland areas, the applicant indicates that the
sewer line will be placed a minimum of 3' below the original
wetland elevations with the stockpiled material from the
trenching (backhoe) excavation being used to restore the
wetland areas back to their original elevation. The total
disturbance area is approximately 2500 linear feet x 10' in.
width. The crossing of the AIWW is proposed to be achieved
by the excavation of an approximately 300' long x up to 33'
wide trench which will be excavated by a dragline. Spoils
excavated will be placed on a barge and will be returned
back to the trench (only suitable material) after the pipe
is placed. The pipe will be a minimum of -6' below the
project depth of the AIWW channel. The remaining waterway
to be crossed is an existing man-made canal which is
approximately 40' in width and -2' MLW deep. An
approximately 10' wide trench will be excavated by dragline
and the sewer pipe will be placed approximately -3' below.

be used to backfill this trench. Adjacent waters outside
the AIWW channel itself have been designated by the N.C.
Division of Marine Fisheries as primary nursery areas and
are classified by the Division of Environmental Management
as "SA" waters.
10. ANTICIPATED IMPACTS: The project as proposed will result in
excavation and temporary filling of approximately 25,000 sq.
ft. of wetland type vegetation (a majority of which is
transitional, wooded wetlands). Additionally, approximately
1,489 sq. ft. of bottom area below the MHW line will be
excavated in conjunction with the sewer line construction
with approximately 2,500 cubic yards of sand, mud and silt
materials being excavated. The applicant proposes to "fill
in" the trenches with suitable materials which are obtained
from the excavation activity. Increased levels of turbidity,
can certainly be expected from the excavation and filling
activity as they occur in the areas below the MHW line.
These impacts could be minimized however, if construction is
timed to periods of least biological activity, and
appropriate backfill material is used. The applicant
indicates that the excavation of the bottom areas cannot be
avoided since the Department of Transportation will not
allow these sewer lines to be attached to the bridge
structure itself. Sediment runoff from upland disturbed
areas could also cause significant impacts to adjacent
wetlands and water areas unless adequate sedimentation and
erosion control techniques are employed.
Certainly, one of the most obvious secondary impacts of this
project will be the availability of sewer to a significant

amount of undeveloped and existing built upon areas.
Whereas, in the past when soil conditions have either
prohibited or limited the density of development, the
availability of a sewer system will now allow these areas to
develop to their full potential in accordance with local
zoning and subdivision regulations.

prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.

ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (Sit) numbers, landmarks, and the like. ,
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to.,the .Division of
Coastal Management. The applicanomust advise sen-
