The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of a canal tributary to Straits in conjunction with the proposed construction activity in Carteret County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted.in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. That silt fences and other erosion controls be in place prior to filling. 3. That the fill material be from a clean upland source, free from any toxic material. 4. That the filled area be stabilized with vegetation as soon as possible to minimize erosion. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. Paul Wilms, Director WQC# 2248 { NOTICE OF FILING OF APPLI TION FOR CAMA MAJOR DEVELOPMENT PERMIT AND WATER QUALITY CERTIFICATION The Department of Natural Resources and Community Development hereby gives public notice as-required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that Anthony Medeiros of Carteret County, filed an application on May 5, 1988, for a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for certification from the Division of Environmental Management that a discharge of fill material in project wetlands will not violate applicable water quality standards. According to said application, the applicant is proposing to bulkhead his shoreline and to fill in an existing man-made basin. The site is located on Whitehurst Drive (off NCSR 1335) and adjacent to a man-made canal which enters "The Straits", in the Community of Straits, Carteret County. A copy of the entire application and additional information may be examined (or copies furnished upon request and payment of reproduction costs) during normal business hours at the office of Charles Jones, Division of Coastal Management, located in the Division of Marine Fisheries Building, Morehead City, N.C., 919/726-7021, and/or the office of Preston Howard, Division of Environmental Management, NRCD Regional Field Office, Wilmington, N.C., 919/256-4161. The Division of Environmental Management proposes to take final action on this water quality certification on or before June 26, 1988. The issuance of the LAMA Major Development permit and the Section 401 Certification may deviate from this projected date depending upon the nature of the comments submitted and subsequent hearings that may result. All persons desiring to make comments should do so in writing to Mr. David Owens, Director, Division of Coastal Management, P.O. PROJECT SUMMARY: The applicant is proposing to bulkhead his shore- line and to fill in an existing man-made basin. The site is located on Whitehurst Drive (off NCSR 1335) and adjacent to a man-made canal which enters "The Straits" in the Community of Straits, Carteret Countv. t FIELD INVESTIGATION REPORT - ANTHONY E. NARRATIVE DESCRIPTION: The applicant's property consists of an approximately 36,000 sq. ft. lot located on the north side of Whitehurst Drive (which is a dirt lane off of NCSR 1335) in the community of Straits, Carteret County. This property borders a man-made canal which eventually enters "The Straits". This canal is designated by the Division of Environmental Management as "SA" waters and is open to the harvesting of shellfish. The property is vacant with elevations of approximately 4' above mean sea level and has an existing septic tank located upon it. The shoreline may be characterized as having an approximately 3' high vertical bank void of wetlands vegetation and shows signs of moderate erosion. Two (2) man-made boat basins have been excavated into the property and have a maximum depth of -3' MLW. Adjacent shorelines are not bulkheaded and a single-family residence has been constructed on the adjacent property to the east. The applicant is proposing to bulkhead his shoreline and to fill in one of the existing boat basins. The proposed bulkheading will be approximately 260' in length and will be located a maximum of 5' beyond the MHW line, but being an average of 21. The existing basin, which is to be filled in, is approximately 40' long x 35' wide x -3' MLW deep. Upland fill material will be used to fill in the basin area, as well as behind the proposed bulkhead. An approximately 70' x 14' mobile home is also proposed to be placed on the lot in the future. The mobile home will be located a minimum distance of 45' away from the existing boat basin. 10. ANTICIPATED IMPACTS: The project, as proposed, will result in the filling in of approximately 1,400 sq. ft. of an existing boat basin bottom and approximately 520 sq. ft. of canal bottom. Approximately 155 cu. yds. of upland fill material will be placed below the MHW line in conjunction with the boat basin fill and approximately 38 cu. yds. of fill below the MHW line in conjunction with the bulkhead. Adverse impacts to estuarine resources will be minimum if the bulkhead is constructed prior to filling activities. Impervious areas within 75' of the MHW line will be approximately 7%.
