This permit shall be effective from the date of issuance until August 31, 2007 and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Intemet http://h2o.enr..state.nc us/ndpu Telephone (919) 733-5083 Fax (919) 715-6048 Telephone 1 800 623-7748 50% recycled/101% post -consumer paper 44 RnENR NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH BULK RECLAIMED WATER DISTRIBUTION PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Charlotte -Mecklenburg Utility Department Mecklenburg County FOR THE construction and operation of a bulls reclaimed water distribution program and all associated facilities at the Franklin Water Treatment Plant (NPDES Permit No. NC0084549): Bulk reclaimed water, following treatment and testing according to the water reclamation facility's existing NPDES permit and the conditions provided herein, may be manually distributed from a three-inch hose connected to a quick -connect coupling and controlled by a lockable control panel at a newly constructed truck filling station. All reclaimed water distributed must be measured and recorded. Bulk reclaimed water may only be distributed to approved trucks and drivers for the following uses: sewer line flushing, dust control for street sweeping, irrigation of landscapes not intended for human consumption, vehicle washing at construction sites (not including-4ehicle underbody), and construction uses such as soil compaction, dust control, and asphalt reclamation. The bulk reclaimed water distribution program shall be operated such that no discharge of wastes to surface waters occurs, pursuant to the application received August 21, 2002 and in conformity with the project plans, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until August 31, 2007 and shall be subject to the following specified conditions and limitations: L PERFORMANCE STANDARDS Upon completion of construction, a certification must be received from a professional engineer certifying that the permitted facility has been installed, operated, and managed in accordance with this permit, the approved plans and specifications, and other supporting materials. Mail the Certification to the Non -Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. 2. The Mooresville Regional Office, telephone number 704-663-1699, shall be notified at least 48 hours in advance of the first day of operation of the bulk reclaimed water distribution program and facilities so that an inspection of the facilities can be made and operation of the program may be observed. Such notification to the regional supervisor shall be made during the normal office hours from 8.00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 3. The bulk reclaimed water distribution program and facilities shall be effectively maintained and operated at all tinges so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event that the program and/or facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the application areas to adequately assimilate the wastewater, the Perrnittee shall take immediate corrective actions including those actions that may be required by the Division of Water Quality (Division), such as the construction of additional or replacement reclaimed water treatment facilities or cessation of the operation of the bulk reclaimed water distribution program. 4. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of the bulk reclaimed water distribution program and facilities. S. The Pernnittee shall maintain a Spill Prevention, Countermeasures, and Control Plan for the water reclamation facility as well as for the bulk reclaimed water distribution program. 6. Diversion or bypassing of the untreated wastewater from the reclaimed water treatment facilities is prohibited. 7. The bulk reclaimed water distribution facilities shall be accessible and operated by authorized personnel only_ 8. The Permittee shall approve all tank trucks for participation in the bulk reclaimed water distribution program prior to distribution of reclaimed water. Tank trucks shall meet the following minimum criteria: a. Tank trucks and other equipment used to distribute reclaimed water shall be clearly identified with advisory signs. b. Tank trucks used to transport reclaimed water shall not be used to transport potable water that is used for drinking or other potable purposes. c. Tank trucks used to transport reclaimed water shall not be filled through on -board piping or removable hoses that may subsequently be used to fill ta4s with water from a potable water supply- d. Tank trucks used to transport septage, raw wastewater, or wastewater residuals shall not be used to transport reclaimed water. IM 9. The Permittee shall approve tank truck drivers for participation in the bulk reclaimed water distribution program prior to distribution of reclaimed water. In addition, the Permittee shall provide training (bilingual (English and Spanish) as necessary) to all tank truck drivers approved to participate in the bulk reclaimed water distribution program at a regular frequency. These sessions shall provide training on, but not limited to, the following topics: a. Reclaimed water description and safety, b. Approved and disapproved uses of reclaimed water, c. Procedures for the application (including buffer maintenance), uses, and storage of reclaimed water as well as the disposal of unused reclaimed water, d. Procedures for spill prevention, countermeasures, and control as well as notification requirements, e. Personal safety and hygiene issues, and f. Interaction with the general public. 2 10. The following uses of reclaimed water shall be strictly forbidden by the Permittee: a. Irrigation of direct food crops, b. Filling of swimming pools, hot tubs, or similar uses, c. Use as a raw potable water supply, and d. Use after 72 hours of storage. The following uses of reclaimed water distributed through the bulk reclaimed water distribution program shall be approved: a. Sewer line flushing, b. Dust control for street sweeping, c_ Vehicle washing at construction sites, not to include washing of vehicle underbodies, d. Landscape irrigation, and e. Construction uses such as soil compaction, dust control, and asphalt reclamation. All other uses for reclaimed water shall not be allowed by the Permittee. In the event there is a desire for the permitting of additional uses, a formal permit modification request must be submitted to the Division accompanied by an application fee and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 11. The following buffers shall be maintained during application of reclaimed water distributed through the bulk reclaimed water distribution program: a. 100 feet between wetted areas and water supply wells, b. 10 feet between wetted areas and non -potable well, and c. 25 feet between wetted areas and surface waters not classified as SA including wetlands as delineated or designated by the appropriate state or federal agency or any swimming pool. 12. Public access to the application sites and contact with reclaimed water shall be controlled during reclaimed water distribution and use. Such controls may include public meetings, publication -of notices in local newspapers, notification through television and radio news programs, as well as distribution of the bilingual educational flyers. a II. OPERATION AND MAINTENANCE REQUIREMENTS 1. The bulk reclaimed water distribution program and facilities shall be properly maintained and operated at all times. 