Newman, III for the construction and continued operation of the subject single family wastewater treatment and surface irrigation facilities. Please pay particular to Condition No. I. 12., which stipulates the property transfer requirements for the subject property as well as for John U. Newman, Ill's Lot No. 4 property (Tax Map No. 5-2-9) located off of Mountainside Lane (36°14' 10", 79°25'00"). Note that a buffer waiver must be provided to the owner or prospective buyer of Lot No. 4 upon the sale of either Lot No. 3 or Lot No. 4. The property deed of Lot No. 3 must be amended to reflect the fact that Lot No. 4's single-family wastewater spray irrigation facility, permitted by Permit No. WQ0016381, does not meet all the State -required buffers established by Regulation 15A NCAC 2H .0219 0) (5). The buffer waiver and amended property deed must be submitted for review and approval when an application is made to transfer ownership of this permit. Also be aware that construction of the subject single-family wastewater spray irrigation facility is strictly forbidden until the appropriate federal and state approvals have been received to allow for the stream crossing of the dosing line (i.e., see Condition No. V. 6. herein). Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. Please also pay particular attention to Conditions V(3) and V(10) of this permit. This permit shall be effective to the date of issuance until March 31, 2009, shall void Permit No. WQ0016400 issued September 27, 1999, and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Newman, III Alamance County FOR THE construction and continued operation of a 480 gallon per day (GPD) surface spray irrigation wastewater treatment and disposal system consisting of a 1,200 gallon baffled septic tank with effluent filter, one 420 square -foot gravity -dosed subsurface sand filter, a tablet chlorinator followed by a baffled 60 gallon chlorine contact chamber, two 2,000 gallon storage/pump tanks (interconnected in series and with floats set to provide a minimum net storage volume of 2,400 gallons), a 15.2 GPM pump with a high water alarm light and buzzer and an automatic rain shut-off device, a 16,474 square -foot spray irrigation area with five full -circle, overlapping (set 60 feet on center), 65-foot diameter, 3.04 GPM sprinkler heads, and all associated piping and appurtenances to serve the John U. Newman, III Residence Lot No. 3 (Tax Map No. 5-2-9) located off of Mountainside Lane (36°14'10", 79°25'00"), with no discharge of wastes to the surface waters, pursuant to the application received December 16, 2003, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until March 31, 2009, shall void Permit No. WQ0016400 issued September 27, 1999 and shall be subject to the following specified conditions and limitations: I. PERFORMANCE STANDARDS Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. If this project is to be completed in phases and partially certified, you shall retain the responsibility t track further construction gRproved under the same permit, and shall pLovide a final certificate of completion once the entire project has been completed. Mail the Certification to the Non -Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. 2. The Winston-Salem Regional Office, telephone number (336) 771-4600, shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 3. The surface irrigation facilities shall be effectively maintained and operated at all times so that there is no discharge to surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately assirnilate the wastewater, the Permittee shall take immediate corrective actions including those actions that may be required by the Division of Water Quality (Division), such as the construction of additional or replacement wastewater treatment and disposal facilities. 4. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or ground waters resulting from the operation of this facility. 5. The sand media of the subsurface sand filters must comply with the Division's sand specifications. The Engineer's Certification will serve as evidence that these specifications have been met. 6. A leakage test shall be performed on the septic tank and storage/pump tank(s) to insure that any exfiltration occurs at a rate which does not exceed twenty (20) gallons per twenty-four (24) hours per 1,000 gallons of tank capacity. The Engineer's Certification will serve as proof of compliance with this condition. 7. If excavation into bedrock is required for the installation of the septic tank or sand filter, the pit shall be lined with a 10-mil synthetic liner. 8. A sanitary tee and filter shall be installed on the effluent pipe of the septic tank. The Engineer's Certification will serve as evidence that these specifications have been met. 9. The residuals generated from these treatment facilities trust be disposed in accordance with General Statute 143-215.1 and in a manner approved by the Division. 10. Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited. 11. The following buffers shall be maintained: a. 400 feet between wetted area and any residence or places of public assembly under separate ownership," b. 150 feet between wetted area and property lines,* c. 100 feet between wetted area and wells, d. 100 feet between wetted area and drainage ways or surface water bodies, e. 50 feet between wetted area and public right of ways, f. 100 feet between treatment/storage units and any wells, and g. 50 feet between treatment units and property lines. Buffers to the property line and the proposed house on the subject property are affected by the wetted area of the spray irrigation facility proposed for Lot No. 4 of John U. Newman, Ill's property (Tax Map No. 5-2-9) located off of Mountainside Lane (36°14' 10", 79°25'00"), permitted by Permit No. WQ0016381 on September 3, 1999. The Permittee shall provide a signed and notarized buffer waiver to the owner or prospective buyer of John U. Newman, III's Lot No. 4 that states that the Permittee acknowledges that a single-family wastewater spray irrigation facility has been permitted and proposed for installation on the neighboring lot. Furthermore, the waiver shall acknowledge the fact that the design of the facility is such that the State -required buffers between the wetted area and property lines as well as houses under separate ownership, as stipulated in 15A NCAC 2H .0219 G) (5), could not be maintained. The property deed for the subject property shall be prepared to reflect the execution of the buffer waiver, either by malting the waiver a permanent part of the property deed or otherwise modifying the property description contained within the property deed. The Division retains the right to request a rewrite of the referenced property deed, if upon, review, the Ianguage contained within the property deed does not adequately meet the intent of this permit condition. 12. The pump tank(s) shall have functional audible and visual high water alarms that are external to any structure. 13. The disposal system shall be connected to a rain or moisture sensor that shall indicate when wastewater application is not appropriate in accordance with Condition 11(4). II. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities shall be properly maintained and operated at all times. 2. Upon classification of the wastewater treatment and surface irrigation facilities by the Water Pollution Control System. Operators Certification Commission (WPCSOCC), the Permittee shall designate and employ a certified operator to be in responsible charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the facilities in accordance with 15A NCAC 8G .0201. The ORC shall visit the facilities in accordance with 15A NCAC 8G .0204 or as specified in this permit and shall comply with all other conditions specified in these rules. 3. A suitable year round cover crop of fescue shall be maintained. 4. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. 5. Adequate measures shall be taken to prevent wastewater runoff from the irrigation field. 6. The application rate shall not exceed a cumulative loading of 18.2 inches over any twelve (12) month period at an instantaneous application rate not to exceed 0.09 inches per hour. 7. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 8. No type of wastewater other than that from the John U. Newman, III Residence Lot No. 3 shall be sprayed onto the irrigation area. 9. No traffic or equipment shall be allowed on the disposal area except while installation occurs or while normal maintenance is being performed. 10. The irrigation field shall be fenced with at least a two -strand wire fence. 11. Wastewater treatment units open to the atmosphere shall have restricted access and pump control panels shall be locked. 12. The Permittee is responsible for the operation and maintenance of the entire treatment and disposal system including, but not limited to, the following items: a. The septic tank shall be checked annually and pumped out as needed. The septic tank effluent filter shall be checked and cleaned at the same frequency of the septic tank. b. The tablet chlorinator shall be checked every week. Tablets shall be added to provide proper chlorination. c. The storage, pump, and alarm systems shall be inspected monthly, The scum layer shall be removed at the same interval as the septic tank is cleaned out. The lamp shall be cleaned and/or replaced to ensure proper disinfects on. d) The storage, pump, and alarm systems shall be inspected monthly. The scum layer shall be removed at the same time interval as the septic tank is purnped out. e) The irrigation system shall be inspected monthly to make certain of proper operation, that vegetative growth does not interfere. with the system, inspection or operation, that the soil is assimilating the disposed treated wastewater with no surface runoff, and that no objectionable odors are being generated. 2) Failure of the Permnittee to properly operate this system is subject to a penalty up to $25,000 per day. 3) Failure to meet the permit conditions or violation of the State's surface or groundwater regulations will require evacuating the dwelling and may void the permit.
