This permit, issued onT? o l? , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) No excavation or filling activities may occur within Kennedy Creek, Tar
River, or on the wetland island.
(2) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-
related discharge.
NOTE: A copy of this permit is being forwarded to the Department of Administration,
State Property Office from which you must receive an Easement prior to
proceeding with your project.
NOTE: Outfall pipe placement should not occur between March and May to avoid
potential impacts to anadromous spawning of river herring.
NOTE: Navigational markers should be placed adjacent to the outfa.ll pipe along
the shoreline to alert boaters of the potential hazard of striking the
pipe at periods of low water.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1991
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

Through coordination with Mr. David Gossett of the North
Carolina Division of Coastal Management, we have learned of your
plans to install a diffuser system in Kennedy Creek, the Tar
River, Washington, Beaufort County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory
Program, Title 33, Code of Federal Regulations (CFR), Part 330,
published in the Federal Register on November 13, 1986, lists
nationwide permits. Authorization was provided for outfall
structures where the effluent from that outfall has been permitted
under the National Pollutant Discharge Elimination System (NPDES)
program.
Your work is authorized by nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions.
Please be aware that this authorization does not relieve you of
the responsibility to obtain any required State or local approval.

cross an approxNate 840' wide section of a wetland island and then extend into the
Tar River a distance of approximately 50'. The pi}x-_s lay on the bottom of Kennedy
Creak thus not restricting navigation. They also lay on the ground through the
wetland area, and on the bottom of the Tar River. The wetland area is vegetated
with Spartina cynosuroidls, Carex spPp., Typha_ sue., Cypress, various species of
Gums and other wetland vegetation.
Project proposal
The company is proposing to discontinue using the existing pies by replacing than
with a new 20" pipeline. The new pipeline will lay immediately adjacent to and
downstream of the existing pipes. The pipe will be allowed to lay on the bottom of
Kennedy Creek (no excavation will be involved), lay atop the wetland area (no excavation
will be involved), and on the bottom of the Tar River (no excavation will be involved).
The new pipe will extend approximately 500' into the river o which the last 90' will
be a diffuser with 4" in diameter openings.
