In addition, the project site is subject to the City of C'harlotte's state delegated Stormwater Program that meets the requirements of Phase 11 NPDES stormwater program. This is applied through their Post Construction Control Ordinance (PC'CO). The City of Charlotte will require the 404/401 to be issued prior to approving the plans. 'therefore we are requesting that the transferred 401 Water Quality Certification be issued with the following modification to the stormwater management condition. "An approval letter from the City of Charlotte and at [cast one copy of the approved SMP, including plan details, calculations and other supporting information must be submittal prior to any approved impacts to streams and/or wetlands". It is very important to note that the developer, engineers, and planners on this project have no predictable way of accurately determining the time frame for the review and approval of the comprehensive development plans once the plans are submitted to the City of C harlotte. Therefore the NCDENR should allow the time necessary to submit the approval letter and plans from the City of Charlotte to NCDENR or include language that allows for additional time to be requested if needed. if you have any questions. The storm water best management practices are required to be appropriate for the surface water classification and designed to remove at least 85% TSS according to the most recent version of the NC DENR Storm water Best Management Practices Manual These facilities must be designed to treat the runoff from the entire project, unless otherwise explicitly approved by the Division of Water Quality Also, before any permanent building is occupied at the subject site, the facilities (as approved by this Office) shall be constructed and operational, and the storm water management plan (as approved by this Office) shall be implemented The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural storm water practices shall be made without written authorization from the Division of Water Quality 4 Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of Completion" form to the 401/Wetlands Unit of the NC Division of Water Quality 5 Continuing Compliance The applicant (WP East Acquisitions, LLC. Dan Cimaglia) shall conduct all activities in a manner so as not to contravene any state water quality standard (including any requirements for compliance with section 303(d) of the Clean Water Act) and any other appropriate requirements of state and federal law If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal law is being violated, or that further conditions are necessary to assure compliance.
