This permit, issued on July 14, 1988 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The project must be carried out in accordance with the following plats: a) "Composite Plan - Corolla Light PUD Phase 9 - Whalehead Village" dated revised 7/8/.88; b) "Stormwater Management Plan - Whalehead Village" dated revised 6/7/88 and c) "Grading, Erosion, and Sedimentation Control Plan- 'Whalehead Village" dated revised 6/20/88. Excavation, Filling and Shoreline Stabilization (2) The permittee shall stake the limits of the authorized mitigation pond for inspection by representatives of the DCM and/or C.O.E. prior to construc- tion of such pond in order to insure that no wetlands are impacted. (3) Creation. of-the proposed ' freshwater . pond. will provide mitigation for::.the existing pond which is to be filled. The proposed pond will be constructed prior to filling the existing pond. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee w Advanced Property Concepts ADDITIONAL CONDITIONS Permit #141-86 Page 2 (4) No wetlands will be filled to create highground for residential development. No fill material will be placed in wetlands with the exception of that which is to be placed in 27,000 square feet of existing pond as authorized by this permit. (5) All wetlands excavated or filled in connection with the proposed dredging, bulkhead construction and the placement of fill material in the existing lagoons will be replaced on a one-to-one basis through the creation of similar habitats. Location and design of the replacement habitats will be approved by the Division of Coastal Management and the U. S. Fish and Wildlife Service. (6) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the plat. (7) All excavated materials (except as described in #6) will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. (8) The bulkhead within the basin will average two feet waterward of the NWL and in no place exceed five feet waterward of the NWL. (9) All fill material to be placed below normal water level will be confined behind the permitted bulkhead. (10) The proposed boat ramp shall be no wider than 15 feet and will not extend further than 20 feet below the mean high water level. (11) Excavation for the boat ramp will be limited to that absolutely necessary to establish adequate ramp slope. Water Quality and Stormwater Treatment (12) Water Quality Certification No. 1787 has been issued for this project by the Division of Environmental Management. Any violation of that Certification will be considered a violation of this CAMA permit. (13) The project activity must be conducted in such a manner as to prevent signifi- cant increases in turbidity outside the area of construction or construction- related discharges (increases such that the turbidity in adjacent waters is 25 NTUs or less are not considered significant). (14) The stormwater management controls proposed for this project which uses density limits as a means of being in compliance with the rules and to which the Division of Environmental Management gave approval on June 20, 1988 must remain in effect for the life of the project. Advanced Property Concepts ADDITIONAL CONDITIONS Potable Water Supply Permit #141-86 Page 3 (15) Potable water will be supplied from an off site source approved by the Division of Health Services. (16) Authorization is required from the Division of Health Services for the operation and construction of a water distribution system. Any violation of the permit required from DHS would be considered a violation of this permit. Historic Resources (17) The Division of Archives and History shall review and comment upon all proposed construction. (18) Any rehabilitation of the Whalehead Club building, boat house and bridge, shall be in accordance with the Secretary of the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings. The permittee shall consult with the Division of Archives and History throughout the rehabilitation process and provide access to the Whalehead Club for occasional inspections by representatives of the Division to ensure compliance with the Secretary of the Interior's standards. (19) All land currently designated as open space around the Whalehead Club (all land southwest of that boat basin and lagoons/ponds/ should remain open. No residential development. of that parcel shall be allowed without review and comment by the Division of Archives and History through a modification of this permit. (20) Prior to new construction and rehabilitation activities, the Division of Archives and History shall be allowed to fully record the Whalehead Club to Historic American Building Standards. Wildlife Protection (21) Habitat losses for some wildlife species can be reduced by carefully planning the overall development to avoid excessive land clearing activities. The overall objective should be to preserve as much of the indigenous vegetative cover as possible when clearing right-of-ways for roads and related construc- tion activities. Wastewater Treatment (22) Wastewater will be disposed of in the manner approved by the Division of Environmental Management on June 21, 1988 under Permit No. 11228R. Require- ments of such permit are incorporated into this permit and any violation of the DEM permit will be considered a violation of this permit. " Advanced Proppr_ty Concepts Permit #141-86 Page 4 ADDITIONAL CONDITIONS (23) The wastewater collection system must be properly maintained and operated on a continuing basis. Erosion Control (24) Project construction must be in compliance with the sedimentation and erosion control plan approved by the Division of Land Resources on June 23, 1988. (25) Any cut and/or fill slopes created must be adequately stabilized within 30 working days. (26) All excavated, backfill material, and disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion within thirty (30) days of project completion. (27) The development will provide a buffer zone along the margin of all estuarine waters which is sufficient to confine visible siltation within 25 percent of the buffer zone nearest the land disturbing development. (28) No graded slopes or fill will be greater than an angle which can be retained by vegetative cover or other adequate erosion control devices or structures. Miscellaneous (29) The proposed pier in Currituck Sou-nd directed north along the shoreline will not cover more than 500 square feet of coastal wetlands. A review of your application received April 25, 1988, for Department of the Army authorization to construct and backfill a bulkhead on Currituck Sound, Corolla Light, Currituck County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be informed regarding its further management. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is a reasonable time for State action. BRINDLEY BIO REPORT MAJOR MODIFICATION PAGE 2 BIO REPORT The applicant is currently developing an ocean to sound subdivision known as Corolla Light located in Corolla, Currituck County. The development covers almost 5000 feet of shoreline along the Currituck Sound. The subdivision was originally permitted under LAMA Major development #19-85 and several modifications to this permit have since been approved. As required under permit #19-85, the applicant left a 75' buffer zone in natural vegetation between Currituck Sound and the development. Severe erosion has and is occurring to this shoreline so that in some areas only 40 feet of buffer zone is left. No coastal wetlands exist along the shoreline from the old Whalehead Hunt Club south approximately 3500' to an extensive marsh extending out into Currituck Sound (see photo reference 135-628). This shoreline is vegetated with large live oaks, pines, juniper, and other upland species. The shoreline erosion has undercut many of these trees and threaten to wash out several others. To protect his shoreline from erosion and subsequent loss of trees, the applicant proposes to bulkhead 3150' of shoreline beginning at a canal south of the Whalehead Hunt Club and continuing south, stopping at the extensive marsh on the south side of the applicant's property. The applicant would like to bulkhead in front of several large undermined trees to prevent their loss. The bulkhead alignment would follow the contours of the shoreline averaging 5' waterward of NWL. Once completed, the applicant proposes to backfill the bulkhead and establish vegetation in the filled area.
