authorizing development in New Hanover County at Cape Fear River (East side, at
Wilmington) as requested in the permittee's application dated 8/27/81 including plat
schedule listed in Condition No. 1 below.
This permit, issued on ??? , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The project must be carried out in keeping with sheets 1-5 of 5 dated 8/27/81;
3 plats for supplementary disposal site dated received 12/30/87; letter
dated 12/7/87 describing addition of "articulating block revetment mat"
in lieu of riprap; and modified "Final Mitigation Plan" dated 11/5/87.
(2) In order to protect juvenile shrimp populations, no excavation or filling
will be permitted between the dates of April 1 through September 30 of any
year without the prior approval of the Division of Coastal Management with
the exception that work may continue until June 1, 1988 without further
authorisation.
Overburden Disposal
(3) All excavated overburden from the hardstand area and the borrow area must
be confined on highground behind adequate dikes or other retaining structures
to prevent spillover of solids into any marsh or adjacent waters.
(See attached sheet for Additional Conditions
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
- This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1988
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

the Chairman of the Coastal Resources Commission.

(4) The disposal area effluent must be contained by pipe, trough or similar
device to a point at or below the mean low water mark to prevent gully erosion
and resultant unnecessary siltation.
(5) The terminal end of the pipeline must be positioned at or greater than 50'
from any part of the dike and a maximum distance from the spillways to allow
adequate settlement of suspended solids.
(6) A water control structure must be installed at the intake end of the effluent
pipe so as to assure compliance with Condition No. 9.
(7) The diked disposal area must be constructed a sufficient distance from the
MHW line or any marshland to eliminate the possibility of dike erosion into
or upon the adjacent waters and/or marshland.
Fill Area
(8) All filling associated with hardstand construction must be accomplished
inside of a silt barrier in order to assure compliance with Condition No.
9.
(9) The activity will be conducted in such a manner as to prevent significant
increase in turbidity outside the area of construction or construction-related
discharge.
NOTE: The permittee is, requested to consider possible benefits of riprap place-
ment on the entire riverward face of the fill in order to reduce long
term erosion and subsequent filling of adjacent shallow water habitat.
NOTE: A Sedimentation and Erosion Control plan has been approved for this project
by the Division of Land Resources.
NOTE: A Section 401 Water Quality Certification has been issued by the Division
of Environmental Management for this work.
NOTE: An Easement to fill is required for this project from the Department
of Administration.
NOTE: The permittee is advised to contact the Division of State Construction
to determine how N. C. Executive Order #31, i.e., "Uniform Flood Plan
.Management Policy" might affect this project.

CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to N. C. State Port Authority
pursuant to an application filed on the 25th day of September, 1987 to
construct a minor road crossing in conjunction with improvements at the
North Gate.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of a tributary
to Cape Fear River in conjunction with the proposed road crossing in New
Hanover County will not result in a violation of applicable Water
Quality Standards and discharge guidelines. Therefore, the State of
North Carolina certifies that this activity will not violate Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction-
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less
are not considered significant).
2. That all fill material be from an upland source and free of
any toxic materials.
3. That side slopes shall be vegetated upon completion to reduce
erosion.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.
This the 15 day of October, 1987.

Dear Mr. Mills:
Thank you for taking the time on September 22, 1987, to talk
with me about the above-referenced project. As we discussed,
enclosed, for your review, is the Paving, Grading, and Drainage
Plan for the North Gate Improvements project at the State Ports.
I have marked on the plan the area identified by Mr. Hugh Heine of
the Corps of Engineers as the wetland area that will be affected
by this project. Also enclosed is a portion of the plan Cover
Sheet showing the project area.
We request that you give consideration for granting the State
Ports a 401 Water Quality Certification for this project under
Nation-wide Permit No. 14, "Minor Road Crossing."
If you have any questions regarding this project or require
