CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to U.S. Army Corps of Engineers
pursuant to an application filed on the 14th day of July, 1987 to
conduct a program of erosion control of the bank of Dan River at the
Madison Wastewater Treatment Plant.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of Dan River
in conjunction with the proposed erosion control project in Rockingham
County will not result in a violation of applicable water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance
with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 50 NTU's or less
are not considered significant).
2. Graded areas not covered by the rip-rap material
should be quickly stabilized to prevent additional
erosion.
3. The discharge outfall line of the wastewater
treatment plant should be protected from damage
during the construction activity.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall became null and void unless the above
conditions are made conditions of the Federal Permit.

River, along the streambank, for a distance of 500 feet at the Madison
Wastewater Treatment Plant. The Madison Wastewater Treatment Plant
is located on the west bank of the Dan River, Rockingham County, N.C.,
about 3,500 feet upstream from the confluence of the Dan and Mayo Rivers
(see figures 1 and 2).

The fill material will consist of sand and/or filter cloth, and North
Carolina Department of Transportation (NCDOT) Class 1 riprap. Project
construction will include grading a 500 foot length of the existing
bank to a 2.5 horizontal to 1 vertical slope, placing a 1-foot-thick
layer of sand on the graded surface as a filter material, and placing
a 1-112 foot-thick layer of riprap over the filter material. A layer
of filter cloth may be used in place of the 1-foot-thick layer of sand.
The riprap will range in size from 2 inches to 1 foot in diameter.
Approximately 2,200 tons of granular fill (sand) will be required,
along with about 3,200 square yards of riprap. The amount of filter
cloth, if needed, has not been determined. Reference figure 3. The
exact quantity of material to be placed below the water line depends
on the river stage at the time of construction.
No pollutants or contaminants will be introduced, relocated, or
increased.

The proposed project has been reviewed and appears
satisfactory. The fill material consists of washed stone
and rip-rap, so its deposition should not increase stream
turbidity. The current erosion of the bank is a significant
threat to the WWTP.
The work should be conducted in a manner that will
minimize disturbance to the floodplain area outside the
existing levee. Any graded areas should be quickly
stabilized to prevent stream sedimentation. The outfall
line from the treatment plant should be protected from
damage during construction.

PUBLIC NOTICE
DAN RIVER - MADISON WASTEWATER TREATMENT PLANT
SECTION 14 STREAMBANK EROSION CONTROL PROJECT
ROCKINGHAM COUNTY, NORTH CAROLINA
TO WHOM IT MAY CONCERN:
The Wilmington District, Corps of Engineers, Wilmington, North Carolina,
plans to stabilize 500 feet of riverbank adjacent to the Madison
Wastewater Treatment Plant, Rockingham County, North Carolina.
The Federal project has been reviewed under the following:
1. Clean Water Act of 1977, as amended (P.L. 95-217).
2. The National Environmental Policy Act of 1969, as amended
(42 U.S.C. 4321-4347).
3. The Fish and Wildlife Act of 1956 (16 U.S.C. 472a at seq.), the
Migratory Marino Game-Fish Act (16 U.S.C. 760e-760g), and the Fish
and Wildlife Coordination Act (16 U.S.C. 661-666c).
4. The National Historic Preservation Act of 1966 (80 Stat. 915,
16 U.S.C. 470).
5. The Endangered Species Act of 1973, as amended.
6. Executive Order 11990, Protection of Wetlands, May 24, 1977.
7. Executive Order 11988, Flood Plain Management, May 24, 1977.
PROJECT DESCRIPTION
The Madison Wastewater Treatment Plant is located on the west bank
of the Dan River. The plant is about 3,500 feet upstream from the
confluenco of the Dan and Mayo Rivers. The vertical distance from
the top of the riverbank to the riverbed is about 12 feet. The too
of the bank protection will be tied into the existing stroambed and
extended to the present top of the bank. A maintenance berm of at
least 15 feet will extend fray the top of the riprapped surface
to the too of the existing levee. A 3- by 3-foot riprap toe will be
placed along the base of the protection. See enclosed figures 1-3.
The riprap protection will be placed along 500 linear feet of stream-
bank. The upstream limit of the project is at the right-of-way of
the Duke Power Company electric line at station 6+00. The downstream
limit is in line with the corner of the levee at station 1+00. The
streambank will be graded and stabilized for a distance of 500 feet to
a 2.5-horizontal to 1-vertical slope. Fill material will consist of
a layer of geotextile filter fabric, 2,200 cubic yards of granular fill,
and 3,200 square yards of riprap. The exact amount of material to be
placed in the water cannot be accurately determined due to fluctuations
in the water level of the Dan River.
The proposed fill is scheduled to begin September 30, 1987, contingent
upon receiving funding, and will take approximately 2 months to
complete. However, since no restrictions on timing exist, work may be
performed any time of the year. Maintenance will be the responsibility
of the local government as project sponsor. The only development near
the proposed work is the Madison Wastewater Treatment Plant.
A Section 401 (P.L. 95-217) Water Quality Certificate has been requested
from the N.C. Division of Environmental Management. A Section 404(b)(1)
(P.L. 95-217) evaluation has been prepared.
The proposed work will.be performed under the emergency streambank
erosion provisions of Section 14 of the 1946 Flood Control Act, as
amended. An Environmental Assessment and Finding of No Significant
Impact have been prepared for the proposed work and have been sent
to local, State, and Federal agencies and the interested public for
information only (see attached list).
No practicable alternative to performing the work within the flood
plain of the Dan River exists. All practicable steps have been taken
to minimize any adverse impacts likely to occur to the flood plain.
Designation of the proposed disposal site for fill material associated
with the Federal project shall be made through the application of
guidelines promulgated by the Administrator, Environmental Protection
Agency, in conjunction with the Secretary of the Army. If theso
guidelines alone prohibit the designation of the proposed site, any
potential impairment to the maintenance of navigation, including any
economic impact on navigation and anchorage which would result from
failure to use the disposal site, will also be considered.
This public notice is being distributed to all known interested persons
in order to assist them in making a decision with respect to the
disposal of fill materials in waters of the United States. For accuracy
and completeness of record, all data in support of, or in opposition to,
the proposed work should be submitted in writing, setting forth
sufficient detail to support positions taken. Any person who has an
interest which may be affected by the disposal of this fill material may
request a public hearing. The request must be submitted in writing to

the District Engineer within 15 days of the date of this notice and must
clearly set forth the interest which may be affected and the manner in
which the interest may be affected by this activity. In order for such
request to be given appropriate consideration, it should be mailed or
delivered.to the U.S. Army Engineer District, Wilmington, 2torth Carolina
28402-1890, in time to be received on or before August 31, 1987. All
correspondence should refer to the number and date of this notice.