2. Upon classification of the wastewater treatment and spray irrigation facilities by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Perrnittee shall designate and employ a certified operator to be in responsible charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the facilities in accordance with 15A NCAC 8G .0201. The Permittee shall submit the ORC and back-up ORC designations to the WPCSOCC at least 50 days prior to the introduction of waste into the system. The designated ORC shall visit the facilities in accordance with 15A NCAC 8G .0204 and shall comply with all other conditions specified in these rules. I A certified operator of a grade equivalent or greater than the water reclamation facility shall be available on -call 24 hours per day. 4. Bulk reclaimed water shall not be distributed for land -based uses nor shall reclaimed water be used for land -based activities during inclement weather or when the ground is in a condition that will cause runoff. 5. The Permittee shall implement adequate measures to prevent reclaimed water runoff frorn the application areas. 3 6. The bulk reclaimed water distribution program and facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any reclaimed water resulting from the operation of the program and its associated facilities. 7, No type of reclaimed water other than that from the Franklin Water Treatment Plant shall be distributed through the bulk reclaimed water distribution program and facilities. 8. All wastewater shall either be routed to the existing backwash clarifiers of the water treatment facilities or discharged in strict accordance with the conditions of the facility's existing NPDES permit should the limit for fecal coliform (daily maximum concentration of 25 per 100 ml) or turbidity (instantaneous maximum of 10 NTU) be exceeded, until such time that the levels have stabilized below these maximum levels. 9. All reclaimed water distributed, but not used within a period not to exceed 72 hours from the time of distribution, shall be reintroduced at the existing backwash clarifiers for disposal. II1. MONITORING AND REPORTING REQUIREMENTS 1, Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division to ensure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed_ 2. As an indicator of proper operation and maintenance, the water treatment facility shall produce an effluent in compliance with the following limitations: Parameter Monthly Avera ea Dail instantaneous Maximum c BOD5 (5-day, 20°C) 10 mg/1 15 mg/l NH3 as N 4 mg/1 6 mg/l TSS 5 mg/1 10 mg/l Fecal Coliform 14 per 100 ml b 25 per 100 ml Turbidity 10 NTU The effluent pH shall not be less than 6.0 standard units nor greater than 9.0 standard units. a Monthly averages for all but fecal coliform shall be the arithmetic mean of all samples collected during the reporting period. Monthly average for fecal coliforrn shall be the geometric mean of all samples collected during the reporting period. Daily maximum shall be the maximum value of aII samples collected during the reporting period. The Permittee shall maintain applications of all approved tank trucks and drivers on file for the duration, not less than one year, that the 'driver participates in the bulk reclaimed water distribution program. 4. Adequate records shall be maintained by the Permittee that tracks the amount bulk reclaimed water distributed. These records shall include, but are not necessarily limited to the following information: a. Date and time of distribution, b. Volume of reclaimed water distribution, c. Intended uses of reclaimed water, d. Locations of intended uses, e. Names and approval status of truck operators, f. Approval status of trucks, g_ Compliance status of the bulkr reclamation facility; and h. Weather conditions. Three copies of all operation and distribution records (as specified in Condition III. 4.) shall be submitted on or before the last day of the month following the month that was monitored. Three copies of all effluent monitoring data (as specified in Condition III. 2.) on Form NDMR-1 shall be submitted on or before the last day of the month following the month that was monitored. Noncompliance Notification: The Permittee shall report by telephone to the Raleigh Regional Office, telephone number (919) 571- 4700, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a_ Any occurrence at the water reclamation facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any spill of reclaimed water from the bulk reclaimed water distribution facilities during filling, from tank trucks during transport, or from tank trucks during application. e. Any time that self -monitoring information indicates that the facility has gone out of compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within five days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 5 IV. INSPECTIONS Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to ensure proper operation and management of the bulk reclaimed water distribution program, and facilities. 2. The Permttee or their designee shall inspect the reclaimed bulk water distribution program and facilities to prevent malfunctions and deterioration, •operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the bulk reclaimed water distribution program or facilities at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the _ terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. V. GENERAL CONDITIONS This permit shall become voidable unless the bulk reclaimed water distribution program and facilities are constructed and operated in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143- 215.6A to 143-215.6C. 5. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 6. The annual administering and compliance fee must be paid by the Permince within thirty days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H _0205 (c)(4). 7. The Permittee, at least six months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Comnussion will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. A The Permittee, within 12 months following issuance of this permit, shall request modification of NPDES Permit Number NCO094549 issued to the Franklin Water Treatment Plant. The modification shall amend the existing NPDES permit to allow the conjunctive use of reclaimed water as provided for in this permit. 9. This permit in no way negates, precludes, or invalidates NPDES Permit Number NC0084549, and the Permittee shall continue to comply with all conditions provided for therein.
